  4. Can anyone advise further, I'm really struggling with this one.

    British gas are not budging and stating their email from October 2014 is wrong.

    That the accounts were never settled.

     

    In the event where I found out that the bills were not cleared and closed as they had advised in 2014,

    then now that they are chasing me after 4 years of nothing

    can I defend it under the backbilling rule?

     

    If it was their error they told me accounts were settled and closed, can they reopen them?

  5. I've been going through my old emails, I never delete anything thankfully.

     

    I have responses from British Gas about a complaint I made in 2014 re: these bills.

     

    The resolve was to use my credit from different BG accounts to clear the two outstanding debts.

     

    In their email they state the two bills 'exact amounts they are demanding' have been cleared and in fact have credit balances remaining.

    Well now I have some ammunition, what a load of donuts.

  6. I have just received demands for final balances, gas and electric, after moving out 4 years ago.

     

    Firstly I did give final readings, as my ex LL was a problem, I also transferred my accounts to my new address, and still at the same address.

    I can't remember if I got final bills from that long ago.

     

    The demands I've received state they have tried contacting me several times, and that I have 28 days to pay or the will register defaults on my credit file!

     

    Any advice, I have emailed a complaint to them.

  7. I got a payday loan from PoundsTillPayday in 2010, I defaulted and was paying bit by bit.

    It was apparently 'assigned' to Merligen Investments.

     

    I've recently requested all documents, and have noted on the 'notice of assignment' that they have put QuickQuid down and not PoundsTillPayday, bad editing on their part I think.

     

    Quick question but what are the chances of defending if they goes for CCJ?

    I ended up taking this complaint to the ombudsman re: payday express, initially loan was taken out in May 2009, from then on the loan was rolled over every month until 2011. So I ended up paying over £2K for a £500 loan!

     

    The FO adjudicator has sent me a response advising that they are not willing to look into my complaint as the original loan was taken out in May 2009 over the six years. This is what they quote in their email:

     

    jurisdiction – application of the rules

     

     

     

    Under the rules that apply to our service, we cannot consider a complaint brought to the business more than six years after the relevant event. As set out by the FCA, DISP rule 2.8.2 says that if a consumer brings a complaint after six years, we should look at when the consumer should reasonably have known they had something to complain about. If the consumer should have known more than three years before they raised the complaint, we cannot look at it.

     

     

     

    The relevant time to bring the complaint to us would have been a maximum of six years from the initial point of lending, which was May 2009. Whilst I appreciate this may come as a disappointment, but in light of the time-bar, I am unable to look into this complaint further.

     

    They have given me to the 30th June if I want to request that this complaint is referred to the ombudsman ...

     

    Although I know that the initial loan was in May 2009 I assumed that each time you rolled over then it was creating a new 'contract / agreement'.

     

    Any suggestions on how I should respond? any advice greatly accepted.

  9. So far I have had several successes with Wageday Advance, Lending Stream and MyJar, and I still have several ongoing complaints with other pdl companies.

     

    With regards to Pounds till pay day, having read through a lot of the other threads its seems that as they were not based in the UK when I originally got loans from them then its quite unlikely to get a resolve. However, they have not even responded to my complaint, despite following their complaints policy. They have totally blanked me.

     

    My question is now that the 8 weeks is here, can I complain to the ombudsman based on this? that they have failed even to respond to my complaint. Its was sent after they became UK registered and therefore having to abide by the regulations. I know the FO problably will not look into my complaint re: loans, surely now they should follow their complaints procedure?

     

    Any advice before I attempt to go to the FO gladly received.

  10. Hi there, not hijacking your thread, but I have this problem with pounds till payday.

    They have not acknowledged or even responded to my complaint either.

    I have followed their complaints procedure and its now 8 weeks.

     

    Although the FOS will not look into the original complaint,

    I'm wondering if they would look into the complaint that they are 'not following their own complaints procedure' now that they are registered?

    Surely they should respond even if its a big 'NO'?

  11. Thank you Silverfox. On reading on the Ombudsman's website, they look into complaints 'outside the six years and should have known after 3 years there was a problem' under special circumstances. Many of the pdl's from payday UK were in 2010, and I spent all of 2010 rolling over the payday express loans. To me this is within the 6 years. Its just the should have known there was a problem after 3 years. Tbh I only saw the information recently that there was a chance you could claim compensation. Before now I thought that was it, in total from six different pdl companies I've paid over £8k in interest alone plus the initial loans.

     

    If anyone can give me an idea on what 'special circumstance' I could use to go to ombudsman I'd be very grateful!

  12. I'm just coming to my 8 week deadline for payday loan complaints, and just had a response from Payday Express and Payday UK. They have refused the complaint stating that firstly its older than 6 years and secondly its been longer than 3 years for me to realise there was a problem.

     

    Payday Express I had 2 loans 8.5.2009 £400 and 26.11.2009 £100, I then continued to rollover until January 2011. At that point I defaulted and started paying via a DMP. For £500 I have so far paid £2,472.07 and still owe £335.27.

     

    Payday UK I was loaning from these from 2008, but my last loans were 30.6.09 £350 26.2.2010 and 29.9.10 inbetween these dates I was rolling over and paying interest until again January 2011 when I defaulted. In total I borrowed £1,050 and I have paid back £2,642.39 and still have £195.11 outstanding.

     

    My question is is their refusal valid? they state that the ombudsman will not deal with this complaint.

  13. I am reposting about this here. Got a loan with WF february 2008. Initially a 3 year loan, but I ended up in a payplan dmp and still paying this loan now and probably will be for sometime yet.

     

    I found some old WF paperwork which shows PPI on the loan, I didnt request this, in fact I told them I didnt need cover working for the NHS I get sickness cover full pay for the first 12 months, reduced thereafter.

     

    So I never realised I had got PPI cover on it, my fault I didnt check the paperwork properly initially but it is a bit vague on there.

     

    Now I want to claim it back with the hope that I can clear my outstanding balance. WF have never defaulted the account and its still with them.

     

    First, should I SAR them? as I have most of the details here? I find their statements difficult to understand and I am assuming the monthly capitalisation fee is the months interest applied.

     

    Help, advice anything kindly accepted.

  14. I have been reading through my old paperwork with WF from February 2008. I noticed in the figures they have put a figure in for PPI £1441.28. I never noticed this during the application, my fault. I told them at the time I didnt want any protection as I work for NHS and get paid sickness at full for the the first 12 months and then a reduced amount thereafter.

     

    I've paid over £8k on this loan and still another £2k to go, is it too late to claim my PPI back? and will this clear the remaining balance (ideally :) )
