  1. Hi I have just chased up the court to see when my court date will be and the lady said I should put in a request for judgement. Please can someone tell me what this is. I tried looking for what this means but cant find. Any help gratefully received. Gertrude
  2. Thank you Arthur P and Buzby for your relplies, I knew there would be a biker out there somwhere. The pothole is around the edge of a manhole cover which was replaced by Welsh water and it was only a temporary reinstatement (on 1st Aug 2003 and the accident happened in APril 2006)). Council said they have taken reasonable measures to maintain the road by having a system of inspection and repair. The pothole was 75mm deep and 300mm long and 150mm wide. I can't believe they are allowed to get away with this. I dread to think what whould have happened if a cyclist had hit this. I am going to investigate further. thanks Gertrude
  3. Hi I am trying to help my brother in law who is an advanced motorcyclist of many years. He also teaches people to ride bikes. 22/4/06 He struck a large hole alongside a manhole cover. He nearly came off and bike wheel rim was buckled. Took this up with Merthyr Tydfil CBC who sent claim forms. Estimates were sent to their legal reps who are B4. B4 advised him that the manhole cover had been replaced and surrounding area temporarily reinstated on 1st August 2003 by their client Welsh Water. As of the date of his incident (22/4/06) a permanent repair had not been completed. He has taken excellent pictures of the damaged wheel and pot hole. He contacted Welsh Water who has said they have checked their work planning records for the last 5 years and confirms no report of this defect has been received. This cover is not a fresh water cover. He wrote back to B4 on 19/11/06 stating that the ball has been put back in their court etc and was going to take them to small claims court. Letter back from B4 stating that the Council have in place a reasonable system of inspection for the location concerned they will be said to have a defence to the claim. As we have previously advised the law relating to this is contained within the Highways Act 1980. Please could anyone give me advice if this is worth persuing (if my brother in law has not left it too late), I feel it is, but dont know enough about the law. Going by the pictures of the pothole I would think he has every right to claim back money for repairs. thanks Gertrude

  5. :idea: Hi I sent my claim force to the county court on 24/4/07 The court sent to Barclays on 25/4/07 and it will deemed to be served on 27/4/07 Barclays have until 11th may to reply. Today 28/4 I received a letter from Barclays stating the usual garbage and offering me half of what I am claiming. Do I have to bother to do a rejection letter accepting their offer as part payment or as it is so late in the day can I ignore it? They state that if they do not hear from me within 8 weeks they assume my complaint is resolved. many thanks in advance

I have sent my LBA stating that I will also be submitting a Consumer Credit Act 1974 complaint to the OFT upon the basis that they have failed to comply with the OFT's direction of 5th April 06 etc. Has anyone already done this and is there a template letter I could use. I had better send one now that I have said I would. Help would be much appreciated. thanks Gertrude

  9. I have just sent my LBA and I confirmed I would be sending a lConsumer Credit Act 1974 etter of complaint to the OFT. Is there a template letter anywhere I could use? I have been searching for a while with no luck thanks Gertrude:confused:
  10. Update so far as follows: SAR sent 20/2/07 Received statements on 12/3/07. They returned £10 fee which I sent for the statements. Sent req for payment of charges letter on 26/3/07 giving them 14 days which is up on 9/4/07. As this falls over Easter should I give them longer? Received the following letter back today 4/4/07 stating that they will let me have an answer or update as quickly as possible but no later than 25th April. Should i first a) give them longer for the Easter period and b) Give them to the 25th April thanks Gertrude

  16. Sent my first letter, SAR and have received this reply. "Please be aware that the bank is not under obligation to present information according to any particular format. Therefore, your request to assemble a schedule of charges is turned aside. You may of course obtain this data from copy statements and these will be supplied to you within the next few weeks without charge on this occasion. We would advise however, that statement information prior to 2000 is stored manually rather than on computer. Therefore, if your account was opened prior to this time, there may be an increase in the time required to collate the information you have requested. I apologise in advance should this delay be the cause of any inconvenience to you. As regards your mention of "manual Iintervention", the DPA does not oblige the Bank to comment about internal policies and procedures. Furthermore, in the context of managing day to day ttransactions arising from out of order accounts, the Bank does not hold the information you have requested in a form that would be covered by the DPA. Whilst aggregated information is retained for statistical purposes, this would not constitute "personal data", under the DPA and therefore would not be covered by a s.7 DPA subject access request. For the avoidance of doubt, the fact that we do not generally record information in a way that is caught by the provisions of the DPA, is in no way an admission that there was no such manual intervention. As the Bank is providing the copy statement on a complimentary basis your payment is returned herewith." I am not sure what they are trying to say regarding manual intervention.   17. A friend of mine told me about this site and I would very much like to make use of it to claim back excessive bank charges although it does seem rather daunting. I am not sure if I can do this myself.
