Hello, can I claim if I'm in debt

Hi,

This is a great forum, it's a wonderous sight to behold to see so

many standing up against the banking bully boys and winning. :)

 

I would like to ask a question if that's ok.

 

First, here's a bit of back story.

 

I owe a bank (Halifax in my case) £25,000 which is a mixture of

defaulted loan and credit card debt (mixture of stupidity, being

led down the garden path by the Halifax for 10 years and plenty

of the usual get your violins out stuff I don't want to bore your

pants off with)

I've been paying them back a bit at a time via a Payplan

agreement and reckon that a plenty big chunk of that debt

is made up of penalty charges.

 

It was a Halifax employee who suggested I contact Payplan in

the first place and it never crossed my mind that I might be able

to dispute the penalty charges at the time when I signed up

for my Payplan agreement.

 

So, basically my question is this;

Is it too late for me to claim anything back and if so would it

be wiped off the total I owe them. I'm a bit confused because

it's not money I have actually given them yet but it is there in

the debt amount to be paid in the future.

 

I don't know if the last bit made any sense.

I'm sorry if it didn't or I've asked something that's been asked

before, I've got an eyesight problem at the moment and can't

get through as many posts on this forum as I'd like to before I

have to stop reading because of it.

You can claim your money back even when you are in debt. When you win your claim, the bank will deduct the amount of your claim from the total amount you owe them.

 

That will be a breather for your current debt problem. You have to start with your first letter called SAR.

 

Don't be afraid of the current problems the banks are putting in the way of claimants. It will only take time, the money will be refunded. The length of time will give you more interest if the matter gets to court, which will certainly happen if they do not settle in time.

It's so good to find out something positive for a change.

 

Feel's like drowning in a vast ocean of raw sewage most days.

 

Blair, Oliver and Scott got on my case this morning.

 

I've given those Halifax viperous leeches nearly £4,000 in the

past 14 months. I miss 6 weeks of payments because stingy

boss paying very low holiday pay, a household full of sick people,

TV licence and the fact that Halifax had decided to say the

agreement covered period was up all collided to wipe me out

financially and mentally.

 

It started out a dark day, you've brightened it so thank you.

Hi Chrissie12 !!

 

Chin up............ You can claim for any charges re credit cards bank loans etc. It is amazing when you look at accounts just how much you have paid in charges !! Now its time to reclaim.......... when sucessful the money is taken from any outstanding debt. On over 6 different claims I am waiting on over £8,000 !!!! old car loan alone was £1700 in charges I knew nothing about till statements came through.......

Good on yer for going after 'em.

 

I'm fed up of the bank trying to make out I got no right

to live because I owe them money. Sometimes seems

murderers in prison have more right to some things than

folk who've defaulted on legally obtained debts.

 

I mean Income and Expenditure target figures that include;

All gas & electric etc. - Max £80 per month

(what cheap energy planet are they living on, where is it and can somebody give me a lift there)

 

Then there's all the things that are NOT ALLOWED....ooooooh:eek:

because people who don't pay back banks promptly deserve to

and must submit to have their head shaved and branded,

be bent over, put in the stocks and given a good shafting

whilst drunkards and large dogs are encouraged to take a

piddle on their face.

 

Whoa, sorry better stop there, soapbox anyone.:D

 

I'll be on to it myself as soon as my stupid eye will

let me see proper again (erm...touchwood on the eye thing)

I have six sepetate claims at present. !!!! :D This site has given me the will to live again and stand up to these so called debt collectors who make your life a misery............... Through no fault of our own ( hubby had road accident and was on half pay ) things got soooooooooooo far behind and before you know it with interest and charges etc you are wayyyyy out of your debths . BUT I now smile in the mornings and think they WILL not get the better of me...........

Welcome to CAG. Before you start the process of getting your charges back, please have a thorough read of the FAQs (there’s a Step by Step guide here too). You should print both of these out to refer to, so as to avoid having to ask basic questions later. Our aim is to make you aware of your rights as a consumer, enabling you to fight back against unlawful bank, credit and store card charges. In the website you will find information on how you could get your money back

 

Then look at other threads in your bank’s forum, so as you know what you can expect to happen.

 

You need to spend 2 or 3 days gradually getting your head round everything. If you find a forum/thread/post of interest, save it in your Favourites, so as you can always find it easily.

 

There’s a lot to take in, but it’s time well spent and will ensure that you succeed in your claim without problems. Remember it’s not a race, don’t rush, just follow the guidelines one step at a time.

 

Take your time and have a good read around this site. Then come and join us in our forum. Here we can guide you every step of the way. Please remember, we are here to help you help your self.

 

When you feel confident that you understand the process and the various stages involved, start a new thread in your bank’s forum and post your progress and any questions there and you’ll get plenty of help.

hi chrissie. i have found that a good way of dealing with this kind of problem is by issuing your creditors with a cca request. you will find a template letter floating about in one of the debt forums. basically they must provide you with a true copy of the credit agreement from when you first borrowed. if they cannot do this( and most companies don't seem to keep copies, or even provide one to begin with), then after 12 working days after they recieve your letter, they are in default. this means the debt is unenforcable, and they must stop adding charges and interest, and cannot chase you for payments, until they provide the agreement.

It's all sounds like good advice and I'm going to follow your

recommendations and get a good bit of research in before

making a move.

 

I'll come back and give progress reports as suggested once

I get the process up and running.
