Hello,

 

I am trying to help my friend claim back some charges. She called the Halifax to speak to someone about something else and had a recorded message saying that due to the test case (which could take a year to complete) being looked at at the moment, they are not looking at any more claims until it's finished. They say that if you try and claim they will ask the court for a delay.

 

Can they do this? It seems a little underhand to me? Is this what all banks are doing now?

Take no notice to the bank telling you that you cant put a claim in yet till the test case is over thats utter rubbish.

 

They are trying any tactics to stop people from putting claims in.

Send this letter along with £10 fee and then you have to wait 40 days from the day they recieved it , send it recorded delivery to Trinity Rd address.

 

They may send you a letter back saying that it could take up to 8 wks, take no notice of this . One thing you must do is always stick to your timescale, its your claim not theirs. Your in the drivers seat.

 

Everyone on here is just going about their claims in the usual way,some people are still winning regardless of the Test Case.

 

My advice to you would be try and read all you can on different threads here. You will get an idea what you are up against.

 

Also read the F& Q's they tell you all you might need to know.

 

You'll find that on here we are like one big extended family. we look out for each otherand try to help anyway we can.

 

If you get stuck at any time or need advice just give a yell on here and some-one will come to help.

SSL once said that there is no such thing as a stupid question only stupid mistakes. I remember that advice from when I first came on here and have gone by its meaning ever since.

17-05-2007--Sent Amended L.B.A. for Contractual Interest this time.

14-06-2007--Received standard Bog Off letter.

13-06-2007--Took N1 to Local Courts.

26-06-2007--Copy of N1 from Court, issued 21-06-2007. to Halifax, Deemed Served 25-06-2007

Have till 09-07-2007 to file Defence.

05-07-2007--Note that Acknowledgment of Service been Filed on 29-06-2007.

Have 28 days from date of Service to File Defence.

07-07-2007--Offer from Halifax.

09-07-2007--Rejection letter sent to Halifax. Next day delivery.

10-07-2007--Money put in Account:mad:

Me v BofS: Charges: £13,048.10 #2a/c Statements from 08/01/01 received. Charges:£5,156.39 Information Commissioner's Office informed June 12th who wrote to BoS, June 22nd for non-compliance. #1a/c: passed to BoS Senior Review Team. Discovered 2 further a/cs, and 3 Loan accounts. "Goodwill offer" of £7,424.23 06/07/07. Accepted (partial repayment). 20/07/07 Top-up payments of £2,558.10 & £1,154.00

£11,136.33 paid back thus far.

New claim issued: 9/07/2007 for 3rd account: £500+ PRESSING ON!

You must keep going with your claim keep copies of all documents you send and receive for evidence keep going till you get a stay issued by the court as once you have issued a court claim the way things stand now you claim will be earning 8% statutory interest until settled.

COMPLAIN about the ANTI-CONSUMER way in which the OFT Test Case is being handled!
