  1. Hello Everyone

    Thank you all for your comments of support and congratulations, what a fanastic website this is!

     

     

    Just FYI I checked my bank account yesterday (20 June 2007) and the full amount had been paid in, and that is just 4 days after the court hearing.

    I received my order from the court on Monday and the funds paid in on the Tuesday, I was thinking Lloyds were going to drag their heels until the 28 days were nearly up.

     

    Happy reclaiming, and dont lose faith!

    Yes I had added the 8% statutory interest when I submitted my schedule of charges to the court and the bank.

    If you check at the very beginning of my thread (page one, #2) you will see a section pasted by Barty which was a god send!

    I did have my own thread where people were offering me advice, I just got a bit scared thats all! - anyway I have some great news! see a copy of my paste from my own thread earlier today:

     

     

    Hi everyone

     

    I have just literally got back from court and I have very good news.

     

    The Lloyds TSB representative was there waiting for me which really put me on edge...however, she met with me outside the court to offer me full settlement of my claim plus the £220 court fees.

     

    We then went into court, (there were about 20 people all in all, in the court being heard at the same time). Basically they had a list of people reclaiming their bank charges from First Direct, RBS, Nationwide, Barclays and Lloyds and all 20 of us entered the court room together.

     

    The Lloyds representative then informed the judge that we had agreed to a settlement. She then had to go draw up what we had agreed which was £3,461.02 plus £220 court fees on a piece of paper.

     

    The judge then ruled that he was happy with this and informed us that we will be receiving an 'order' from the court in due course in my favour.

     

    I was then informed that I should expect to get the money within 28 days!

     

    A very long and scarey process, but I am so thrilled at the outcome and thrilled that I was given support so much through this site that I had the confidence to turn up to court and present my case.

     

    Thank you all so much for your support and wishes of luck, I hope this inspires many others to continue with this process, especially Amber Ellie, I am sure the same thing will happen with your case.

     

    I shall report back when I actually receive the funds into my account.

  4. HA! it sure did drop, it was so awful! however, that feeling didnt last long and the representatives acting on behalf of the banks were all really nice actually so there was nothing to be scared of ....

    Thanks for the comments, and I wish you all the luck in getting your money back, I would be interested to be kept updated by you all and will keep my fingers crossed for each of your cases!

  6. Well it is the morning of the court case and still nothing in my bank account and nothing in the post.

    I shall be setting off shortly to the court and will report back my judgement later.

  7. I have just double checked my court papers and it says:

     

    Signed statements setting out the evidence of all witnesses on whom each party intends to rely shall be prepared and copies included in the documents mentioned at (a). This includes the evidence of the parties themselves and of any other witnesses whether or not the witnesses are going to come to Court to give evidence.

     

    I dont need that right?

  10. Hi there

    I have followed all the processes to the letter following this site, but I have my court day tomorrow - 14 June at 10.00am and I have received nothing through the post except a letter from them stating that they know I am going to court and that they will not seek to retrieve the £690 they have already given me. I submitted by court bundle at the end of April 2007.

    I do not know how to link into my thread but its called: Lloyds TSB Defending.

    Why are things never simple for me, I knew I would be the one having to actually go to court.

    I was hoping to have received a cheque through the post this morning from Lloyds as my court date is tomorrow.

    I received nothing and my appointment is at 10.00am.

    I guess I just turn up and hope that Lloyds don't?

    If you check earlier in my thread back (page 1)to 6 March ish...there is a really useful link by Barty to help re: allocation questionnaire.

    You only receive an allocation questionnaire when you have a court date I think, well I think that is what happened to me...and I also believe you can ask for a different court, it should have the details on the original form from Northampton telling you which court you were going to be going to, I think there was a section which said if you wanted to change your local court.

  13. Well, it is the 8 June 2007.

    I am due in court on Thursday 14 June and I wasn't expecting to hear anything from Lloyds TSB until then.

    However, this morning I open my post - the envelope is marked Lloyds, I got terribly excited thinking it might be them offering me a settlement.

    But no, it wasn't it was a letter stating:

     

    Thank you for your letter dated 20 February 2007. I am sorry that you've not been happy withour response so far.

    I am unable to add to our letter dated 12 February 2007. This is because we have already outlined our position on the points you have raised.

    I can see that you have already issued a court claim for repayment of these fees and that our solicitors are dealing with it. If you are successful in your claim, this figure will be deducted from any award that may be made. Other than this, we will not be making any attempt to reclaim this money.

    Thank you once again for taking the time to raise your concerns with us.

    I shall hopefully be reporting back next week with another success story...I do have some niggling bad feelings about it though!

  14. Has anybody managed to push Lloyds into passing their money over sooner than just waiting to hear from them prior to the court date.

    I was just wondering if anyone had used any tactics or know where to call to check they have received the paperwork etc....

    Just a thought, do excuse my itchy feet and anxiety.

    Hi all just to report I have heard nothing from the bank as of today's date.

    I rang the court just to confirm they had received my paperwork and they had so this waiting game is getting very dull now.

    Hopefully I will update you soon with some better news

  16. Well I have started my reclaim today

    I have to say Egg were very helpful and nice over the phone. All I did was ring this number as posted in another thread by Elise Driver: 0845 1 233 233 and I asked them that I wanted my statements going back six years and he said ok...said he would have to charge me £10 for each account as I have 3 accounts which I am happy enough to pay for and I will receive them within the next 5 - 7 working days. Much easier than all that letter writing to the banks!

    So we will see what happens. I shall keep you updated.

    I appreciate your points and helps to clarify their way of thinking... the trouble is the pot hole is on a single track road, stretching over half of it so it was unavoidable, especially in the dark, even driving at slow speeds.

    The pot hole was repaired thanks to my complaining, which is great, but I just wonder how many other people using that road for the first time caused damage to their vehicles and are too worried to complain as they will think they wont get anywhere ... I can see their point!

    The fact is, in their leaflet, it states that you can complain if you think that SCC have not maintained the road to the a satisfactory level. They haven't so I do not see how they can say to me that it is not their responsbility? who else is responsible for maintaining the roads?

    Anyway, thanks for the advice, I have done the said court threatening letter, so will see what happens from there.

  18. Hi

    I rang up on the 15 February, the day after I damaged the 2nd wheel cos I was just so cross that I did both wheels within a week of each other. I thought enough was enough. The problem I have is if I was driving down that road for the first time, not knowing it was there, how would I have known to complain about it before hand?

    However, i have my history documents which they have sent me and it states as follows:

    15 February - Enquiry logged ins leaflet sent

    16 February - Enwuiry logged by an officer

    6 March - Caller rang again to say that pothole is getting worse, spreading in size

    9 March - Officer logged

    9 March - Caller rang again to say that the pothole is getting worse and spreading in size

    They have also sent me Defect Details of that road detailing all the other complaints about the road in general.

    They seem to be proud of the fact that the road was last inspected in May 2006 !

    Getting more angry by the minute :D

Oh how annoying ... the simple facts are that it was impossible to avoid the pot hole and it damaged two alloy wheels and it is down to them to maintain the roads and they haven't, the rest of the road is totally undriveable as well, it is totally ridiculous, when do they admit responsibility then? I am so angry, I am £418 out of pocket, wish I could upload the pictures to show you how huge it was, it stretched across the whole of the road practically.

    I live in Cranleigh in Surrey so a bit away from Birmingham.

    Thanks Blacksheep - they have been notified about the poor condition of the road, by me, on several ocassions....I think there should be similar forum set up - like there is for reclaiming bank charges, with template letters etc which the council will take seriously!

    SCC SUCKS!
