From your other posts, you have made it clear that you work for a private parking company.

 

Please point me in the direction of any legislation or case law that allows a private company to levy a fine.

 

A charge, maybe; a fine or penalty, certainly not

If Parking Companies and local Authorities where to abide by the Road Traffic Act 1991 as Ammended and play fair with driver then there would be no need for these forums but they don't. Do we really need people like this in our forum

And I love, just love ignoring all the threatening letters private parking companies have sent me over the years which have fizzled out to nothing. I am still waiting for one of you to take me to Court.

The RTA applies only to the public highway. It does not apply to private parking in any way, shape or form.

Does this mean only PCNs issued on the Public Highway can be ruled as invalid by the adjudicator for being technically incorrect in format? Take for example the two date issue surely this would make all the PCNs issued by Councils using one date that had to cancel them still able to chase off street penalties? :D

The question to ask yourself is: Who owns and maintains the Car Parks where the Councils issue PCNs for off street contraventions?

The Council owns and maintains them but they are not public highway as the Public do not have the right to enter or pass through 24 hrs a day 365 days a year therefore cannot be claimed to be 'Public Highway' many are closed at night for example which a Public Highway would not be allowed to. Pat was saying that the RTA 1991 did not cover private car parks therefore the requirement for a PCN (issued in ANY car park) to comply with the wording in the act would not exist.

Public Highways can and are sometimes closed to the Public.

 

Legislation exists for the enforcement of Council controlled Off street parking (Council Car Parks) in accordance with the RTA 1991.

When a court orders me to pay up, then I will. Until then you can place as many tickets on my car as you wish
