Note FOS comment re hardship cases.

Support is there. Go to them and complain. These cases should not be affected by waiver, although there will still be a fight.

It is highly unlikely that the FOS would look at cases already in the court system.

:) Hi

I rang and spoke to FOS regarding my claim being made up from my benefits. They have given me a reference number and are looking at my case. So it is worth ringing them, (even if your case is in the system, mine is) what have you got to loose.

Keep the faith.

Chris:)

i have been claiming charges back for my step son from Halifax. We got as far as halifax making a partial payment of £500 against a claim of a £1000, which was accepted as partial payment and not as full and final settlement. Having paid him the money they immediately removed it to pay money off against a loan he has with them.

his income consist soleley of incapacity benefit and he cannot pay his creditors. he could realy do with the balance of this claim, a further £500.

what is the process for requesting that the claim be continued in spit eof the FOS waiver?/

sorry if this question has been asked before but i cant really find what i am looking for :-?

You need to contact the FOS but you must stress that these charges have come from benefits and that your step son is still on benefits. The bank are not willing to refunded the charges and as a result this is causing continuing financial hardship.
