    • Update! I have now opened the mail from Barclaycard. I am assuming that their letters were prompted by my confirmation to them of my change of address, which I had advised them of twice. They are treating my change of address notification as a "General Data Protection Regulation Right of Access Request"  and state that I have made a "Right of Access Request. They are asking me to provide valid indentity documents! I have made no such request and am minded to ignore their request for extra information? I should add that their letters were sent to my correct current address!
    • Are you allowed to appeal if you plead guilty?   I know you appeal the sentence, but the criminal record formed from your guilt would surely remain?   I'm not sure if your able to appeal a crimianl record if you plead guilty are you?
    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referenced  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx £2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!
    • Yes, a few months ago. They wrote back saying there was no CCA and the debt was unenforcable. I then started gtting bombarded with threatening emails from their 'litigations team' which have been sent to spam. I've now recieved the letter before claim with the PAP form enclosed, but still no CCA or even a letter from them to say the debt is deemed enforcable. Thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

HBOS have used many tactics to delay submission and preparation of claims for bank charges and may not have provided details of all other accounts you may have had with them. You may also have found it impossible to get copies of consumer credit agreements, insurance related policies, loans and mortgages etc.

 

This means that HBOS may potentially have breached their obligations to you under the Data Protection Act. Additionally, it may have meant that you could possibly not prepare and submit a bank recharge claim which are deemed unlawful. Or, you may unfortunately have been working in the dark and depending on HBOS to total up charges for you. Either way, they may have breached the law.

 

Additionally, HBOS have also used the tactic of saying they would only provide 6 years of statements. You should have received statements for your full banking history. Possibly as far back as 1992, if you had an account then. A full banking history is just that and not what HBOS wants to give you, so that they can limit the potentential size of your recharge claim.

 

With the advent of the OFT test case, my suggestion is that if this has happened to you, that you complain to the Information Commissioners Office. Everyone that has experienced this is encouraged to do so.

 

It is hoped that your complaint will then be part of statistical evidence during the OFT case.

Yes, it happened to me and your thoughts are something I relate to.

However, they require to report on the number and type of complaints received.

This type of disclosure information by all the agencies, ie FOS, ICO, OFT and FSA on bank charge related failures could potentially be used by someone during the OFT case. It might, might, be something that could help.

Happened to me also Kenny, Took 103 days to get statements although I did receive a list of charges after 76 days. About same time as ICO wrote to them., and another 18 days later, I informed both Halifax and ICO about this and still have not received some of info I requested. ie, original T & C and copies of all letters sent to me.

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

Your right stone.

 

We should not let them get away with it. A full banking history is just that. Banks tactics include briefing call centre staff to state that either that is all they keep, or all we are entitled to as they won't pay back more than 6 years. That is wrong on all counts!!

I reported the breach of the data protections act to the FOS in June.

 

I rang them the other day, and they said that they have not had time to look at it.

 

3 MONTHS AWAITING BARCLAYS, 1 MONTH THE INFORMATION COMMISSIONER, AND NOW THE FOS HAVE SAT ON IT FOR 2 MONTHS. AAARRRHHHH!!!! I JUST WANT MY STATEMENTS!!!!

 

I was awaiting the FOS outcome, then going to court, but i think i might just take them to court now. Most people are asking for £200 + their statements, and the banks are settling before court.

Not only have I done this twice, I am in the middle of two more actions for the same thing with Northern Bank and NCO (Europe) Ltd. (A dodgy debt collection agency which I intend nailing to the floor for harrassment, but not until after Ive caused them maximum pain for failing to comply with my SAR.)

i complained to the Information Commissioners Office in Feb, they sent a letter in March saying its awaiting allocation and yet i am still waiting!

 

On calling them all i am told is to wait your turn, its awaiting allocation!

 

I would have passed them many more complaints as not one of my DCA's have complied with anything i've sent them, no CCA s.77/s78, no Data Protection Act s.10/s.12, and no removal of defaults, but i have zero confidence in the Information Commissioners Office and think its a waste of time.

 

All i get from DCA's is threatening letters about court action.

I have written again this week to the Information Commissioners Office, as Halifax Plc have failed to respond to their initial complaint, which was made 17th July Their 28 days to respond to this is up - and they are now 100 days out of compliance with my original S.A.R - (Subject Access Request), made 30th March.

 

I await the outcome.

I don't think the Information Commissioners Office is a waste of time, but they are swamped at the minute. However, February seems like a heck of a log time to wait for progress :o

 

Have you considered writing to your MP to see if they might intervene?

Some of these 'dodgy debt collection agencies' are in fact complete inventions, with fictitious logos, fake company names and non-existent employees. Many of the letters we receive from these organisations are in actual fact from the principals themselves, passing themselves off as DCAs.

 

I think this is a practice that could bear further investigation. At the very least it is misleading.

Have you considered writing to your MP to see if they might intervene?

 

I might do that, but first how do i complain about the ICO to someone?

 

Yet, the DCA i complained about merrily continues to default me with no legal right and never had any in the first place.

 

(By the way, this is from my Lowell - 5 defaults thread i have, yes, 5 defaults and not a peek out if the ICO!).

I meant asking your MP to intervene on your behalf to the Commissioner. The Information Commissioners Office itself also has its own complaints procedure.

Well looking at the PDF I would say that you can complain to your MP straight away, using the link I gave and complain internally to the ICO. Then, if all else fails, complain to the Parliamentary and Health Service Ombudsman and ultimately appeal to the Information Tribunal.

 

You appear to have plenty of options open to you. Good luck!

Hi Kenny

 

I've complained to the ICO about Howard and his mates, I complained really to get a bit more evidence of their delaying tactics for when I go to

court.

 

I have a received a reply from the ICO, which basically says that they are aware of the problems the banks are having responding within the forty time period.

 

They also said in their letter they would contact HBOS with the details of my complaint.

 

When I sent my compliant, I inlcuded my proof of delivery slips, which seems to have made a difference.
