Hi all, I had a court date set for 7th september at ipswich county court, but received notice of a stay last week. I would like to apply to have this lifted but the bank informed me it would cost £65.00 which i cant really afford. I just wondered if anybody has actually had their stay lifted as a result before i decide if i should pay it.

I believe there have been a few cases where the judges have continued the claims following application to have the stay lifted.

 

What is very annoying is that although the test case is only for current accounts, the courts are staying all sorts of claims, including mrtgage claims, credit cards claims ect, now you can apply to have the stays lifted however the courts are still saying you still have to pay the fee, which is non claimable, so because of the courts mistake in staying a claim which has no relevance or bearing on the "test case" you are out of pocket, this issue really need addressing

It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.

Remember that if your claim is involving a credit card claim, then it should NOT be stayed, and if it is you should appeal this decision immediatly.

Liverpool County Court is staying all cases although they still make you turn up and put you through the heartache - evil b######s so anybody with a hearing dont hold your breath they also seem uninterested in hardship cases as well

If the stay hasn't been applied as the result of, or during a hearing you WILL have a limited number of days to challenge the stay - this shouldn't attract a fee, as you aren't making an application regarding an order, but you are challenging the decision itself;

 

NOTICE OF ORDER MADE WITHOUT A HEARING;

Because this order has been made by the court without considering representations from the parties, the parties have a right to apply to have the order set aside, varied or stayed.

A party wishing to make an application must send or deliver the application to the court (together with any appropriate fee) to arrive to the court office within 7 days of receiving this order.

 

If you wait until after this time, you will have to pay the fee as you're effectively requesting the Court to make another order to review the stay order.

i've got hearing tomorrow for a small sum and bank indicated they're defending. can I put something into court today saying that I beleieve bank are applying for stay and shouldn't be allowed etc? or do I need to do it tomorrow

Natwest court date 19th September 2007. Natwest applied for a stay but did not send payment. Case carrying on as normal but stay request will be included in file for judge.

Hi there, just like to add, that if you are on certain benefits, you can ask for an exemption against paying for the fees for the removal of stay. I too was worried about having to pay this, but after contacting the court, they said i was to fill in an exemption form and send it with my removal of stay notice.Hope this is of help.

Hi

i had a general judgement from Northampton and it says that HSBC have to file and serve a schedule in regards to the charges if it does not do this by 1st september then the defence will be thrown out.

I rang the court today and the lady there said that the judgement was still going ahead.

I have had no court date set so i am not sure if i would need to go to court

Has anybody else had this yet?/

Just take the letter with you, for what it will be worth - if you post/fax it now the Judge won't see it as most County Courts work on a 5 day turnaround for paperwork. (Which is probably the reason they just want to stay all these claims!)

The Courts have been accepting these "informal" applications on the basis that you've had notice of the Banks' intention to file an application - which is usually heard on your scheduled hearing date, if not stayed beforehand.

 

Be prepared with the standard response to stay application and any specific circumstances you have to argue against the stay, (financial distress, hearing date already booked in, Defendant's litigation style, etc) but it probably will still be stayed, sadly.

Looks like this is one Court that is bucking the trend! If you don't have a hearing date, just sit tight and see what response the Court gets - hopefully none and you should win by default if all goes to plan.

 

Again, be prepared to respond to a stay request, as they probably will turn up for the hearing date.

I was told last week, during a visit to my local Court office, that my claim was to be stayed and that I would receive written confirmation in the post in a couple of days. Well it arrived this morning and it reads as follows:-

I have 2 claims at Ipswich, Abbey and Lloyds, which have been stayed. I have been told by GaryH that as Abbey admit to a breach of contract in their defence, there is a very strong case for having it lifted, which I intend to apply for as soon as I get home at the end of this week. The Lloyds one though is a different matter as they defend on the basis of 'fee for a service' which is what the Test Case is all about, and I'll probably let that one go. Oddly enough I too had an allocation hearing set for 7th Sept for the Lloyds claim!

Phoned Darlington CC this morning. Initially told that cases are being stayed on a case by case basis.

 

However the lassy on the phone went to confirm this and came back with all cases automatically stayed.

Hole in one Buzz

 

Quite apart from being a monumental injustice, its a complete shambles across the nation. Staff at the courts are not being given any credible guidance and are being put in the front line of massive (and inevitable) consumer complaint.

 

Whilst I have nothing but disgust for the way that the courts are supporting the banks profiteering and profiting themselves at our expense, I feel sorry for the shabby way that their staff are being used in this pathetic and incompetent way.

hey ,

just receive a letter from DG sollicitors saying that they have applied with the OFT and FOS for a stay on the case. and that the FSA has agreed to that .. my claim started in beginning of april and is still being carried on ,..... thats not fair ... the bank was defending the case on a different issue other than the unfair bk chgs. i dont know whats next,,, need to wait until the test case is being resolve i suppose... can we get the stay off .......

Can I just ask for a bit of your greater knowledge here mate. I had the stay order from Peterborough County Court, quoting the OFT ruling. Not so swiftly followed by a letter (standard I guess) from DG solicitors acting for HSBC.

 

They quote the "fairness and legality" of bank charges and they (the solicitors) are confident that HSBC's charges are" fair, transparent and lawful".

 

I know I could just use the standard application for the stay to be lifted - but is that not a bit long-winded? Could I use the fact that HSBC had offered me £1,300 (without prejudice) to settle back in April, thus in itself being admission that their charges were onerous? I realise that "without prejudice" offers are off the record, but surely they are acting unreasonably to then "forget" this ever happened. I am inclined to call off the Court action altogether and write to them and say bugger this just give me the £1300 (loss of £700 if I do). I know they won't pay even so but has ayone tried this?

 

What do you suggest?

This is all down to how you feel personally about the issue - if you have an offer that you want to accept, no one is going to tell you not to in order to "fight the crusade" here. It's your claim - yes, we can advise/assist, but ultimately it's your call as to how to continue.

 

I'll quote Martin from MSE - don't get sucked in to the challenge! Think about how this effects you, financially, mentally and emotionally and weigh up if you want to continue.

 

If you don't, that's fine, no one will think any less of you - in fact, well done for even getting this far as you must have faced some challenges along the way already.

 

If you do, that's fine as well - but don't do it for the wrong reasons. Make sure you know what's instore and be prepared for more challenges along the way.

 

For me, an offer of £1k on a £4k claim just isn't worth it. If I was in your position, I would probably accept what you have now - remember, there is always a chance that "we" may lose on the test case outcome! On the other hand, the TC is all about "laws" that have been around for over 200 years - all of a sudden these "laws" aren't "good laws"? I don't think so! How can they overturn 200 years of precedent without putting the whole of society in general in strife? It's highly unlikely, in my opinion - but not impossible.
