I have posted a DVD player that arrived smashed at the other end. I have the reciept from Royal Mail and I am applying for compensation for him through their standard insurance. Meanwhile, the recipient keeps sending me badly spelled, mildly intimidating or ominous emails.

Where do I stand legally?

You'll receive the maximum due (£32) but they'll need the recipient to retain the packaging for possible inspection. As you'll receive the compensation from RM directly, it's often better to refund the recipient in advance of this - sadly not everyone is literate or reasonable these days.

Agreed - you ask the purchaser to return the goods to you for a full refund (it may be good practice to offer to pay their return costs, but you are not under any obligation to do so).

Does the other person get to keep the goods and all his money? The good are damaged buy they still have value.

 

Was this sale through ebay?

 

If it was, then read the procedure for damaged goods.

 

The goods are the responsibility of the sender up to the point of delivery.

The purchaser has to return the damged goods to the seller.

The seller refunds the purchaser full cost.

The seller then claims from Royal Mail (courier company) upto the amount of the goods given at the time of posting or the maximum due to the limited amount guaranteed by the Royal Mail for the level of posting taken out.
