  1. If you are in doubt about which form to use. You can send in a letter which the court will allow and explain in "normal English" what position etc you are in.

    They seem to prefer this rather than sending in a form that might not be filled out correctly.

    (The clerk I spoke to said that the judge preferred plain English as he knew exactly what we are on about and where we are at etc!!!!!! Afterall they know that we are not legally trained but an ordinary person).

  2. Hi, I also have had no bundle, sent a non - compliance letter to bank and court.

    Didn't seem to make a difference as I have had a stay made by the judge on my case which should have been tomorrow (13th August).

     

    Wish you luck and know what its like trying to juggle kids, house and legal issues all at the same time!

  3. Phoned end of July and was told that my case was going ahead. (13th August in Swindon)

    Got a letter on Friday 10th to say that

    "upon the court's own motion it is ordered that ..... my application is stayed until 1st February 2008"

     

    "This order has been made without a hearing under the Court's management powers in Part 3 of the Civil Procedure Rules. You may within 7 days of the service of this order apply to the courts to set aside or to vary the order under Part 23 rule 10. You must file with the court and serve on the other parties an application that sets out your reasons for objecting to the order. The original application ( if any) will be listed for hearing with your application unless you ask the court to vary the order without a hearing."

    I would welcome suggestions or advice! ( not pleased with the court for the lateness of stay, was due to appear tomorrow where I thought it would all end rather than another delay!)

  4. when I was looking through my account charges came across one:

    £30 charge for going over overdraft.

    Immediately after it: £30 refunded due to good management of account over last 6 months!

     

    Can I take this and include it in my court date next week if I need it. Surely this is proof in the way Abbey work with regards to overdrafts V Free banking?

     

    Advice needed!

  5. I spoke to the court yesterday.

    Spoke to a really helpful court manager who told me that most of the banks are not sending in their bundles even though it is still business as usual.

     

    Nothing has changed as far as the courts are concerned.

     

    He also said: it was our duty to follow up and chase the banks for the bundles.

    He stressed the importance of letting the court know of any additional letters/ calls that you might have to make in chasing up any matters.

     

    Said that they were not surprised that the banks were not sending their bundles as they all seemed to go for a settlement 2 or 3 days before the hearing.

  7. I have my court date on 13th August. I have been allocated to the Small Claims Track (Hearing) without filling an AQ as the judge did not issue them.

    Was asked to return the court bundle within 21 days which I have done.

     

    "Each party shall deliver to every other party and to the court office copies of all documents(including any experts' report)on which he intends to rely at the hearing no later than 21 days before the hearing."

     

    HAVENOT had anything from Abbey. Can I now ask the court to throw it out?

     

    Any suggestions please!!!!!!!!!!1

  8. I have been sent a court date for August 13th and have sent my court bundle off to the court and Abbey.

    I have not received anything from Abbey and assume that this is there way of delaying things.

    Is it worth me writing to them or shall I just write to the court to tell them the situation?

    I also wrote a letter asking for settlement which again seem to have been ignored.

     

    I am assuming that my case will still continue as normal in less I hear differently. (I shall contact the court tomorrow to find out.)

  9. Welcome all. This is my first post and am feeling anxious as I have had Notice of Transfer of Proceedings.

    All previous threads seem to say that you get an allocation questionnaire to fill out. This has been crossed through on my letter and I have no questionnaire.

    I am worried that I will not get a chance to state my case etc.

     

    Can anyone help?
