  1. Hi all,

     

    my court date is rapidly approaching (August 3rd) - i havent been asked to send anything in yet by the court. However as everything needs to be sent to the court 14 days before the hearing, i assume i should sent documents in now.

     

    can anyone tell me what i shold do? - i will shortly be sending off my up to date schedule of charges, together with highlighted statements. what else do i need to send?

     

    if anyone is in the same position, i would be grateful to hear from you.

    I received a letter from the Court confirming the court date for 3rd August.

     

    I called the court who confirmed i did not need to do anything at the moment.

     

    Has anyone else received a court date too?

     

    Is it A & L's intention to wait until the very last minute before the court date, to pay out?

    I called the Bristol County Court today who confirmed that the case has been transferred to them. They said that i should hear shortly with regards to what will happen next & at the moment i dont need to fill out an allocation questionnaire until i am sent one.

    I have received the defence papers from Wragge & Co detailing, in 25 points, how their charges are reasonable etc.

     

    Has anyone else received something similar?

     

    Do I need to respond in any way?

  5. Hi all,

     

    After receiving no payment following my LBA, I have progressed my claim onto the courts.

     

    I issued my MCOL on 02/05 for a total of £1,200 (inc court fee) and sent the schedule of charges onto the court.

     

    I have today received a letter from A & L saying that they believe their charges are fair, blah, blah, and offered a measly £324.50 (chq included) in full and final settlement.

     

    Obviously i am not going to accept this and will destroy the cheque. Does anyone have any suggestions of a reply - i was thinking along the lines of 'i do not accept your offer and will only accept £1200.00, enclosing the schedule of charges' - is there any template i can use for this?

     

    I have also received a letter from A & L Solicitors, confirming they will defend the claim. is this anything to worry about? anyone been through similar process and can advise what might happen next?

     

    any helpful comments much appreciated.

  6. After returning my payment and ID on 22 March 2007, i received a letter from MBNA dated 3 April 2007 confirming receipt of my payment and ID and saying they will send me all the info in the next 40 days! - Even though my initial SAR was back on the 7th Feb 2007!

     

    I have today written to MBNA stating i do not accept they have a further 40 days to comply & if i dont receive a reply in the next 7 days i will be submitting a court claim for non-compliance.

     

    I will endeavour to keep you all updated!

    Ive just called A & L who advised that my account was opened in June 2001. The copy statements they have sent free of charge only goes back to March 2003!

     

    God knows what charges they've tried to keep from me. I think you're right, I will need to return the chq with my ID and get full statements.

     

    how long do they have to send the full statements to me, given the fact that the 40 days has already expired? (it says in the letter they have another 40 days to send them?!)

     

    how would i word it?

  8. Thanks for that info.

     

    I have a few statements for last year, so have checked them against the copy statements they sent me and all the charges (late fees and payment fees) are all on there, so I think i will proceed on the info they have sent me.

     

    Is there a template letter to say that i accept their offer as partial payment but will be pursuing the rest?

     

    also, to clarify, can i only add the contractual interest (24.9%) onto my claim if i have to do a MCOL?

    I have received a letter from A & L today in response to my SAR letter.

     

    It states how their charges are fair etc. They have returned the £10 cheque and provided details of all the charges free of charge!

     

    They have also offered £480 in full and final settlement - am i right in saying that i accept this as partial payment of the claim as long as they settle the rest?

     

    Could someone please clarify if i can claim back the following:

     

    Cash Advance interest (Promotional Cash Interest charged)

     

    Retail Interest (Promotional Retail Interest charged)

     

    Cash Advance Interest (Cash Interest charged)

     

    Retail Interest (Retail Interest charged)

    i am putting a claim through and have reached the MCOL stage.

     

    When i send the schedule of charges to the courts (3 copies) do i change it to show the days since offence as of today, which would increase the 8% APR amount?

     

    It would be a different amount from the schedule of charges i sent with my LBA letter.......

    After reading about opening up a 'parachute' account incase A&L close my current one down, ive been applying (but keep being turnt down) for a new account elsewhere.

     

    Ive tried Cahoot, Co-operative, Nationwide, Abbey - but ive been turned down by all of them.

     

    I know my credit rating is poor and this is the reason why im being rejected.

     

    does anyone have any ideas please?!
