  1. Hey everyone,

     

    Been advised to start a thread cos I'm just entering the world of bank charge reclaiming and my head is hurting...............

     

    I estimate that Lloyds have taken between 6 and 8K from me in charges over the last 6 years and I'm determined to get it back. We are a single income family with 2 kids and simply cannot afford to lose that much money!

     

    Has anyone got any general gems of wisdom for me? I'd appreciate any input really. I've read through the site but am feeling a bit overwhelmed I have to admit. I'm prepared to take it to court but feel quite queasy at the same time!!!!!!!!!!

     

    Had some great help from the chatroom but all are welcome to advise me on anything they think might be relevant..................

    dont worry i have not completed an allocation questionaire, i spoke to the court clerk and was told the judge has made a date for august the first, i said but i havent received a AQ, the judge has desided that he wants both parties in court, ok if they dont show, but worried if they do...but good news rbs owed me £786.00 and sent two letters and they paid up no problem, but they cancelled my credit card, only owed £226.00 so im in pocket, good luck, cheers john

I will keep everyone up to date what happens to my claim with Lloyd TSB, at present Notice of Transfer of Proceedings:lol: Spoke to the local court Thursday and told that my case will move to another court 40 plus miles away as the courts are overburdend with bank charge cases, this could be to everyone advantage, as i'm sure the courts do not have the time to go sit every single claim, thats what im hoping........they will then be sending me and Lloyd TSB an allocation questionaire, and a date will then be issued in the new court, so almost there. good luck everyone with your claims John

Call your local court on monday, i had one rejected only because i put lloyds tsb as the claimant and defendant, then had to refile and pay another £120, so it set my claim back by three weeks, but it will be worth it in the end as i'm claimimg £1808.00, going on holiday as soon as they pay up:-) :-) :-) :-)

  4. on the mcol site does it say rejected or halted, mine said halted, meaning lloyds tsb have taken my case on, i spoke to the court and was told it will be sent to my local court next wednesday, the judge at my local court with then transfer it to another court and send me and lloyds solicitors a questionaire, as they will be doing then all in a block at a different court miles away for my local court but if i have to go i will.

     

    dont get stressed mate...when they pay ot will all be worth it.

  5. Go for it mate, im waiting on a court date, next week the court will issue one they told me this morning, i was worried because its not going to my local court not it going to another and they will deal with hundreds, martin gave me some good info earlier. good luck john

    I have just sent my first letter, requesting details of charges as per Data Protection Act. I am expecting the total sum of charges to be a fair whack.

     

    Current State of affairs

     

    Current account: £400 credit (OD facility -£600)

    Flexiloan: - £1999.00

    grad. loan: -£19200.00

     

     

    What I am curious / concerned about is if I claim back my 'unfair bank charges', what are they able to do to make my life difficult?

     

    I am under the impression they could recall the flexiloan.

     

    I do not think they are capable of closing the graduate loan as it has a seperate contract.

     

    Also I think you need an account from which to pay the loan with HSBC, so I can't see them closing my account.

     

    Does any one have any experience with this?

    I tried to close my account with Lloyds TSB 3 years ago, but because i had a loan with them i couldnt close the account, i did speak to a solicitor friend of mine and he said its legal and i cant close the account until the loan is paid off, i pay my loan by direct debit for another bank and have had a problems, but i still have to pay bank fees for having the account open, hope this helps, good luck John

  7. Hello everyone and good luck claiming your charges back.

     

    I have just receiced a Notice of Transfer of Proceedings from Northampton County Court to Brecon my local court, I spoke to the court this morning and they told me that a questionaire will be sent out next week to both myself and Lloyds TSB, the case will then be refered to Cardiff County Court as all bank charge claims will be dealt in one court, is this normal?

     

    Also does anybody have Terms and Conditions for Lloyds TSB going back as far as possible, as i have been told the new T & Cs have been updated and if i have to go to court i think the judge would not look likely on the bank doing this with all that is going on with the banks.
