  1. hi zoot, they have obviously applied the E.R.C. £3000.00 approx. they have applied the following DD rejection, Monthly arrears fee, admin fees, deeds fees, debt counsellors fees, deeds fees, legal fees to the total of another £3000.00 aaprox.

Hi folks, just preparing my Pre-lim for my charges and my E.R.C.s for Mortgages plc. could anyone give me guidance on what i can claim for with the charges and also any templates for sending both the letters to the charming people........ all help would be much appreciated............. thanks t.d.

  4. Hi Kriso. I would say you will accept the offer but only as a partial payment. I normally underline the wording regarding Partial Payment, it helps to let them understand that you are serious. Remember to send it Recorded or Special delivery, as they cannot come back and say its not been received. Cheers T.D.
  5. Hi, i was offered the exact same deal. They owe me £904.00 but offered me £283.00 with the reduced £12 charge........what a cheek. LBA gone for the Full amount! Lets see what happens now. T.D.
  6. Hi, i too had a second offer of £3067.00, first was £1000.00. Have accepted it as a partial payment and sent my letter back to T.Mclean. Tuesday is D-Day and i cant wait to register my claim online for £5199.00 Max (£5000.00). It equates to nearly £7000.00 with the interest of 8%. I,ll keep you posted..... T.D.
  7. Hi, Firstly, are you claiming through the English small claims system? you mentioned the Moneyclaim (MCOL) which is the English Small Claims version. If you are not a resident in England you must have an English address for a base for any replies from the court. Second, the maximum is £5000.00 principle sum (the amount you are claiming for)in England. In Scotland it is either £750.00 Small Claims, or £1500.00 Summary Cause Claim. (both a £39.00 fee) When you register the claim, the % will be automatic when your claim is paid out. The fee is £120.00 paid up front online- debit or credit card, and will be paid back to you when your claim is finalised. I think i,ve kinda covered everything Hope this helps. Cheers T.D.
  8. Hi Les, i had a Mortgage with mortgages plc (Glasgow), where was your mortgage held and where did you write to for your DAR? Up until June this year it's probably cost me about £500.00+ in admin charges and it cost me over £3k in ERC. Could you please give me advice on what letters you used from the start of your claim!? I have a feeling this is gonna be a fight with Mortgages PLC! Cheers in advance.. T.D.

Must be a busy day for old Tommy boy........I received a cheeky wee letter offering me £1000.00!!! £4199.00 short i,m afraid.....Have drafted up the letter for acceptance of the £1000.00 as partial payment.here it is any suggestions of alterations? 'Dear Mr. McLean, Firstly, thank you for your prompt response to my letter dated 11/10/2006. (copy attached) I am in now in receipt of your letter dated 17/10/2006, received on 19/10/2006 and note its contents. With regard to your offer of £1000.00 I am prepared to accept this amount in partial payment of my claim of £5199.00. As I have now, no banking facilities with your organisation, I would appreciate if you would forward your offer of £1000.00 partial payment by cheque to my address as shown above. Please note, if it becomes necessary to proceed with legal proceedings for the balance then my claim at that time will include interest pursuant to statute and my court costs. I look forward to the remainder of the payment amount by return of post. Yours sincerely anybody any suggestions, does this read ok or does it need altered? Roll on the 24th and it's MCOL....+ interest........ Cheers T.D.
  10. Hi Murmagic, If you are sending your LBA include the full principle sum of money that you are claiming for (£946.00). Include your spreadsheet but without the interest. Remember to state at the end of the LBA letter something on the lines of - "If you do not comply fully within 14 days then i shall begin a claim against you for the full amount as stated, plus interest, plus my costs and without further notice" (You will only get the interest back if you win the case in front of the sheriff, or if they default after 21 days when you register the claim at court so don't include the interest spreadsheet until you register the claim at court!) After the 14 days are up you would be better registering the claim through the Summary Cause route at the Sheriff Court. This costs the same £39.00, and is basically completed the same as the Small Claims paperwork. (check with the staff in your sheriff court, they are normally very helpful) Good luck, let me know how you get on....... Cheers T.D.
  11. Hi Ian, The small claims pocedure is very simple up here in Scotland, and I dare say it is very similar in principle down in England. Have a trip down to your local court in the meantime and speak to the staff, they will give you advice on what details you need and what paperwork/ information you are required to submit. Just remember this - NONE OF THE ESTABLISHMENTS REALLY WANT TO GO TO COURT AND ARE PAYING OUT BEFORE IT ACTUALLY HAPPENS! Stick to your dates for LBA etc. Good Luck... T.D.
  12. Hi ya! The principal sum (the amount of charges that you are claiming and not including the interest or costs!) are £750.00 for small claims and £1500.00 for summary cause. I,m led to beleive that he defender has 21 days to lodge a defence from when you lodge your claim at the court. Only if they don't defend within the 21 days, or lose after defending do you get the interest and the costs back! Hope this helps?? T.D.
  13. Hi folks, "YIPPPEEE", recieved a cheque from Clydesdale Financial Services for half the charges! Unfortunately for them i had already registered 2 small claims on Thursday 12th October so i have sent the acceptance letter as part payment. Lets see what they do now........ Thank you to everybody on this forum, my life it now starting to change dramatically.......Donation will follow as soon as the Cheque has cleared.
