sorry I have only just found this site so have been doing things on my own until now.

Well I am trying for 4.5k and have so far had 750 and a letter saying they won;t take it back if I still go to court.

I have now got a court deadline of 15th august to have my terms and conditions etc etc into the court. I have looked on one of the sticky threads for what I need to send so will get that all together over the weekend.

I pressume though that even if I send all my stuff as the bank have until 27 septemebr to reply they are going to say we don;t have to until the high court has mage a ruling?

Feel a bit daunted about what I need to send but i suppose that is what they are hoping that I will back down.

Will let you know who I get on

Hi Lisa, do you mean you had an order for directions to hand in your bundle? why is the bank's date later than yours for their evidence? Do you have a date for a final hearing? Until Lloyds tell you they are going to ask for a stay, proceed as normal, and if they do tell you they are going to, consider whether to oppose it, there is a sticky in the general forum with evidence in support, which has today been praised by a judge in Penrith. Don't feel too daunted, there is lots of support on this site!

thankyou.

My court letter says they (the court)loooked at my case and I now have to reply by the 15th and the bank then have until 28th september to reply to that!

Am wading thorough what to send now.

well, it's a positive sign that the court have not made an automatic stay so keep going. It's fair to say the bank are almost bound to write and say they want a stay but if they wait until after you have filed your docs, it might be easier for you to argue against it as by then you will have spent further time and money copying stuff which they could have saved you doing. If the Court is a decent one, they may be prepared not to order a stay especially if you can prove it would cause you hardship to wait x years for the money

my only worry is that it is Hull court who has one of the judges that said he didn;t want to see any of these cases!

I may as well send everything off though and see what happens.
