Hi I bought a shirt for my son from Sports world, when I took it home and he tried it on it was too small (even though it was for his age). I went back to the store and asked for a cash refund as the shirt did not fit even though he is aged 13 and the shirt was aged 13/14years. I was told that only a credit note or exchange would be given. I explained that the shirt I purchased was the largest size they did and therefore they could not offer me an alternative larger size, as there was nothing else in the store I wanted I again asked for a refund. He refused point blank and said the company policy was not to refund but only offer credit note or exchange. I feel this is forcing you to purchase or exchange an item for something you dont want. Can you legally ask for your money back. Any advice would be appreciated.

Age ratings are only a guidance and not a guarantee that it will fit that "age".

If you buy anything and find it doesn't fit, you don't like it, you buy the wrong one (essentially if the product is not faulty) you are not entitled to a refund or even an exchange.

By offering you a credit note or an exchange they are offering you more then they legally have too.

Ex-Retail Manager who is happy to offer helpful advise in many consumer problems based on my retail experience. Any advise I do offer is my opinion and how I understand the law.

It's not faulty, if you wanted to check the size you should have got the kid to try it before buying.

 

A 13 yr old kid can come in a variety of shapes and sizes... If it's not faulty, they don't have to do anything.

My son wasnt with me at the time, and whether he should have tried it on or not wasnt the point, i was asking can you legally as for a refund, to which i have already been given the answer

What has £3 got to do with it, and by the way it cost a lot more than that, so what was your point:rolleyes:

If i were you i would take it back to a different store and try there, i have never had a problem with taking items back whether it cost £3 or £300, is there anything in the store that clearly states no cash refunds will be given?

There doesn't need to be: they are not under any obligation to have signs.

 

If they do have signs that offer a refund, then that term would be binding on them however.

They do have signs in ours saying something like "refunds will only be offered in accordance with the Sale of Goods Act" or something. I don't go in there that often though because it's always full of chavs :D

 

The point about taking the kid to try it on is perfectly valid though, otherwise how else are you going to know it fits him and it's something he likes? Neither would be a case for a refund so you'll end up stuck with a potentially expensive shirt nobody wants.

As above really, when you purchase something you enter into a contract with the seller. You can only back out of the contract if the seller breaches the contract ie your statutory rights.

 

Is the product fit for the purpose made known to the seller? Hard to prove as you didn't check the fitting first.

Is it as described? Yes

Is it of satisfactory quality? I guess so.

I have worked at Sports Direct for the last year.

Firstly, I want to point out that the staff are not trying to upset you and that we do understand your frustration. If I went back to a shop to exhange something, or get my money back for a good reason and they refused to, then yes I would be angry too. Anyone would because it's your money. You must understand that it is also hard for us because customers take it out on us all day long. In my store, we've been threatened to be stabbed, a few of us have been hurt physically and offered outside for fights. So, you can imagine that when we get this all day every day, we are not the happiest people in the world but we always try to put a smile on our faces for our customers.

 

However, don't take it out on the people that work their because it's not their fault. It's what we've all been told by head office, we cant make the rules. Not even the manager of the store can change the policy.

 

Legally, we do NOT have to offer you a refund, unless the product falls under a manufactoring fault such as stitching or glueing. It annoys me when people come up to my till and say 'this is against the law'. Yes of course it is? We have over 400 stores across the UK, don't you think we would have gotten found out by now???!!! Even some of the top designers are offering this policy now. French Connection offer the same policy!

 

The main reason we ask for a receipt even for just an exchange, is for our benefit. As you have all said 'its full of chavs.' This is the reason head office put the policy in place. Because people would pick something up off the shelves, bring it to the till and we would let them walk out with something else. We NEED proof of purchase.

Also, there is a barcode on the bottom of the receipt when we print it for you, different from the barcode's of the item's you bought. We need to scan this barcode to put the items through our till system so that on our stock take, we can see whats been exchanged and what's been stolen.

 

Obviously we need a reciept for a credit note because we're not going to give company money away for you to spend when we don't even know if you've paid for the item you returned!!

I agree, in my opinion this is policy means that at worst for them, they get a free loan, but in all probability customers lose the cards before they can cash them or are forced to buy something they don't want. Probably sports direct believe their customers are too stupid or weak to complain and that they can therefore get away with it. (which they seem to be doing). Even supermarkets manage to do proper refunds!:mad2:
