  1. Hi Lisa

    I signed up for a 3 year contract too at a "Feel good fitness" gym, harlands take the direct debit and I couldn't get out of it, reading my contract now you have to have been made redundant, moved so many miles from the gym (with proof that a bill is going to new address), prove facilities aren't as promised, or be pregnant.

     

    I am still paying for the gym but don't use it, stuck with them :(

  2. Can you explain why you thought you would be paid for the whole month when you only worked to the 20th?

     

    Hi Emmzi, I wrongly assumed that as my holiday was based on me working the whole month that i was getting paid until 30th September.

     

    @ assisted blonde - I knew I had taken more holiday so this is why I checked, I had taken two more days than I should have, so my as my last working date was tuesday 18th, I worked the wed and Thursday to compensate / not get deducted.

     

    those two days have still been deducted.

     

    Am I correct to chase these two days?

    My last working date was Tuesday 18th September but when I checked with HR how many holidays (A/L year starts Feb 25th). I had used compared to my entitlement i was told my entitlement was 14.5 days to the end of Sept and I had taken 16.5 days. To compensate this I work Wed and Thursday to avoid being deducted.

     

    I have recently started a new job. my final pay was paid on Thursday 27th. and the two days £128.75 in total has been deducted. I was also deducted 6 days as i left before the month depsite me being under the impression I would be paid for the whole month of Sept.

     

    Please can someone confirm I am right in chasing this money especially the 2x deducted days, no matter what way I work it out i still get to the fact that I worked Wed and Thursday to avoid me being deducted. Surely I could have left Tuesday and been no worse off?

  4. Hi all

     

    I am in month 7 of 18 mobile broadband and want to cancel this, Orange tell me I can't do this unless I pay £132 for the remainder of the contract. Where can I go as I dont want to pay this amount, but dont want to pay an additional monthly £12 on top of my phone bill.

     

    Sales advisor told me when purchasing this contract I can change it at any time but now this is not the case. Sales advisor also promised speeds but I am finding it very slow to use indeed.

     

    Any help gratefully received.

    I have Correspondence Department, PO Box 10, Patchway, Bristol, BS32 4BQ address from them for my complaint, but unsure if I have a leg to stand on..

    The last thing I sent was the Prelim letter detailing my claim amount, I havent done anything else yet, I assumed I had to wait for the Test case..

     

    I need a little trip to the step by step thread....

    I have been off this site for a while, and I still havent heard anymore from HSBC, after those letters I received a while ago.

    What was the outcome of that test case, and what can i do to push this further?

    I have received a letter today which is very long bascially saying about a test case and will keep me updated as and when... it goes like this:

     

    "We acknowledge receipt of your complaint about bank charges. We believe that your complaint concerns the level, fairness or lawfuness of the charges. If it concerns something else, such as administrative error, please let us know.

     

    We do not agree that our charges are in any way unfair or unenforceable.

     

    However, the bank (along with a number of other banks) has now become involved in legal proceedings with the Office of Fair Trading ("OFT") in relation to bank charges which we believe will resolve the legal issues regarding the fairness and legality of your bank charges.

     

    It would be our normal approach to resolve your complaint through our internal complaints process as quickly as possible. However, until the determination of the legal issues in the above proceedings, we have asked the Financial Services Authority ("FSA") to suspend the normal timetable for dealing with bank charges complaints, and the FSA has agreed to this request subject to conditions that protect yuor rights.

     

    We can assure you we have registered and stored your complaint. Please retain your bank records, as this will make it easier for you to support your complaint on resolution of the test case. Once the legal proceedings between the OHT and the banks finish, we will resolve your complaint as quickly as possible.

     

    We are sorry that we have not been able to respond in full to your complaint now, but we (together with the FSA and the OFT) think that it is necessary to resolve the key legal issues before we decide how we should respond to your complaint.

     

    Obviously, exactly what will happen next will depend on the courts. We do not know how long the case will take - we have promised to proceed as quickly as possible but inevitably, given the importance of the issues being considered, this may take many months to finally resolve. But we can assue you that once the legal proceedings are completed we will resolve your complaint as quickly as possible. If at that stage you do not agree with our conclusions you will of course be able to refer your case to the Financial Ombudman Service ("FOS") (or the courts).

     

    Given this court case we have asked both the FOS and the courts not to proceed with any other case they are hearing until the test case is resolved. FOS has indicated that as a general proposition it will indeed not proceed with cases which rely on the legal issues being considered in the test case. Similarly, you should be aware that if you choose to issue a claim in the Courts, we will immediately apply to the Court for an order to stay your action until resolution of the bank's proceedings with OFT.

     

    The FSA requires us to ensure that your complaint will not be adversely affected by the edlay in dealing with it and we can assure you that this will be the case.

  9. Cheers Jo thats put my mind at rest a bit, I am up to date on payments on my loan, i dont have a credit card, but my plan was to balance transfer, which has fallen through anyway.

    Thanks both for your replies, but my Father means, as i'm claiming from HSBC, and say i win back all my fees, will it affect the loan i have with them, so in other words the total of my claim will be taken off my loan amount left to repay.

     

    Does that make sense?
