Hi there, I have a claim in process with Abbey that's currently at court stage. My account is £500 overdrawn, due to these charges (I have no overdraft limit on this account). Abbey have passed my account to a DCA, I thought that they couldn't do this whilst the account was in dispute or does the test hearing alter this?, can anyone please point me in the right direction along with a pointer to a letter please?

Hi, yop need to write to them in the strongest possible terms saying that the account is in dispute and with the courts at the moment, you could offer to pay them something that you can afford and dont be bullied into paying anymore, if nothing else, it will increase the amount of money that you get to keep when you win your case. Have a look in the library section for a standard letter.
