    • Well tbh that’s good news and something she can find out for herself.  She has no intention of peace.  I’m going to ask the thread stays open a little longer.   It seems she had not learned that I am just not the one!!!!  plus I have received new medical info from my vet today.   To remain within agreement, I need to generally ask for advice re:  If new medical information for the pup became apparent now - post agreement signing, that added proof a second genetic disease (tested for in those initial tests in the first case but relayed incorrectly to me then ), does it give me grounds for asking a court to unseal the deed so I can pursue this new info….. if she persists in being a pain ? If generally speaking, a first case was a cardiac issue that can be argued as both genetic and congenital until a genetic test is done and then a second absolute genetic only disease was then discovered, is that deemed a new case or grounds for unsealing? Make sense ?   This disease is only ever genetic!!!!   Rather more damning and indisputable proof of genetic disease breeding with no screening yk prevent.   The vet report showing this was uploaded in the original N1 pack.   Somehow rekeyed as normal when I was called with the results.   A vet visit today shows they were not normal and every symptom he has had reported in all reports uploaded from day one are related to the disease.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I bought a fridge freezer from Comet in May 2005 one of them american ones with the ice and water dispenser. Paid £700 for it and withing the first year it broke down and defrosted all my food etc.. Comet fixed it as it was under 1 year guarantee. Now it has broken down again! Had someone local out who says the motor has gone and cannot be fixed and it cant be replaced due to cfc gases or something. So I am left with a totally useless fridge freezer that is only just over 2 years old and cost a small fortune! Contacted Comet by letter and they are sending out an engineer free of charge to look at it. They said if it is a major fault we can have 35% off the cost of the parts but will have to pay all of the labour, how nice of them!!! I know that when they come out it is beyond repair as the other bloke told us this but I want them to see it too! Samsung have said they wont do anything as it is over 2 years old. What rights do I have?? Can anyone help me?

Did you pay with cash? Credit Card? Debit Card?

 

If this is a manufacturing fault/defect and the fridge freezer is not as durable as would be reasonably expected then Comet should be repairing or replacing free of charge.

We paid cash! Comet came out on Friday and looked at it and they are repairing it for free, this is because samsung have had problems with this model of fridege freezer and the parts need replacing.

I am on my second samsung fridge freezer had the last one repaired 6 times eventually samsung offered me an exchange that was 18 mnths ago now same problems arising with this one ice build up on components in fridge and does not cool gives a warning couple weeks before breaking down as a whirling fan noise which stops when you open the door.this model is RS21WCNS1/XEU are there others out there with same problem. I am not going through the same as before which consisted 11 weeks of repairs...would like to know where i stand because both these F.Freezers were still under warranty.

We bought our Samsung American style side by side fridge freezer from Comet. I have never had such a bad after sales experience as I have with them. My Samsung fridge freezer was great until the warranty ran out! Typical! Comet have visited on several occasions, changing God knows how may parts, and yet they still couldn't fix it. Samsung didn't want to know. The engineers in my area said they didn't work on Samsung fridge freezers, and referred me back to Comet and Samsung! Anyway, as time went on, Comet offered me the usual deal that other people seem to have been given. The deal was they will cancel my insuance, and give me some vouchers to put towards a new fridge freezer (from Comet of course). Unfortunately however, as the prices of a new fridge freezer had gone up since I bought mine, I would now need to pay the extra £435.00 difference!! How reasonable of them!! How do they do it and make a profit?!! Eventually, I decided that even though I had foolishly taken out insurance with Comet and was still insured, I'd try something else. I read how loads of other people have ordered a kit from a website, and fixed it themselves - and its worked. The company is APPLIANCE DIY REPAIRS. I ordered the kit, it arrived quickly, I fitted it and its been great ever since. So what the hell have all the Comet engineers been fitting on my fridge freezer? Needless to say, I won't be taking out any more insurance policies with Comet. From now on, I'll just contact APPLIANCE DIY REPAIRS, and ask their advice. The icing on the cake for me is, that as Comet deemed my fridge freezer as being unrepairable (which we now know to be a load of bull), I accepted the offer to cancel my insurance, and did go into their store to spend the vouchers they gave me. I spent it on a surround sound system!! So, I now have the same fridge, only working, and repaired for a reasonable price, and a nice new surround sound system courtesy of Comet!! So in the end, it was a rather good result all round!!!!!!!!!!!!!!!

we are having problems with a american style FF ModelR S20CCMS5/XEU. Comet were useless, ordered the wrong part said they could fix it - then in typical comet gfashion ordererd the wrong part and than said even if they they hasd the right part they could fix it ( that took nealy six weeks). Yeah we got extented warranty - not worth the paper its written on.

I must say that I would never buy anything any where other than comet. I once bought a DVD system cos I got £200 off I paid 4 insurance . 2 yrs later my kids stuffed a load ov jam in the DVD part was fixed. After 4 year it was dropped. So original price £700-200 £500 insurance £150 4 years off use then £700 quids worth of voucher. Ad a tumble dryer although it was not replaced it was fixed twice under 3 yrs waranty. Ad a tv £700 4 n half yrs down the line I thought as the waranty would b up soon I would call em out to try my luck as the screen ad a mark on the bak (plastic as rear projection.) only cheap part but they don't make anymore so wrote off I get another brand new 50inch plasma. Now I av a 4 n half year old fridge freezer agen cos the waranty will b up soon I called em out as there a small air line crack in the inner casing they av wrote off n I av anva £380 quid to spend. I av now found out that fridge freezers cost a lot more now but the insurance is still great n I av ordered a samsung american freezer the rsa1wtmh modal. But thy can't b bothered to pick it up so I av still got my old one. My point is is that adding my story to the fact u got your sound system & to keep your freezer it confirms that I would nearly always get the 5 yr waranty n I nearly always use it. Problem now tho is inav read loads bout samsung f.freezers breaking after a few years now whilst I av got the insurance on mine again I don't want to av it breaking all the time. But the modal I av bought I can't find a bad review about that one. So do I try my look r cancel my order. I'll have to think bout that 1.
