Thanks, having not been in this situation before i was not aware of this, i sent a request to Orange yesterday enclosing a payment of £10.00 and also sent a copy to Arrow and once again informed them the account was in dispute, i am quite prepared to pay the money i owe Orange but not for the unsolicited text. will Arrow still continue with the SD action??

When i could not get Orange to stop the unwanted text being sent to me i told them i was closing the account and to send me a statement of all the outstanding, i then destroyed the sim card and went back on a different network, i then received a letter telling me i owed them £1100 i aske for statement so that i could check just what i had been charged for, i never received these statements so i could never contest the charges for the text that were being sent almost every hour of the day and night.

     

    In the above what you are saying is that even if a Subject Access request is sent Arrow do not have to comply with it!!!

     

    Arrow have told me they are the inhouse collections for Orange

I received the records that Arrow have kept on me but no statments of account and no credit agreement, last week a guy came to the gate and asked for me i was not in, on Friday i received a letter saying they would be coming on Thursday to hand me a SD, i rang them and said the account is in dispute and you still have not provided me with the information requested without they guy on the phone sounded quite young and he said Orange did not send them the statements just an amount of £1100 as being unpaid, and i should write to them again and tell them the account is in dispute.

    What should i do now wait for the SD or send a letter recorded delivery so they get it before thursday.

  4. The only reason i paid it in the first place was on the understanding that Capital would cancel the card, how can they take action against someone when they are also responsible. i warned them on both occasions that he would not be able to pay the debts.

In 2005 my son obtained a Capital one credit card with a limit of £1000, he is not very good with money so i knew he would get into touble with this card, within two months he was up to the limit and not making the monthly payment, i made the first two payment and then asked him to ring Capital one and cancel the card and give permission for me to speak to them over he phone i told i would be the bill in full if they cancelled it as he had asked.

    After two or three months i found a statement in his bedroom which showed that they had issed him with another card and he was up to his limit again as you can imagine i was very angry and made him ring them up and tell them to speak to me which he did, i asked why they had sent another card when the last time i spoke to them i told them he was hopeless with money and he had asked them to cancel the card, they said they had made a mistake sending out the second card and they were very sorry, i then said i would pay the bill in full once again but the account had to be closed and no new cards sent out,

    Within three weeks he had been sent a card and he was back up to the £1000, i have refused to pay it this time and there is no why my son can pay it because he just does not earn enough, could anyone suggest a solution because i think the next step will be taking him to court.

  6. I received another leter from Arrow today, saying they are in the process of requesting the documents relevant to my Data Protect Act 1998 request.

     

    I did not sign a contract i was on pay as you go and when i rang to add funds to my phone they asked me why i did not go on the monthly charging i agreed and that was that, biggest mistake i have made.

     

    They did not put a stamp on the envelope of the latest lettes and i had to pay £1.30 to the post office when i picked the letter up this morning

  7. the account was opened in 2006 i received a statement from Orange in June 2008 saying that the account balance was £0.00. and that the debt had been written of on the 29th May

     

    i had requested detailed copy of the bill that made up the charges they were asking me for.

     

    i made many phone calls to Orange to have the text stopped and was always given the same information which was, send stop to the text when i received them and also a phone number to ring to complain about the company sending them, but the text just kept on coming all times of the day and night.

    i paid the bill by cheque, there was no direct debit, i told orange to canell the phone because i had just paid a large phone bill,

     

    i have not received any itemised bill either from orange or Arrow, just a letter saying there is ample evidence available to prove the existence of a agreement between you and the original creditor, in the circumstances we shall be obliged to receive your proposals for repayment of your debt.

     

    The SAR i sent was copied from this site and a cheque for £10.00 was enclosed.

  8. am also having problems with Arrow Global they sent me a letter saying i owes them a debt assigned by Orange for £1149.45, and if it as not paid they would issue a statutory demand.

     

    i sent them a letter Subject Access Request letter and saying that i disputed owing this money and enclosed a cheque for £10.00.

     

    They replied to me today saying that the agreement was not covered by the Consumer Credit act1974 so they were not obliged to provide copy documentation and if they did not hear from me in the next seven days they would continue with the action.

     

    Can someone tell me where i go next??

    My account is now being dealt with a solicitor acting on behalf of Arrow. I have not missed a single payment but the solicitors have applied for a warrant of execution. I asked Arrow for a copy of my CCA and I have just received this email from the solicitors-

     

    We note your request for a copy of the "true signed agreement of the CCA". Regrettably, your request is invalid as no agreement currently exists for this matter. You did not comply with the terms of the Default Notice served upon you in November 2006 and, as a consequence, the agreement was terminated.

     

    Additionally, we would like to point out that we were instructed to act on our Clients behalf in this matter in November 2006. In the absence of a response to the Claim issued against you, forthwith Judgment was subsequently obtained against you in February 2008. A Charging Order application was then made and served upon you in March 2009 and the charge subsequently registered against your beneficial interest in your property.

     

    Throughout all of the above process, you have not once requested a copy of any agreement in this matter. You have also never disputed that you owe this debt, even making payments toward the Judgment balance. It is with all this in mind that our Client can confirm that it will not be providing you with a copy of the agreement.

     

     

    Are they right in what they are saying or do they need to produce an original signed agreement?? The debt was for a credit card.
