  5. So far, I've given you as much information as I have. We have been invited to a launch event (which makes it sound positive when we all know it's not) and that will be our opportunity to ask questions and meet with the Unions. However, I have since been forwarded an email which has been sent to managers of those staff being reviewed which says, "staff will be invited to partake in a diary exercise" - this would suggest to me that it cannot be enforced. There are 15 of us working together on this, I'm not niaive enough to think I can tackle them on my own.
  6. My Job Descriptions says "This is not an exhaustive list of duties and responsibilities. The post holder may be required to undertake other duties which fall within the grade of the job, in discussion with the Line Manager." However, the email which has gone out to managers says that staff will be invited to take part in a diary exercise - which suggests it's not compulsory. We have been invited to one of two launch events to provide more information about the process, but these have been arranged for 2 and 5 April - slap bang in the middle of the easter holidays when lots of staff will be on leave, which makes me more suspicious of their intentions. I have also had it confirmed that this is a cost saving exercise and I am loathe to assist them in cutting my pay! Thanks
  7. Our employers (local NHS Trust) have advised that they will be undertaking a review of admin staff within our area of work. Similar reviews have already been held in other divisions which have resulted in all staff being placed at risk before being down-graded and moved to new areas of work in many cases. Some staff retained their original job and grade. No staff at all have received an upgrade - this is purely a cost saving exercise reworded as a staff review. As part of this process we have been told we need to keep a work diary for one week, detailing in 15 minute sessions, what we do all day. This information will then be used to decide whether staff need to be downgraded. As this task is clearly for management to see if they can pay us less for what we do, I am trying to discover whether we are legally obliged to complete this diary exercise.   8. Hi there I am in exactly the same position. My account was being managed by Bryan Carter and I agreed to a full and final settlement, which was confirmed in writing. I have reclaimed charges which they have said have been refunded to my account as it was only partially settled. Contacted Bryan Carter who confirmed that the terms of the settlement were full and final and the balance is zero, but Cap 1 will not pay up. I have just referred this to the Financial Ombudsman to see if they can help.
  9. A couple of years ago we owed money on a few cards and agreed settlement figures on some of them in full and final settlement. Capital One was one of them and a couple of weeks ago they offered £413 as a refund of charges owed. Although this was less than I was requesting, I agreed to accept if the payment was made by cheque and sent by return. After several weeks I hadnt received it. I phoned Cap One who said that because the account had been partially settled the refunded amount had been applied to the outstanding balance. As I had written confirmation from the DMA to say that payment had been accepted in full and final settlement I queried this but was told that they would not pay. I contacted the DMA who have since confirmed in writing that agreement was made at the time for the account to be settled in full and that the balance is £0, however, Capital One are continuing to dispute this. I have phoned Cap One today who said that they had contacted the DMA and this was an error, that the DMA had no right to agree such a settlement, that a balance remains and therefore they will not be sending me the money. I phoned the DMA who said that no contact had been made by Cap One, that the terms were for full and final settlement, the balance is zero and Cap One are talking rubbish. My question is (I get there in the end!!!) what can I do to make them give me my money? Please help. Thanks
  10. Let me begin at the beginning. A few years ago we got into some financial difficulties and our Capital One card was passed to Bryan Carter Solicitors for collection. Two years ago we had some money and offered £3750 against an outstanding balance of £5800. This was accepted and I have a letter to confirm this was in full and final settlement of the account. I have recently been successful in claiming £413 from Capital One for charges applied to my account. However, they have now written to me telling me that they have paid this money back into my account as there is still an outstanding balance. Being as this account was settled as above, and I have the letter of confirmation in respect of this, are they allowed to do this or are they trying to pull a fast one. I have called them and they are trying to say that the amount I paid was a partial settlement so I called Bryan Carter who confirmed it was full and final settlement. How can I get my money???

  12. Hi I wonder if anyone can give me any advice. I wrote to Halifax regarding a DSAR in March enclosing my cheque for £10 which they cashed shortly afterwards. I received nothing from them until 27 April 2007 when they wrote to me to say that the information I requested had been ordered and would be sent to me shortly. I was given a telephone number to call if the statements had not been received within 2 weeks. It is now 25 June and I am still waiting. I have called the number quoted on the letter but its just an answering machine message telling me that statements will be sent within 40 days (a clear lie!!!). I wrote again on 25 May and have telephone the complaints department 3 times. They have told me on each occasion that they cannot put me through, but they said they would email the relevant department to chase my request and ask someone to make contact with me. I have heard nothing. I dont know how I can proceed without this information. Can I estimate a claim? Although I really would have no idea at where to pitch this. Has anyone else had the same problem. Does anyone have the phone numbers of someone who actually had a clue at the Halifax? Thanks guys
  13. I completed a registration form before my child started there, but that was more to do with details about her, next of kin, gp details, etc.
  14. There was no loan and there is no credit agreement. I simply got way way behind in paying the nursery costs because I was so much in debt at the time. They didnt remind me so I fooled myself into believing that I didnt owe them very much. It was only when they hit me with an outstanding bill which had run into thousands that I began to panic and realised I couldnt pay them back. The debt has now increased because when it was passed to the debt collection agency, they added on interest as well as their charges.
  15. We are paying for the full Sky package, but we never go out, so we have to do something!!! Broadband is basic package, plus we are tied into this. The clothing/uniform/work wear/misc budget is a little high, but I have two school age children so the budget has to take into account their needs, and you know how fast they grow!!! The house is ours and mortgaged.
