Hello

Can someone please guide me on this one, Sent a CCA letter to "red Debt Collections" asking for an executed credit agreement copy for a debt with Abbey National, they said they have no obligation under the provisions of the act to supply information, as the agreement I seek is not a regulated consumer credit agreement.

 

last time I had an account with Abbey was in 99, What do I ask for, for proof of the alleged debt and date for me to fire back a letter of the limitation act?

abbey.LBA sent 30/10/06.MCOL claim submitted 8/11/06.allocation questionnaire sent 16/12/06.schedule of charges sent 16/12/06.WON

 

2nd abbey claim SAR sent 3/1/07.WON.complaint letter sent 18/1/08

Sandrock, if there's been no payments made towards the account since 1999.... the account would be statute-barred by now. In which case, Red Debt Collections can just berger off.

Red Debt is the ''Specialist Insolvency'' :rolleyes: wing of Clownells Financial. Presumably you already heard from Clownells and Hampton ilLegal first. These numpties specialise in purchasing unenforceable and Statute Barred Debt.

Red are, in a word, STUPID and that is putting it politely.

 

I had a letter from them regarding a Crapital Dumb card, I have already CCA's them when they were 'Lowells' and Hamptons Legal and I wrote to Red stating the account shouldn't have been passed on and for them to contact Miss A something or other in Lowells RE my CCA request.

 

They wrote back stating that they didn't have a Miss A but she signed the letter!! (OK it WAS an electronic signature but hey...how stupid)

 

They then said they would get a copy of my CCA to me within 12 days, but they'd already had over a month!

 

Still waiting..........

Cut to the chase with these "people" and send them a Statue barred letter.

The onus is then on THEM to prove otherwise.

I've had my run-ins with these clowns in the past too. Sent them the statute barred letter etc etc & everything went quiet for several months, then Muckyballs appeared on the horizon..... but were soon shot down in flames after they were threatened with castigation (or was it castration?):)

Ah the glorious Red Debt Collections, l recently reported them to the OFT in their area for criminal default (60 days) still no CCA , the lovely gentleman at the OFT assured that my complaint will be followed up after they have got through everyone else's complaints against them...lmfao :D
