  2. My local court has agreed to waive the AQ stage and also the £150 charge.

     

    However, the court has said an allocation fee it to be charged - £100 and this is payable before x date.

     

    Can this £100 be added into the witness statement as court fees or is it an amount which just has to be paid and can't be claimed back?

     

    I've not seen this before as it was never mentioned when I claimed mine back but I'm helping a friend and so need to know as I'm doing their WS for them.

    I put an N244 into the Court and requested the money they were holding (after the hearing in October when Citi were ordered to pay my claim into Court) and I've had an order today saying that

     

    'The funds now in court totalling £530.61 be paid out forthwith to the Claimant'

     

    I've been asked for (and given) my bank details for the transfer to happen.

     

    I think that can be classed as a

     

    WIN

    knew I'd get there in the end...............

  4. a) A schedule setting out each charge repayment of which is sought , showing the date , amount and reason given ( if any) for the charge being made.

     

    This is a schedule of charges, the same as you have already sent to citi

     

    b) Copies of any statements or other documents relied upon as showing that every charge has been made

     

    This is a set of statements which show the charges on them

     

     

    c) A statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise.

     

    This is the rest of the court bundle - have a look in the templates libraray Basic Court Bundle

     

    d) Copies of decided cases and other legal materials relied upon.

     

    This is cases won (ie me, bongobaz, gizmo even though they haven't paid out yet!) plus anything else you feel is necessary for your case.

     

    Copy of it all to the court, copy of it all to Citi

  5. Cheers, I thought that might be the situation. I've given him the options and said he needs to decide. The 8% interest is over £500 and the daily interest is 41p a day, so it is up to him.

     

    I'd be prepared to go to court with him if it ever came to it as a litigation friend as I've had two Citicards hearings and an Abbey one over the last few months and I feel almost on first name terms with the DJ!!

  6. I'm helping my ex get his Barclays charges back.

     

    No mutterings from them on the prelim and LBA and claim issued through MCOL on Sunday.

     

    He has said he has a letter from them today dated yesterday offering £1380 against £1860 with a form to sign.

     

    It is a gesture of goodwill as full and final settlement and is from Customer services rather than the solicitors.

     

    What is the situation with Barclays and offers like this? Can he take the £1380 and carry on (with an amended claim) or does signing the letter mean what it says - full and final.

     

    Not up to speed with barclays as not done a claim with them myself so looking for advice.

    i will respond to the main point only rather that all since i have seen this letter at least a dozen times now its is simply tiresome to have to answer all the half baked misinformation it contains. i would be grateful if, I future, you could at least attempt to litigate on your own behalf and not by rote.

     

    my client does defend these cases although, naturally, it chooses not defend all as some are too small to be worth attending court. i can assure you that we will be attending court on the 8 May and will seek set aside on the grounds that you have failed to pay the sums you claiming as a debt. this simple yet telling point seems to elude many people. you claim is simply and opportunistic attempt to make money out of my client and will be defended.

    Have to say, that is the funniest letter I've seen from Brian in a while!

  8. ok, due to the prying eyes, I've not updated my thread so Brian isn't alerted to him not doing as ordered by the Court.

     

    However, to all those who are worried about their bullish claims about victories

     

    Citi have had their DEFENCE STRUCK OUT for my claim

     

    They did not comply with a previous order to provide information and have been ordered to pay me the full amount I am claiming within 14 days.

     

    Glass of red for me I think........
