Halifax refund given to settled c/card debt

Had a credit card with halifax for about £4500.

 

Was offered a settlement (full and final) of £1200, which i paid and they accepted.

 

However the account remains open to date.

 

I went about seeking a refund of charges. Agreed to £350 refund. Waited for a few weeks and nothing came. What they have done is refunded it back to the credit card account that they had already accepted full and final settlement on a few months earlier.

I have wrote to them, but they say, yes they were correct in doing this.

 

I don't wanna have to go the court route as it would prob be stayed.

 

Any other options for me?

Charges claim nearly sorted, now taking on anything thats left..

Dont know if Im right but I didnt think c/card claims were being stayed .

 

Some one will correct me if Im wrong, but if Im not then perhaps the only option is for you to threaten them with Court.

30-12-2006--Requested statements from Local Halifax.

02-02-2007--Statements Recieved.

18-04-2007--Prelim sent.

20-04-2007--Reply , Thanks , give us 8wks letter.

02-0502007--Sent L.B.A. & Schedule of Charges

11-05-2007--Recieved reply ,still investigating.

17-05-2007--Sent Amended L.B.A. for Contractual Interest this time.

14-06-2007--Received standard Bog Off letter.

13-06-2007--Took N1 to Local Courts.

26-06-2007--Copy of N1 from Court, issued 21-06-2007. to Halifax, Deemed Served 25-06-2007

Have till 09-07-2007 to file Defence.

05-07-2007--Note that Acknowledgment of Service been Filed on 29-06-2007.

Have 28 days from date of Service to File Defence.

07-07-2007--Offer from Halifax.

09-07-2007--Rejection letter sent to Halifax. Next day delivery.

10-07-2007--Money put in Account:mad:

I went about seeking a refund of charges.

Why? You haven't paid the charges and if the reduced settlement offer was accepted then the account should be closed and you will never actually pay these charges, so you can't claim them back.

 

What they have done is refunded it back to the credit card account

The bank have the right to offset.

 

I don't wanna have to go the court route as it would prob be stayed.

 

It's more likely to be thrown out I'm afraid.

Yes. The only time it isn't is if they have put some clause in their acceptance, but that's unlikely. Can you post their full and final settlement letter?

 

Normally what they do is close the account, mark on your credit file that the account is partially settled and then write the rest of the amount off and claim tax back on it.

Then as the account is still open you may wish to request a copy of their complaints procedure and check your credit file.
