    • Hey guys - I've read a fair few of the Hermes related posts but hoping you can guide me here.   I paid Parcel2Go to ship 2 speakers to me, via ParcelForce from an ebay seller (Value £170 + £33 shipping) I stated on the form it was 2 speakers, and having been told that these were protected for loss only, I took out their insurance (£9 cost) The seller packed them according to their packaging tips page - two layers of corrugated cardboard and some corrugated plastic cushioning (4 layers).    They arrived badly damaged - the base smashed on one, cracked on the other. Dents on both. Looks like they had been dropped several times from a reasonable height.   Parcel2Go are now saying that they class these as Musical Instruments and that they must be packed in a hard case.  As such they will not pay anything towards the damage. After searching through several pages, and buried links, I've have found this in their terms but its buried pretty deep, and wasn't at all clear in any correspondence, or during the booking process.   Do I have a leg to stand on in terms of making a claim in small claims court? Really disappointed in the terrible handling of both the parcels and the complaints process.   Thanks for any advice - its very much appreciated.
    • So then the guide is incorrect. I don't have duplicate entries on my credit file even from the piggybank loan which is the only one of the 3 that i'm aware of being sold.  I'm subscribed to all 3 so have checked them all. So 2 of the 3 PDL's are not with DCA's and the same 2 companies are in administration and from what i read that means they can be removed.  I will re read the guide but am sure that applies.     "If the company who reported this info doesn’t exist anymore – Then you have a right to have the information removed by default. Its only in the case of where it hasn’t been picked up by a Debt Purchaser."
    • Yes, had no symptoms,  just took the test in case I was positive, and didn’t want to spread in case I was positive and carried on working.   On the test instructions leaflet they gave me with nothing on the back to say you should isolate now till you get test results.   so don’t know where I stand, I believe I haven’t broke the law.   as I believe there might not a employers covid testing policy in place, and not signed a document. I have read about what to do etc. I cannot check as suspended, but will ask for a copy.
    • What could the SAR throw up? I wasn’t sure of the relevance of it. Sorry I just didn’t understand it much
    • no. if the debt has been sold and you have received a notice of assignment from the DCA to say so and if there are duplicate entries on your credit file i'e as i keep saying the same debt is listed twice on your file and defaulted  ..thus you have 2 defaults from the same debt (not that that makes any difference anyway!! it doesn't harm your score twice)   so no you cant get them removed.
  • Our picks

    • Hi @BankFodder
Sorry for only updating you now, but after your guidance with submitting the claim it was pretty straight forward and I didn't want to unnecessarily waste your time. Especially with this guide you wrote here, so many thanks for that
So I issued the claim on day 15 and they requested more time to respond.
They took until the last day to respond and denied the claim, unsurprisingly saying my contract was with Packlink and not with them.

I opted for mediation, and it played out very similarly to other people's experiences.

In the first call I outlined my case, and I referred to the Contracts (Rights of Third Parties) Act 1999 as the reason to why I do in fact have a contract with them.

In the second call the mediator came back with an offer of the full amount of the phone and postage £146.93, but not the court costs. I said I was not willing to accept this and the mediator came across as a bit irritated that I would not accept this and said I should be flexible. I insisted that the law was on my side and I was willing to take them to court. The mediator went back to Hermes with what I said.

In the third call the mediator said that they would offer the full amount. However, he said that Hermes still thought that I should have taken the case against Packlink instead, and that they would try to recover the court costs themselves from Packlink.

To be fair to them, if Packlink wasn't based in Spain I would've made the claim against them instead. But since they are overseas and the law lets me take action against Hermes directly, it's the best way of trying to recover the money.

So this is a great win. Thank you so much for your help and all of the resources available on this site. It has helped me so much especially as someone who does not know anything about making money claims.

Many thanks, stay safe and have a good Christmas!

Welcome to the forum Un1boy,

You are right to take it steadily. Being methodical in your approach should keep any claims running smoothly.

For each account it's a good idea to find out what has been taken and then take a view on what you want to do with that information. For example, you can prioritise which accounts to claim on first based on their value, interest rate, or hassle-factor.

Bean

Well, sent my DPA request to Lloyds with the cheque. They received it 22.06.2006. It's been a week now and still not heard anything - can I start the 40 days from the date they received it because I've got recorded delivery proof? Or do they actually have to cash the cheque first?!

Hello un1boy,

I believe you can count the 40 days from when they receive your letter. The £10 fee is the statutory maximum and they may or may not choose to take it. Sometimes they do, sometimes they don't.

In my DPA letter I gave authorisation for them to take up to £10. They sent the information on my current account at 18 and 20 days (in two batches) and they debited my account by £10 just afterwards. My credit card info requested on the same DPA letter arrived at 43 days in a torn brown paper envelope, with my personal details open to view.

For both current account and credit card, I prompted them after about 14 days, to help them meet the deadline as it is in the interests of both parties to make sure this happens. If you choose to send them, you may wish to emphasise to the bank in your prompting emails that they are required to send your data in a protected fashion (e.g. well packaged) - this is under the Data Protection Act after all. Presumably the encompassing Freedom of Information Act means freedom of information to you, the person they hold information on, not freedom of information to all and sundry.

Regards,

Bean

It's a list of "customer noted".

It looks like this:

[DATE] MO STDLET

LU906 First Class Central

There is a list of explanatory notes too, this basically means that a Mail Out (MO) of a standard letter (STDLET) was sent to me on that date. I think thats my statement as there are loads of these. There are a couple indicating when I opened my account and also when I closed one of my other accounts.

Does this help?

At the top of each page you see the word 'search' in the blue bar. Click on that and enter your searchword(s) in the drop down box. Click 'go'.

Well done Topgeeza! Great news! As Bookworm said I have found mjanet's thread the most comprehensive on the subject of Ts & Cs. Not quite there yet mind you, I got my Notice of Acknowldgment of Service dated 14th July, so was about 4 days behind you at that stage. SCM are the solicitors. Still no AQ for me though. Maybe they're all on holiday as you said before! Enjoy your good news! Saj x

Just an update - Lloyds received my prelim MOnday 07.08.2006 and I got a reply today, you know the usual fob-off letter "I'm sorry you have made a complaint, we will get back to you in 18 months!" lol.

Now, my question - they have been quicker than I thought and my first deadline expires 21.08.2006. Should I wait until this date? I was reading through this forum yesterday (well, I do everyday - seems to be all I do online now, whcih I don't mind at all!!!) and it clicked to me that we actually give the bank(s) 28 days to sort it our amicably (14 days first letters + 14 days second letter). Is this significant or should I issue them with the LBA now?

I know people seem to haev different views on this and I am tempted to leave it, however I am just impatient and would rather get this over with asap. It's the whole court thing though - would a judge look unfavourably if I haven't given them the FULL 28 days to think about it? Or is it sufficient to act on their reply.

I was just thinking that, if the role was reversed they would guive us 28 days to reply, but once we have replied they can issue the next steps can't they? I would have thought the 28 days just gives them enough time to reply but once they have replied the deadline can change?

I didn't have this problem with HSBC - they replied to all my letters one day before the deadline, so I just waited, lol.

Any thoughts?

Thanks guys.

There are three points I would make about the 14-day deadlines:

1. A Preliminary Approach for Repayment letter then a Letter Before Action each giving 14 days gives the bank 28 days to pay if they choose to. Ultimately a court could look dimly on a reduced timescale, taking the view that the Defendant had not been offered sufficient time to pay.

2. You are controlling your claim, not the bank. If any of your actions (either reducing or increasing the length of your claim) are a response to what the bank does, you are conducting your claim on their terms and I think you will probably agree that we have all had quite enough of dancing to the bank's tune.

3. I think I am correct in saying that I have never seen Dave, Bankfodder or any of the Moderators recommending a reduced timescale, i.e. one of any less than 28 days.

Bean is correct in everything he has said , you are expected to try and settle and only use court as a last resort .The court would look at 28 days as being a reasonable time .that is why both the template letters give 14 days each and we always stress to stick to the time limits you give them.

You need patience with this :)
