Quick question, hope im on the right thread?

my sons case v NatWest has been stayed, they (cleveland combined court) have since sent an allocation questionnaire, do i still complete and send it to the courts within 14 days of issue? should i also include the basic court bundle at this stage?

It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.

Remember that if your claim is involving a credit card claim, then it should NOT be stayed, and if it is you should appeal this decision immediatly.

:x received a letter from DJ sollicitors saying that they have applied for the case to be stayed.... and that i should be getting a letter from the court to confirm that..

in regards to the letter from DG sollicitors for the stay... do i have to send a removal of stay letter yet or wait for the court to confirm this first...

The case seems to drag.... and the bank seems to try to buy more n more time....

:-( Dunnoo whats next...... Had an account plus with hsbc where they were charging an extra 12.50 monthly which ive cancelled now.. and they still charge me £75 for being over my overdraft limit at most by £10///

These bank are just making money out of us...........

The Guildford court is on the case by case process and despite the application from DG.. any boby knows if the guildford court will accept the stay or not..

 

Give me a good news anybody ..... to boost me confidence a bit .. feel that am fighting a losing battle.......HELP>>>>>>>>>>>>

wait till the court tells you i recieved a letter from cobbets they faxed the court asking for a stay but when i contacted the court the lady said they failed to fax the fee as well icon10.gif.

The test case is scheduled for Jan and Feb 2008. After that it usually takes several months before the final judgement is delivered.

 

Then the fun really starts with appeals, and potentially these could drag on for years. All of the delays are stated to be till the conclusion of the test case, so all stayed cases will be held until all of this is completed, if it goes the way that the banks and the courts want it to.

The situation in Wales is a good example of this.

 

There was a bulk hearing due in cardiff mid August, with 600 cases. All of these were stayed following the announcement of the test case.

 

Now, all cases in Wales are also being sent there (without any explanation why), so there must now be tens of thousands of cases all in sacks in Cardiff.

 

People who appeal stays are told that they will be looked at 'next week', which is the same story the court has ben saying since early August. Its a total shambles and an absolute disgrace when the court has been paid to provide a simple service that they are there to provide.

 

Its also becoming clear from various courts that the volume of cases is being processed by staff not by the judges who are supposed to do this. So far there is no proof of this but if anyone gets any please be sure to post it as it is a clear breach of the regulations.

Icy, have you formed any ballpark impression on what percentage of hearings previously set for the first two weeks of September have now been stayed?

 

If hearings are stopped and refunds stopped, drastically reduced contributions to CAG are probably already in force. Cannot afford for this site with 150,000 members to go off air following a six-month starvation of funds.

my case at weston super mare county court was stayed,i applied for the stay to be lifted using n244 form and the letter off penaltycharges.co.uk i have now got a hearing on oct the 4th for my application to be lifted

and it did not cost me anything to do,i will post details of what happens on the day so the list can be updated

At Stoke-on-Trent Combined Court by Deputy District Judge Connolly.

 

Upon the Courts own motion. The court has made this order of its own initiative without a hearing.

 

IT IS ORDERED THAT:

 

as shown by other threads on this site. The courts must have a bundle of photocopied sheets to send out to people.

 

I cant believe that the court would apply for a stay after all the money we have lined the courts pockets with. I'm sure if it was the other way around i.e LLoydsTSB V ME the judge would not be so quick to grant a stay.

 

Has anybody actually won at this court since OFT test case came about, its just that in the list of courts it says this court is ordering stays on a case by case situation??????

I'm afraid that, yes all cases at Stoke on Trent Combined Courts have now been stayed.

 

I phoned on Friday to check the situation and was told that they were, haven't been able to post until today with an update.

 

Stafford though are still going on a case by case basis.
