ias far as i understand it there wasnt a test case as such on credit cards, just an agreement concocted btween the issuers and OFT this case does not affect CC claims and you should still file your claim, the wroding of my court order says it all

 

(a) A test case has been issued in the High Court between the Office of Fair Trading and certain banks ("the test case") with a view to determining issues of legal principal in relation to the recovery of charges made on bank current accounts and the applicability of the Unfair terms in Consumer Contracts Regulations and other legislation to such charges.

I got to see the DJ yestarday at birkenhead county court ,but after about 10 mins he decided to stay my case ,in fact he stayed all cases so why we all went in there i dont know ,as i got the feeling that he knew what the outcome would be anyway,ps solicitor did turn up representing hsbc in fact he acted for all banks involved ,and was asking the judge for stays,I AM STILL CONFIDENT THAT WE WILL WIN THIS CASE EVENTUALLY HOWEVER LONG IT TAKES .PS DO WE STILL GET ALL THE INTEREST THAT IS OWED WHEN THE CASE IS WON:?: :rolleyes:

Yes correct.The OFT ruling has no legal force,in fact the 12.00 figure is still questionable since the card issuers never did produce figures that could be reconciled to their costs.

Hello all,

 

i have just contacted Maidstone County Court, and have been tolds that all cases pertaining to penalty charges are to be stayed, banks and credit cards.This was ordered by the District Judge Millwood.They said they will be informing everyone who has a case in the courts.So i asked if i could contest the stay.They said i would have to seek legal action!

It would be very useful if you could post what your local court has told you regarding stay on claims due to the OFT report. We dont need to know what the banks said, we all know they will just tell us that they have a stay and that is that.

I am Hoping that this list will help in our argument to have stays set aside, by demonstrating to judges that (at the moment) the majority of courts are continuing with claims on a case by case basis, which is a fair and just way to continue.

I also hope to raise the awareness a bit, it may give us all a bit of hope if anyone was fearing the banks letters were right saying all cases were stayed when in fact they werent.

Just found out from West London County Court that Abbey has applied for stay on my claim. The guy on the phone stressed that it would not automatically be granted (think we all know what that means though:evil:)

 

He said to be prepared to come to the hearing on Friday but I can call back after 4.00 today to see if the stay has been granted. Shall I bother wasting a phone call and ten minutes of my time?????

 

Do we already know the answer??????? :evil:

Hi icy.Went to court its on a stay for 12mths.But when it goes to higher court in jan 16th i think the barrister said! If we win the banks have to pay ALL back plus interest even whats been took recently.The barrister for yb recons the banks wont win.So its stays a bury county court too.Now.Theres was 2stays yesterday the judge said

Just spoken to a nice lady at Winchester Court.

The deal is proceed as normal and stays may be granted IF a defence is entered, otherwise they wont.

 

Card actions are unaffected at present.

Be VERY careful whose advice you listen too

Clerkenwell and Shoreditch County Court - dealing with cases individually. Judge said no automatic right to a stay and particularly not in cases which were listed for a final hearing BEFORE the test case was announced. Permission for bank to appeal was denied. yay! I then won because my bank's defence was a bare denial (4 sentences long) and not compliant with the CPR. They had not served any further evidence in support.

If yours is a credit card claim you need to dispute this as they should not be affected by the stay!

 

Write to the bank - the court to advise/remind them of this & compalin to the FOS & OFT that the banks are abusing the waiver! :-x

Cant beleive what i've just read-i received acnowledgement of service and intention to defend the claim from Cap One on the 9th Aug. I filed at Leicester CC does this mean my claim will be stayed??? i thought credit card claims were still ok-i'm soooooo close!!!!!!
