Can you explain this for the newer user please...?

When you request a copy of the credit agreement they have 12 working days to supply it from receipt of your request. After this period they are in default of supplying the agreement and can not lawfully enforce the account. If after a further calendar month they have still failled to supply a copy of the agreement they commit a summary criminal offence.

HAVE YOU BEEN TREATED UNFAIRLY BY CREDITORS OR DCA's?

Just as a matter of interest. What sort of figures are we talking about if I do the charges thing. Guessing at £900 charges with 9 years interest...

 

Credit limit £3500

Default balance £4400

 

Balance after 9 years of £10/month payment £3400

Depends on the interest rate and when exactly the charges were. They may end up owing you money or you could owe them a few hundred pounds, that's if you go for contractual interest and get it.

Have they still been charging interest since the default? i would suggest that once you have done a spreadsheet like the ones i do they will owe you money:p

Well seeing how there's 1100 between the limit and default that's the minimum I would expect.

I would of thought there'd be enough to easily walk away owing nothing with maybe a few hundred spare.

CCI would make this a different game entirely.

Look at my Cap1 thread.

£500 over 6 years interest alone was £1,200 !!!

Ok the settlement was that but it was more than enough ;)

That is completely different from the letter I got.

 

For what it's worth the Information Commissioners Office replied to me today about the unlawful CRA entry Wescot added, they wanted evidence of the entry - hopefully this means a swift kicking is due to them.

 

I was hoping for some swift justice.....but I'd still not heard anything from the ICO about Wescot.

 

Just rang the ICO to find that they are processing files from mid June today - gah!!!

 

DMD - If you are planning on taking the the non complicance up with the ICO that you will be prepared to wait!

I submitted an ICO complaint in June, I have just had my first letter saying that my case workeer has been allocated and I'll be contacted in due course, taken a long time but worth it for the poo Robinson Way & Co will get into when the ICO has finished with them.

All my knowledge has been gained from personal experience and the sharing of advice from fellow members.

The bit I dont understand is that I raised another complaint approx 10 days later with regard to another company and had it resolved approx 6 weeks ago (making it about a 6 week turn around!!)
