This morning I got my bank statement from Nationwide through the post.


It turns out that, because we had gone below our overdraft limit (-£ 514.09 where the limit is £ 400) they are going to take the princely sum of £ 339.35 off our account in 28 days time, this as a result of unpaid Direct Debits and cheques and obviously also because of going over our overdraft limit.


The reason we got there was because last month we stopped our JSA benefit and Child Tax Credit from going into our account as we would not have had a penny to live on as it would all gone on clearing the overdraft and various charges. (A letter of right to appropriation would not have done any good neither).


As you can imagine, those charges are obviously going to push us into very deep trouble.


Is there anything that can be done to "limit the damage", so to speak, and is it really legal for them to take that much money from us? (We have to live on £ 187 JSA + £ 44 Tax Credit a fortnight, with one unemployed child at home and another one who is still studying, also bringing with it the well known regular expenses).

I can only see things getting worse, as, due to all this, next month DDs will certainly not be paid and there will be no overdraft to rely on.

The more you understand about the processes the easier your claim will be.

It is not illegal to charge you for THE ACTUAL COST TO THE BANK for your overdraft, etc., but the level of charges are UNLAWFUL as they constitute a penalty charge.
