  1. Cheers for that. CAB were about as helpful as a chocolate teapot. But I got all the forms from the very helpful lady at the County Court. The clerks aren't in today so I can't ring them to ask a question. I was wondering if you guys can help Some of our debts have been handed over to collection agencies. In the list of creditors section, do I list the collection agency, or the original creditor?
  2. Yup, will definitely be seeing the CAB first, but we can't go til next week. I'm just trying to get a better idea of things and questions to ask before we go What's an income payment order?
  3. My wife and I are both going to file for bankruptcy, but I am unsure on the best way to declare our debts and outgoings. We are on benefits which are mostly in her name, although a few (for example Tax Credits) are in our joints names. How should we split the outgoings between the 2 petitions, or seeing as all our income goes into a joint account, should we put all the outgoings onto just one of the petitions?

Hello, My wife and I are planning to go through Bankruptcy proceedings, and so we need to raise the deposit (approx £350 each - we are exempt from the court costs) However our weekly payments to Provident and Shopacheck (£130 a week) leave us with absolutely no spare money to put together to pay for the bankruptcy deposit. Is there a letter I can send to their offices informing them of our intentions and request that we receive no more visits from their agents. The agents are all too happy to help to give us money, but can be very rude, even approaching aggressive, when payments can't be made. So we would like to avoid any face to face confrontations. If they stop visiting, we should be able to afford the deposits within a month.

  6. I had my digital camera with me But I got a letter today from Tesco Head Office apologising and basically saying send them the bill, and offering a replacement vehicle if it's still off the road! So, all should be well Well done, Tesco (But you still haven't filled in that pothole yet)
  7. The claim is still with their head office, but I should hear back this week. But looking at the worst case scenario, if you go to a small claims court, isn't it the case that you don't need to prove 100% what happened, but the court will consider what is most likely to have occured. And seeing as the car broke down instantly after hitting the pothole, and a garage has said that hitting a pothole could cause that damage, wouldn't that make it the most likely scenario?
  8. Got the car back, and it was definitely the driveshaft. It cost £130 for recovery and repair (quite reasonable I thought - it's a very trustworthy garage) The guy there told me that they've done a few jobs stemming from the Tesco store including trolley damage, and things being blown by the wind into the vehicles so he says I shouldn't have any trouble. I still have the feeling that this may be different as with the examples above, there's no doubt. But the guy did say that because of the actual damage that was done, it's very unlikely that it wasn't caused by the pothole. So I'm gonna speak to the manager tomorrow (hopefully) and see what she says. I do know that the garage will gladly tell them that it was the pothole that caused the damage so it should go through without a hitch. What I have found interesting is that despite the signs saying Tesco accept no responsibility for damage to vehicles on their property, they have paid out for damages which don't actually appear to be their fault
  9. First of all, forgive me if this is the wrong forum. Please move it if it's better suited somewhere else On saturday, I went to Tesco, and as I was leaving, my car (Renault Espace) hit a pothole right in front of a speedbump (this is on their property). About 20 meters later (just leaving their property), there was a bang, and the car ground to a halt. I went to one of the trolley lads (a most helpful guy) who helped me push the car to a safer place (as it was currently blocking a road). On the way to the car, I pointed out to him the pothole and told him I'd hit it. A friend of mine came up to get my shopping and take me home, and we took some pictures of the pothole in question. Today I gave the keys to a local garage who will collect the car and sort it for me. I explained the symptoms of the fault and they think it may be a driveshaft issue (I have no idea about cars). I asked him if driving over a pothole could cause that, and he said yes. So I explained what had happened, and he told me that if this was the case then Tesco may well be liable. I phoned the store manager today as a curtesy to let them know what had happened and that the garage would be giving me a report as to what had caused the damage. I also let them know the lad's name with whom I spoke on the day. She told me that when the report comes through, I should go to the store if I wanted to pursue a claim. So, hopefully this should all go through without a problem. I'll pay for the repairs this week, and then go to the store with the bill and ask them for a reimbursement. But something tells me it won't be as clear cut as that, and that Tesco will try and evade responsibility. Just wondering what the best course of action for me to take is
  10. I'd like to go down that road, but surely I'd need to give them something in writing before the court date. I know the court wouldn't look favourably on me had I not attempted beforehand to at least ask for the account to be put on hold pending the test case (I don't use the account anymore. I'm on my parachute one)
  11. I hadn't started. I was going to pretty much the day that it was announced that reclaiming was on hold
  12. My halifax account is overdrawn by £400, but this is ALL due to bank charges. Overall there's been £700 of charges in the last 2 months, and it was the charges which made the account overdrawn, and all the remaining overdraft is 100% charges. Halifax are now threatening legal action to claim £400 "back" (It's not really "back" as I never took the money from them in the first place). I am concerned as I believe that new claims for charges are currently "on hold" pending the OFT investigation. How should I prevent Halifax from continuing with legal action?
  13. I had an enhanced disclosure which is more in depth than your standard disclosure, and NONE of my driving offences were on it
  14. Oops, just rechecked the statements. The first 2 charges were in February and May in 2001 which is outside the 6 year thingy. Is it easier to write those 2 charges off? I've successfully claimed against Halifax earlier this year, but that was all within the 6 year period.
