  1. I hope so, like you said there's alot of us, and we need out money back. I'm sure the banks are rubbing their hands at the moment. The longer they can hang on to money, the better it is for them. I also wondered if the credit crunch might hold off any judgement, as the government has been bailing banks out. (I'm not sure where it's up to at the high courts right now)

  2. Well my case is now a couple of years old, and is still stayed. I was made redundant at the end of October as part of a full site closure. The redundancy money (what little there was of 3 years service) has now dried up. I'm struggling to get back in to work. I have a loan and VISA that I have to pay each month. Do you think I might have a chance of them reassesing under hardship? Does anybody know if any of these stays are being lifted, or how long it will be until the high courts make a ruling?

  3. Nope and neither should anyone else..........

     

    The Judge in my hearing at the Mercantile Courts Leeds held that the stay placed on my claims will be lifted automatically after the Jan Hearing has finished........and before any appeals to be heard to!!

     

    Patience........as Lula would say "is a dirty word!"........but it holds!

     

    Has this now been lifted as I haven't heard anything? Do I have to take any action at the moment, or do I wait?

  4. Hi Jo. Nothing was mentioned about an appeal, but I did say I objected to it. The Judge had made his decision before I even got there I think. Shame I had to take a day off work. Like you said, the DJ could have written to me. I just hope now the test case works in our favour

  5. well back home. Abbey showed up, tried the waiting room intimidation. Seems the judge decided to stay it. Abbey didn't even need to make the application. I did say my case was an old one, and felt it shouldn't be stayed. Nothing I could have done. Feel crushed. :(

  6. well after receiving a letter a few weeks back from Abbey telling me they would be applying for a stay, I have heard nothing. today's the day. I'm in Court at 11.50am. If you're watching Rekka, see you there!

  7. I will send today (already printed the letters off), but my court case is on Tuesday. Their letter to me was dated 7th August. I will hand post a copy to the court today, and there is a post office open in Asda all day, so I'll send the Abbey letter today special delivery. I don't know why the woman at MCOL would have said I don't need to contact Abbey.

  8. I'm a bit worried about not sending Abbey a letter stating I do not accept the small payment they put into my account as full and final. I phoned MCOL the day is happened, and asked the lady if I need to write to or contact Abbey, and she said no, just continue with the claim as it is. My hearing is on Tuesday. Could this jeopardise my case?

    I called them early last week, and they didn't say it was stayed. They did say some of the newer cases would be stayed, and the older ones were going through. Not sure which mine falls into.

  10. Well my preliminary hearing is scheduled for 4th Sept. I received a letter today from Abbey saying they are applying for a stay. Their letter strongly emphasises that the court is likely to let them have this pending the test case. A couple of month ago Abbey gave me part of the money. I immediately phoned MCOL (who were handling my claim at the time), they said no problem, we will log this. I asked them if I need to contact Abbey, and they said no, and just to continue. Abbey are now saying in this letter that I need to contact them to confirm that I accept this as full and final, or my case is likely to be thrown out.

     

    I made it clear to the court in my Schedule of Charges that Abbey have part paid, and to deduct it from the balance. I think again this is Abbey playing dirty, and I'll continue just to deal directly through the court.

     

    My partner just said to me if they didn't feel threatened, or I didn't stand a chance, they wouldn't have bothered saying all of this to me.

     

    They also said that after the test case, they will follow those guidelines, and not my claim.

     

    What do you guys think? Do you think the court might let them have the stay?

  11. I posted my Schedule of Charges through the letterbox of the court on Saturday (sent a copy to Abbey). I phoned the Court on Tues to check they had it, and they said yes, and they were happy. I asked them if I need to prepare anything else i.e a court bundle, and they said no. Has anybody else known this? My preliminary hearing is on 4th Sept via the small claims route

  13. I handposted a breakdown of the Schedule of Charges through the court letter bx last night (deducting the £718) Abbey have paid me (and attached a copy of their letter). I will ring the Court on Tuesday to make sure they got it. Hope this was the right thing.
