You're right of course. My sister telephoned me when the clerk told her the claim would be stayed, I told her to enquire why, as the OFT case has no relevance to credit card claims. The clerk went away to ask and came back with the answer that the judge is staying all claims regardless.

 

The probable answer is that the courts have never seen so many cases since the whole bank charges thing exploded, we've been a major pain in the *rse and a blanket stay is a simple way to avoid it all.

 

 

What really gets my goat, as it were, is that the judiciary should NOT have the right to unilaterally take action, outside of their remit, that can seriously adversely affect the financial well-being of many people, just because the Judge and the Court have a heavy workload. It is an apallingly bad reflection on our legal system. The 'powers that be' should be ashamed of it!

CENTRAL LONDON COUNTY COURT.

 

 

Have been in touch with them today and been told that no 'blanket stay' regarding bank/CC penalty charges claims is in place.

 

District Judge assessing each claim on individual basis!

Is that a good thing? With this advice, can anyone tell me if this (Central London County Court) would be a good place for me to file my N1 claim??

You need to look at your Local Court though, as any claim is likely to be transferred there anyway - I can't see a Court dealing with a Claim outside of it's Jurisdiction area? (I could be wrong!)

I live in C London, so I think that it is my closest County Court anyways..

 

Just want to know if given the information provided from the poster quoted in my above post, its a good place to file my N1?

 

He said that it "isn't" staying bank/CC claims.. Is that a good thing then?

It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.

Remember that if your claim is involving a credit card claim, then it should NOT be stayed, and if it is you should appeal this decision immediatly.

Just spoke to the Halifax County court, regarding my credit card stay.

 

I sent a letter, as instructed by the court, asking for the incorrect stay to be lifted.

 

Today, i was told that i now have to fill in the correct forms and send a cheque. I was also told that it does not matter what the FSA, FOS, AND OFT say, or the credit card companies - If the judge wants to stay credit card claims aswell, thats up to him, and there is nothing i can do about it.

 

For what its worth, i have asked for a court complaint form. I am more bothered about the lack of justice now, than the money.

I telephoned Chester Court on Monday (3rd Sept) and was told that they had applied a blanket stay to all cases relating to bank charges, i have a hearing next week (11th Sept) with the judge to put my case forward to have the stay removed, However, I was not charged for my appeal i just had to write a letter to the court to request the removal of the stay.

For what its worth, i have asked for a court complaint form. I am more bothered about the lack of justice now, than the money.

Just to say (and with apols to ICY) that I fully agree with you - the lack of justice is rapidly becoming a massive concern. The lack of consistency across the Courts is making a mockery of our Legal system. The consumer is getting a very raw deal and the banks are, no doubt, laughing their socks off. As I've said in other places, the Judiciary 'powers that be' should be ashamed of themselves.

 

Problem is, what can we, as consumers do about it?

Cap One - just under £1000 - WON (just over £1k) Nov 07 (JimmyBoy vs Cap One)

Lloyds TSB - £3.5k - Court claim issued, defence rec'd and AQ filed; Alloc'n hearing 7th Sept Claim stayed 29/8/07! (JimmyBoy vs Lloyds')

MBNA - over £1k for mis-sold PPI - WON - approx £1500(IpswichWitch vs MBNA . . .)

Hi all,

 

First time on here !

 

I did my HSBC claim at MCOL - two days ago I received a letter from MCOL/Northampton County Court stating that the claim will be stayed pending judgement of OFT case. It also says liberty to apply with a judgement.

 

Can I do anything about this ? It is mentioned somewhere about transferring to local court (mine appears to be carrying on as normal) so can I do this ? And if so how ?

 

Or do i now request that the stay will be lifted ? And if so is there a template as I cant seem to find one.

Would it make any difference if WE ALL signed a petition voicing our concerns about the blanket stays, and presented it to the courts. It's just an idea, although I haven't a clue where I'd send it

"When the Office of Fair Trading and the banks agreed at the end of July to go to a test case on the legitimacy of overdraft charges, the banks also approached the Master of the Rolls, the head of the civil justice system in England and Wales, and asked him to stay all current cases.

Instead, his deputy wrote to all senior civil judges in England and Wales and asked them to consider staying cases on a case-by-case basis, as appropriate. In other words, he left it up to them."

I appreciate marcus2864's scepticism about stays being lifted by a grassroots petition. However, even more so I agree with peterpete's point that justice at the moment is asymmetric.

 

Banks can put victims' lawsuits into limbo pending the OFT hearing. But victims are not allowed to resist still more unlawful charges ahead of the selfsame hearing. Banks can stop victims. Victims cannot stop banks. One side is told to maintain a ceasefire while the other side carries on shooting.

 

Judge Hickinbottom gave one reason for the stays -- "To allow individual claims to proceed is likely to result in considerable wasted costs". I would suggest that to disallow individual claims to proceed even while fresh injuries are daily inflicted, will signal to the nation that law courts condone one-sided contempt for the law.

 

If CAG or PenaltyCharges.co.uk would like to lead a petition I want to be the first to sign -- for the Master of the Rolls to advise courts that, for every bank still daily exacting unlawful charges, hearings stayed against aforesaid bank shall be allowed to resume.

 

If banks say there is no merit in this allegation of unlawfulness, why did banks keep a safe distance from court for all of 17 months?

 

£39 penalty charge for going overdrawn 39 pence? You cannot be serious.

Lambeth County Court has informed me that my case has been stayed pending the outcome of the OFT test case, yet in the meantime Abbey continues to take charges out of my bank account. :mad:

This is a valid point, I think if the courts rule in favor of the tyrants there will be blood on the streets as so many people are angry by these rip off charges lol. 8)

We all need to buck the argument of preventing wasted costs by having every claimant out there send in a requested to have the stay lifted - if it's at the Judges' discretion, lets force their hand and see how they like dealing with 600 requests to have a stay lifted each day... They'll soon realise that it would cost less to deal with the claim as normal than continue this pathetic situation.

 

I've already sent my request for my claim - have you sent yours?
