  1. the court part I read on here in a thread or two...one of them went on for 18 pages lol... The suggestion appears to me (knowing very little) that as they weren't regulated prior to 2004/5 they just tell you to go away, the threads I've read 1 went to court and another was certainly on its way to court. Although they were going after DAFS rather than the underwriter of the PPI.
  2. Hi. DX I’m certainly considering the prospect after all the reading I’ve dome. My concern is firstly the prospect of having to go to court and associated cost. Secondly proving after circa 14 years that I was told I had to take the insurance. I’m going to start with an SAR should this now be to provident rather than DAFS? Thanks
  3. I've spent lots of time (and I mean LOTS) reading various threads on the site ref Yes car credit, DAFS etc and PPI.... Has anyone been successful pursuing a claim on a pre 2005 claim? There is one post amounting to 18 pages of very interesting reading and then no outcome - suggesting possibility of a settlement and NDA... Thanks
  4. Hiya, I believe the whole thing relates to a second mortgage/secured loan. Mortgage lender with first charge I reckon had loan satisified when the house was sold - I was no longer in the house. The CCJ date is + 6 years and has dropped of my file. The DCA and the people they say they're working for are neither the mortgage company or secured loan provider. Reference numbers don't appear to be court reference numbers so perhaps they know nothing of the CCJ. I think I may just sit tight and see what they come up with next. Thanks,
  5. Registry trust shows no CCJ's on any former address. Will contact Northampton directly I think. I'm now getting text messages from them on my company mobile - god knows how they've got that number. I'm a little worried still about it all and need to follow it thro, limitations period on mortgages is 12 years, but unsure if that is 12 years to begin court action and then after the CCJ the normal 6 years applies so thats nagging in the back of my mind all the time.   6. Hi, Thanks for that. Will deffo check this, whilst looking at my file for case numbers etc I noticed the amounts don't tally, I thought amounts couldn't be added to judgement so thinking something is a miss somewhere. The difference is +£2k so need to get my ducks in a row first. Thanks, Dave
  7. Hi, Thanks again for your reply. I don't know how to find out who if anybody are admin of the CCJ, the CCJ has dropped off my file now. All I could see on file was CCJ with Northampton County Court bulk process centre or similar centre, I don't think it showed the orignal creditor but I could be wrong on that one, should check my printed copy really. Rossendales are apparently acting for Lowell portfolio. What should be my next step with them? Do I just ignore them and they will eventually stop wasting their time? If I respond is that taken as acknowledgment? My worry is if anybody attempts to implement enforcement action and I am away with work or similar my partner and baby will be left on a sticky wicket, tho from reading the above I think at this point the chances of that are very slim. Thats what I thought, seen similar before on unsecured debt usually around the time as the six years is about to expire so they send a big discount and hope you'll cough. I just wondered what the legal side of things was like, my thinking was at that kind of amount someone, somewhere is going to be hassling for it back. Cheers, Dave

Hi, I believe a few different aspects of my question have been covered in part and many times in several threads around the forums regarding CCJ's, sold CCj's etc so apologies for this but my scenario is a little sticky and not straightforward. So wanted to try and get a view on this separately based on my saga... Many years ago, roughly 10 years ago I was happily cohabiting with a view to being married and myself and my partner became a little over reached financially and, as many people did when lending came easy we took a second mortgage secured on our as was then home. A year or two later we separated and I was left in said marital home, by this time more stretched and with CSA payments etc soon fell behind on the mortgage. Sorry for the long story. To the point.... Both securities on property were joint. Property was eventually repossessed , first mortageg lender loan was satisfied at auction. With little or no to my knowledge funds left over. Now in 2014 I began looking into my credit history to see how things were with a view to clearing things up, if possible. I learned of a CCJ but little else, many I have found out subsequently have dropped off my credit file whatever that is. The CCJ was for quite a large amount of money £25k so assumed it to be from my previous marital home. After moving out of said house communication from lenders varied from sporadic to none so I had little true knowledge of who got what from sale of proeprty. today I receive a letter from a DCA at my home addressed to me and my ex wife stating that this DCA (Rossendales Collect?) intend after failed attempts to collect this debt and may in certain scenarios offer upto 60% discount for full settlement. This is where it gets muddy for me, even if I could settle the debt which I cant't ( I wish I could have that money sat around) where does this leave the 'joint debt'? I know my ex wife most certainly cannot meet the demand or even what is legally her half (I assume legally her half) what if I could meet half? What is still enforcable and what isn't? Could I pay half and leave to her? I have worries that if I respond then bailiffs come to my door, if I make no response then I get visits anyway. I have had fishing letters from DCA's before for jnsecured amounts which I have sorted out, but this is the first letter in many many years I have had even remotely mentioning my ex wife so considering the amount involved I fear this is the real deal. The CCJ has I think from when I first obtained my credit file now dropped of it or will do so imminently further confusing things for me. The DCA aren't the claimant on my file, I doubt they're the first people to but this and I know nothing about being taken to court to be given a CCJ. Any advice appreciated and again apologies for the long tale but I figured kt was best to give as much info as possible. Many thanks in advance. Dave
