Help dealing with Uncle Bryan C - Court Claim issued
broxilondon replied to broxilondon's topic in Debt Collection Agencies
Anyone any thoughts on where I could get some ideas for my defence? Is there a library anywhere? I have some ideas but really want to find something "cast iron" to put forward. Thanks all and this is a truly wonderful website. Broxi -
Help dealing with Uncle Bryan C - Court Claim issued
broxilondon replied to broxilondon's topic in Debt Collection Agencies
Hi and thanks for the prompt reply.I'm working to roughly the 4th of November as I last paid on or around that date in 2006. I acknowledged service online but haven't sent anything other than the CPR 31.14 to uncle Bryan via recorded delivery. Should I also write to uncle Bryan with one of the "rigourosly defend the claim" letters? Thanks, Broxi -
Hi all,Recieved a County Court Claim Form from Northampton today (just back from holidays) dated 26th September. It's from uncle Bryan with the claimant being Arrow. I received letter from Fred for a while then ucle Bryan over a 2 year period but just ignored them - all the usual threats.POC are "The claimant claims 816.47 being the balance of considerayion outstanding to it under account number AGxxxxxxxx in respect of services rendered to the defendant" then the usual bit about claimant also claiming interest.Completed the AOS online and also sent CPR 31.14 to uncle Bryan. I'm assuming I'll get the "you've previously receieved the documents" from the OC. I belive the claim to be for an old (32 days away from being statute barred!) mobile phone account.I've moved about a bit and have never received any form of assignment from the OC or Arrow. In addition, uncle Bryan is claiming £55 court costs and £70 solicitors costs. In terms of next steps (once I've received the letter I expect from uncle Bryan) should I file a defence or just file for the court to strike out the claim as I've not been provided with the information I required. Any thoughts on the best places to find sample defences?Much appreciated in advance. Broxi
