I'm just starting out with these sharks... I sent a request for refund of a PPI (single premium policy, added to loan taken out 5yrs ago) and was told 'the loan pre-dates the regulation of their business by the FSA so forget it' Hmmm... Have contacted FOS and am still waiting for their view, but from what I've read on here I dont think they can do much because it was before Jan 2005. The FSA have told me its not time barred, you can still have been mis-sold prior to Jan 2005!

Can the FLA help with my complaint? In order to go the 'court route' I feel like its my word against theirs, that the PPI was mis-sold. How do you prove it? Any advice gratefully received!

On a different note, what the hell are 'disbursal of fees' also added on my

loan, to the tune of a grand???!!!

Hey One,

 

Have you sent a CCA request to WFS? Can turn up interesting things.

 

Disbursal of fees - not to sure what it actually is, but it appears to be something they charge everyone - I had about £1000 added to my loan, and then they charge interest on that too.

 

I didn't think PPI was date/time limited, it was either mis-sold or not.

thanks chancer1! Can I submit a CCA request on a loan that's been paid up? Should have been more savvy years ago, at one point WFS told me they had no record of my loan so I cancelled my DD and waited... About 6 months later they rang me at work jumping up and down!!! Would have saved me a fortune if I'd been more aware. No CCA agreement = no loan.

When I remortgaged and finally paid the loan off, it cost me a whole lot more than I'd borrowed but it was worth it to be free of them.

No, sorry - the CCA1974 only requires them to supply a copy of the executed agreement if there is still money to pay. You can send an SAR and claim back any charges though.

well the FOS haven't been too helpful - as the loan was taken out way before welcome were regulated they cant do anything. FSA seem to agree that a PPI can still have been mis-sold before regulation so is the only option the legal route? Anyone?!!! Also, is my main ammo the misrepresentation act 1967?

Any advice gratefully received. They cant get away with it, surely!

i'm currently at court stage over PPi with Welcome as mine's is from 2003-4 so had to go down court route

 

do a ful disclosure SAR and specifically ask for insurance certificate and policy wording document.

 

then write to complaints dept and ask them to confirm if these two documents were issued and on what date. (Ask for a sworn statement)

 

then write to First group who the PPi policy is usually with and ask them to confirm if the insurance certificate and policy wording document were sent out and on what date

 

when you get your response from both company's you'll have a bit more ammo for your case. then read the policy wording document (specifically your cancellation rights) and you'll see a very good starting point for mis-selling.

 

will give more info in a couple of weeks when my case has gone through court
