I have totted up £317 of charges with Nationwide. I have not paid the charges but because they said I owed it them they put a default on my account.

 

I applied to MCOL to get the money wiped off and get the default removed. This was done at the front end of August.

 

After realising that they are staying the cases automatically I emailed MCOL:

 

Hi

 

I am concerned that you will blanket stay my court case. Even though it does refer to bank charges I have not paid the charges. My main aim is to get my default notice removed because of these charges.

 

As I have put that on my court case as well as the charges themselves should the action continue without a blanket stay on the case? I am not just disputing the charges.

I have just got a reply back from MCOL:

 

Dear toneighty170,

 

Thank you for your e-mail. Your claim has been stayed, but because you have e-mailed requesting that your claim continue, I will ensure that the case is transferred to your local County Court for continuation.

Very interesting indeed! I suggest everyone emailing mcol and asking them not to stay their case. Anything is worth a try at the moment.
