hi me and my partner rent private, we have been here 3 months first month rent was on time 2 month was a day late but paid, this month however i have started a new job which means working a month in hand i wont get paid until 21st sept same date as my partner and housing benefit isnt due until this date approx either, i have phoned the landlord and asked if the rent due date of 7th of month can be changed to 21st as its going to be a struggle to get it by 7th, he was stroppy and said he cant change the date as its a legally binding contract, we arent trying to miss paying just pay it later when we get paid, all he suggested was as we have a guarantor can they not lend us the money to pay him on the 7th? this is not what the guarnator is for and as he has just had major surgery we arent going to risk his health by asking, does anyone know if we pay late will this be in breach of the contract 9which i guess is a yes) and what legal recourse can the landlord take. any advice greatly appreciated.

If you pay late, the landlord can realistically do nothing if it is a one off. However, he could choose to evict after the 6 month term(assuming it is a 6 month term).
