I would ask anyone if they could send me a copy of the Consumer Credit Act 1974 as amended 2006. I have had a default notice served on my credit file by Thames Credit Ltd for something i know nothing about and know without a shadow of a doubt that i had no financial commitments at that time.

I have reported them to the FSA and to trading standards as they served the default without legal compliance of the cca.

 

I am taking them on at there own game...... I would aslo like any templates for sar request and compliance letters.

Use the site S.A.R - (Subject Access Request) generator Data Protection Act - Subject Access Request Generator *** New ***. If you haven't done so include under CCA1974 a request for your agreement, pay £10 + £1 by Chq/PO.

Dear Sir/Madam,

 

This letter serves as official notice that you have illegally entered information alleging a default of the aforementioned account and have broken the requirements of the Consumer Credit Act 1974 as amended 2006 (non compliance). You have failed to comply with the statutes of limitations of the act by serving a proper default notice and there has been no official notification of any debt.

 

I can assure you that I have no knowledge of this account and also have never formally lived at the address listed with the account. At the time that this account was alleged to be active, I was unable to get any form of credit and had no financial commitments. I have had identity theft in the past and have now reported this as a possible fraud. I have also written to the credit reference agency and informed them of the illegal notice on my file. Further, I have reported your company to the Office of Fair Trading and lodged a formal complaint with the trading standards authority.

 

Under the terms of the CCA 1974 you are required by law to prove any debt owing and I would formally request that you reply with copies of any official contracts or documentations pertaining to any agreement under the CCA 1974. I also require proof of any signatures made under this agreement. A copy of this letter has been formally lodged with my solicitor and we will be looking to take this further through the courts as well as claiming for damages and any other disbursements including court costs.

 

I require that you remove the default from my credit file immediately.

2.8 Examples of unfair practices are as follows:

 

a. sending demands for payment to an individual when it is uncertain that

they are the debtor in question, for example, threatening debt recovery

action to 'the occupier' or sending a payment demand to all people sharing

the same name/date of birth as a debtor in the hope that contact with the correct debtor will be made.
