hi

can anyone help, i had a debt outstanding for approx £330.00 from 1995 and barclaycard are using thames credit from glasgow to chase me for the debt.

in march 07 i requested my details from them , by phone, and i have heard nothing.

i have now sent request to thames credit for details.

can i request the details from barclaycard because im sure there would have been charges on this account

I was in the same position and contacted the information commissioner. You will son get a replt after that.

if it from 95 it be statute barred assuming you have nothing to do/pay within last 6 years, DO NOT ACKNOLEDGE the debt, use post aswell not telephone. if everything done by letter and you go to court you have evidence

hi , had a reply from thames credit now ,giving me some info that they have on file.

the amount that was outstanding, a ref no and the charges , since no payment from 1995.

also have informed me that the debt is statute barred but i have a moral obligation top pay them, but as far as they are concerned now the debt is written off.

just wondering if i should SAR barclaycard now,

any suggestions !!!

if theams tell you it stat barred then i'd just prob leave it at that, they know they cant take u to court, just make sure u keep all letters sent and received, if there are charges then yes S.A.R bcard if not then dont worry about it

finally would you believe it barclaycard have sent a letter informing me they will provide all the details of my credit card even though it was cancelled years ago.:)

that ok then, if charges on account take them to court for refund, as with thames ignore them, they have admitted they can't do anything to enforce it :D

Just my 2p's worth.

 

Surely the debt is statute barred and the DCA can go take a hike.

 

OR you reclaim any chgs on the a/c for the last 6 yrs which reduces the debt that you still owe them. I wonder if that resets the clock re activity on the a/c making the debt collectable once more.

 

I will ask for more expert advice to be given here.

Hi Oggy,

 

I have sought advice and the debt is of course time-barred by the Statute of Limitations.

 

However, as YOU'VE paid nothing since 1995, there's nothing that you can claim back either.

 

The DCA is right that the debt in unenforceable. If you don't want to pay the debt, you don't have to.

 

In the circumstances, there appears to be no point in sending SAR or, indeed, doing anything more about this.

 

If DCA contacts you again, you can write to confirm that the debt they refer to is time-barred and you do not wish to hear any more from them about this or you will make an official complaint.

hi, had some paperwork from barclaycard , but the main info is on microfiche and they say the data protection act does not cover this far back.

seems funny that they have kept the account live all this time??

In a word - no.

 

If you've paid nothing since 1995, you have paid no current charges (ie within the last 6 years) which you can reclaim.

 

You have a far harder task to reclaim charges which relate solely to 7 years or older as you have to argue against the Statute of Limitations before you can recaim a penny.

 

Time to let this lie.:)
