Hi, I have never been on this before so sorry if i'm a bit slow.

 

I have a court date on 6th Sept 07 to reclaim £3K in Bank Charges. I would really like some help putting a bundle together. I have read somewhere that I should not include any correspondence of either mine or HSBC that states 'Without Predudice', is that right?

Yep. Without prejudice means that it can't be used unless both parties agree to it being used.

Hi moschops, (great name, where did you get that from) You are right in thinking that anything with "without predudice" should not be used in the bundle.

I will post you a link for a step by step guide to the bundle. Have a read through it and just come back with any questions along the way.

Moschops is my boyfriends name for me, its from a kids programme when he was younger about a dinosaur and his magic flower!!:D

 

Also I only have my most recent T+C's which doesn't call the charges 'penalties' etc.

Hi

 

I am really stuck. I need to send off my bundle today. I have been looking at Nawandas Particulars of Claim which is different to the Statement of evidence that is recommended in Court Bundles for Dummies. I dont know which one to use.:confused:

 

The statement of evidence says alot of stuff about bank charges being called penalties, but I have no evidence that HSBC have done this, They have always called them charges. So do i delete this bit out of the statement? Please help me:(

I wish you had asked earlier! I have to go out for the rest of the day now but I think Jowalshy will be around later to help.

The thing with the thread for dummies is to read it a few times in order to understand what you will be needing.

It is soe and ws are virtually the same thing. You just need to adapt it to suit your case.

If you have no help on this just keep bumping it up to the top for people to see.

I posted my bundles special delivery today only to find that when I got home I had a letter from DG saying they are going to apply for a stay.:evil:

 

What do I need to do next? Is it likely that that the hearing will go ahead if I challenge the stay?

 

I had an offer on 12th June for £2K and I wish I had taken it. Is there any chance I can go back to HSBC and accept the offer?

Letters from DG mean nothing, wait to see what your Judge does and if he places a stay on your claim apply to have it lifted.

 

Keep an eye on what DG were asked to do in the judges directions have they complied ? if not try to get the defense struck out and judgement awarded to you :)

Sorry moss only just seen this. Any offers from hsbc will stipulate a time limmit in which you have to accept. After that time they will consider it as a refusal to the offer. Have a look at the offer letter and see what time limmit they imposed.
