    • Hi, wondering if anyone has any helpful advice for me please:    I took out a secured loan with GE Money in 2007 for £6k, repayable over 25 years. The loan was brokered by Ocean Finance. The stated commission payment was £300 and a further £150 was charged for “application assessment and completion costs”.    About £4K of the loan was used to pay off other debts. My credit rating was poor at the time, with a history of late/missed payments. I was struggling to manage financially both before and after taking out this loan. Within a few months my direct debit payments were often returned unpaid. I took out a further secured loan (with a different company) about a year later.    My income at the time of the GE loan was £16k p/a (gross.) My mortgage payments were around £470 a month and the GE payments were around £70 at that time.    I cannot recall detailed information about my other outgoings - I was a single person living in a small terraced house, I didn’t run a car and travelled to and from work by public transport. I certainly never had any “spare” money (I had only bought my house the previous year and put every bit of my savings into it) and constantly struggled to manage on my income.    I have sent a SAR to GE and the documents I have received do not include anything I did not already have copies of, except for their call logs, which do not show anything of note.    I also sent a SAR to Ocean Finance, but was told that Ocean Finance and Mortgages Limited ceased trading in 2016 and that Intelligent Lending Limited, who now own the Ocean Finance brand, do not hold any information on the loan.    I have three issues:    Do I have scope to bring an affordability complaint against GE? I have had some success with complaints against other lenders - would the process be the same even though this is a secured loan?   Is it likely that there was secret commission paid on this loan and if so how can I find out? I understand from older posts that an “underwriting agreement” might give me this information - should I ask GE for this specifically and what does it look like?    Is there scope to argue that it was unreasonable for the £300 and £150 fees to be automatically added to the loan and that I should have been given the option to pay these up front, rather than paying enormous amounts of interest on these relatively small sums over the course of 25 years?    In case it is relevant, I have just paid off the loan, using monies I received from other affordability complaints!    Thank you in anticipation.

    • What happens now is that the central court will send both you and the fleecers a simple form called a Directions Questionnaire, and then allocate the case to your local court in the small claims track.   Read some threads with "claimform" in the title and you'll soon get the hang of the legal process.  In fact it's essential that you gen up.    
    • Back in September my husband was at home with our 2 year old son and 5 months old puppy when suddenly a DPD driver walked into our property.  We live on a main road and the front door was wide open while he tried to take a picture of the goods inside.  My husband was shocked and furious which is understandable as open doors, main roads, puppies and toddlers don’t mix.  At the time we had a man in servicing the boiler so the front door was not locked.   My husband shouted at the guy to get out and the rude driver persisted with his attempted to picture  the package in the hallway even calling my husband “white boy” and telling him to shut up.  My husband ushered him out of the house and shut the door.  He immediately called the local DPD depot and raised a complaint to be told that someone would call him back.  This call never came.  We did not pursue this as no harm had to come anyone and DPD were obviously not interested.   Fast forward a few months and I was expecting a coin from the Royal Mint for the value of around £750.  The tracking on the delivery of this stated that coin had been delivered, then it said it had been delivered to number 2 (we are number 18).  Calling over and over again I was never supported by DPD as to where my package was.  The Royal Mint was informed it was delivered and I was invoiced £750 for the coin.  Try as I might to have this invoice removed from my name they would not budge as DPD said it was delivered.  It nearly got to court proceedings before the coin eventually landed back at the Royal Mint.  After that debacle I was frustrated, rejected another coin being sent and left it at that.   Again we move forward a few months and I am now expecting some gardening tools to be delivered that ordered from Amazon.  I had no details of the delivery but then I get an email from the seller advising me the items are on their way to them and I will get a refund.  I check the tracking information and once again DPD have returned the items. I thought this was odd but calling through to DPD offered no input as to why and they just told me to order them again.   A week later I take out a new contract with Sky for a mobile phone and on the morning I am due to get the delivery from DPD the goods are sent straight back to sky.  I was so puzzled at this point so I call DPD and ask them why. They inform me that there is no name on the parcel and due to the value of the goods there has to be a name.  I literally spend all day on the phone to sky speaking to various departments trying to get a new phone but they all inform me that I have to have a new order which means a new credit check.   I hate this idea because one credit check knocks your score by hundreds of points and takes months to build back up.  In the end they say they can send a new phone and to my relief they dispatch that night.   The next morning I wake to a message to say the phone had been shipped but was rejected by DPD and sent back to Sky.  I called DPD and was told they can’t tell me why and I must speak to sky.  I speak to sky and they tell me I have to speak to DPD.  My frustration is working overtime at this point and I have nowhere to go.   I remember I have a contact through work of someone at DPD who was trying to get my company to use DPD’s services.  She was incredibly helpful and confirms that my property has been blacklisted because the driver feels unsafe!!!  He feels unsafe!!!  He was the one who entered my home yet he feels unsafe???  My contact passes on my details to the exec helpdesk who proceeds to tell me that they are very sorry that all of this happened, they have retrained the driver however they will not remove the ban on deliveries to my property.  I ask why I cannot collect from a local drop box or shop but am informed they do not offer this service (although this is a service they promote as it saves the environment).  They say my complaint was called back but we didn’t answer however this is not correct as no call was ever received.    To make matters comical is that the same driver deliveries to my husbands place of work and he collects/delivers regularly.  He doesn’t even recognise him let alone feel threatened by him.  The exec helpdesk have said sorry for their lack of transparency on the blacklist of the address and for the bogus reasons for rejecting my parcels.  They have said sorry for not following up the call more than once and they have said sorry that delivering to drop boxes and shops is not something which they do.   They seem to be very sorry for a lot of things but it does not help me fix this issue and it impacts any further online shopping as I must now always establish who the courier is before placing orders….which is quite a difficult thing to do!   Where do I stand with this because I still don’t know what the driver is even saying happened as nobody will divulge this.  They seems to have closed ranks and are taking the drivers word as gospel over the version of events which we are not able to defend.   The lies they have told so far to me and their customers (Amazon, Royal Mint, Sky) about the bogus return reasons shows they are not a truthful company.     • Given they have presumably done this work for other properties, hopefully your complaint will now make them take you seriously and put you at the head of the queue.   If that fails and you do have to threaten or take legal action, given what you have - paper trail, promises by them to do the work at various dates, acceptance by them of their responsibility - I think you're in a great position.  You've gone the right way about this.   Let's do this.  Wait till Thursday.  Then come back here and if you've had no joy we can think about a Letter of Claim.  Legally there are various timescales which may or may not include giving them a final chance to complete the work before you do it yourself and sue them - I'm afraid I only have the vaguest knowledge of these but on Thursday we can "call in" Caggers who have years of experience with problems like yours.    Very good idea of yours to get quotes for how much it will cost to do the work.

Just discussing the welcome car finance situation with our business manager and he has told me that over the last few months that we have had loads of applications from them for jobs, we have even had an applicant from log book loans so they must be desperate aswell.... i cant wipe the smile off my face at the moment with the thought of these cretins about to hit hard times... they will no doubt realize that job losses do change your circumstances and soon they will be using our resons not to pay as reasons for themselves.

what does this announcement mean for us who have aggreements with welcome car finance

your debt will be sold on to a DCA but i would request a CCA and a SAR as this is how im getting my agreement written off. My agreement has gap hidden in the finance with no reference to it and my agreement even states that i dont want it but after i received the statement , the gap is there in black and white, little buggers have hidden it. so i would suggest that you get all the info you can on your account asap.

Im not happy, for a while I thought I was one of the few unlucky guys with an enforceable agreement, but i didnt mind, i made my bed it was time for me to lie in it. I didnt even mind when my subject access request and change of address form was "lost" in the post. But now Welcome have really got to me.

 

A few weeks ago a guy called Dan phoned me from debt collection and said that he could offer me a loan which would pay off my old one and reduce my payments so I could afford to repay them as I had fallen behind on the last one. Being wary I didnt commit myself fully I told him how much I could afford and mentioned that I May be able to make a £100 first payment on the day I got my student loan, but I wasnt sure because it depends on my budget, he came across helpful and told me that wasnt a problem and that he would phone me in a week, little did i know i was talking to a machievalian prince of the highest order. I stupidly gave him my account details so if I could afford it he could take the payment out on student loan day.

 

A week passed and like the majority of the girls I meet he never called, fighting the repressed memories of rejection in the past I plucked up the courage and called him, he was "away" collecting some poor saps money so I was told that he would phone me back as he was only going to be about 45 mins, the day passed without a phonecall. Thinking he would try and get hold of me sometime leading up to loan day I didnt think much of it, but he never called. I know this as my housemate is writing his dissertaion downstairs next to the phone and has only managed 10 hours sleep since last thursday, and even if he did call in one of those rare moments of rest for my zombiefied housemate he still didnt speak to me to confirm.

 

Loan day came and I was busy visiting banks transferring my loan to cover all the bills that have built up since I last had money and I missed a call from welcome. Still no confirmation then. As is often the case on loan day I didnt check my balance all day I was revelling in having some money and was spending it wisely on food stuffs. It wasnt until today when I was trying to pay a bill over the phone that I found out that my account was now empty, "strange" I thought as even with my copious buying of pasta and noodles I should still have around £100 left in the bank. After waiting in line for what seemed like an age in the bank the ugly truth was revealed to me, £100 had been taken from my account 10 mins after I put the money in, the swines.

 

The tragedy of the situation was if Dan did speak to me he would of found out I could only really budget for around£20-£30 down payment. Oh and he never sent me the documents for the new loan agreement either the fecker.

 

So now I must turn to the trusty caggers and hope that you can fill my day with a little bit of hope. What should I do, oh and sorry for the mini essay, really needed to vent =]

Welcome secured recoveries are alive and well, they have just 'accepted' the net balance left on my property (around £5000) get this to discharge the security (the illegal security) and the balance will be turned into an unsecured loan which another department will deal with...when asked if I accepted that they would take the balance I said I had no choice it was out of my hands but no, it wasn't fair or legal and they should expect my letter regarding charges and PPI.

 

also when i queried that Nu & DG couldn't find my PPI details I was told that there was about 3 or 4 people who specifically deal with this within Welcome and it would go to them.....to clarify I asked for a contact for direct group and was told there was a department within welcome that would deal with it...what fun as I have my policy booklet!

 

What really scunners me about all the stuff I've been through is that the person that made the decision about settlement had not read my file, knew nothing of my complaints and basically looked at the settlement figure they wanted (£14,000) and what they could get (£5000) and as far as their unsecured loan, if I could whistle I would (can't ride a bike either, I know!) :shock:

 

Also there was contradicting info on charges & interest being added to my account, when it went into dispute it stood at £6000 and apparently is now at over £7000! I did mention no charges could be added to be told they wouldn't have been while it was with that particular dept...it hasn't left that particular dept!

 

So decision for me guys is do I cut my losses?, send everything to FSA, go after charges & PPI again? same merry go round although better informed, lets face it I would have paid them £5000 to get out of my life!

 

Advice would also be appreciated as they are not saying this is full & final settlement, has to be approved by one of their directors, aren't they all in the nick? Also they wont mark the account as settled on credit reference agency. anyone know where I would stand on this? If they accept a bulk payment surely that is settlement? Especially as I was told it would look bad for me in any claim i make if I give them a bulk amount AS IF I HAD A BLOODY CHOICE!!!

 

Essentially I have been cleaning my credit for a few years & welscum drop off in december, can they default this loan again if that balance is now unsecured? any advice on the legalities of this would be much appreciated. God they really hang on like clampets, it's astounding the delusion they are under because of the power they are given.

 

Still haven't heard from Direct gov about my loanshark complaint. Thanks again to all on the forum, I don't think I could have got far without you or dealt with the outcome with such graciousness in the knowledge that others are really winning. ultimately i haven't been stung that badly and I will learn most definitely and have now joined my local credit union which eases my soul as far as financial organizations, I'm not saving a lot but a little at a time.

 

I urge anyone fighting them that has security on their property to get this checked out, they hang on like bull terriers so if your thinking of selling or anything see where you stand with them, ask them to explain all and every charge and notice of interest change, request a settlement figure every year and watch how it changes. I got stung by the rule of 78 or the like and the bingo machine!

 

Any words of comfort and/or chocolate gratefully accepted till I rise tall again.

Don't know the details as yet but from what I gather the outstanding balance of their original settlement minus what they get from the sale will be classed as an unsecured loan, no new cca to my knowledge therefore since it is leftover it will still be the same loan number. I certainly won't be signing anything with them. Essentially it's the same loan with no security, tho how that works I don't know, security will be disposed of, they will have no leg to stand on. My concern is if I go after charges etc and the loan isn't marked as settled then am I admitting the loan is legit by claiming against it. I have a fuzzy head with all this. but they are still adamant they won't pursue me in court for any outstanding funds!? Crazy.

Well here's one her name is Sarah Valentine and she is the director of compliance - don't let them fob you off that there's a department within Welcome.

i have just been informed that welcome have today gone bust ! does anybody know if this is true ? also , is there any way i can get out of my finance arrangement with them without losing my car ? i have about 14 payments left to make .;)

You are now in the same boat as me. I sold my house and i had a secured loan of £15000 with welcome. I had to cut the price so welcome only got a couple of thousand after halifax had put their early payment fees on. Anyway they still keep adding the £270 in interest every month even though i was with CCCS and could only pay £90 per month. My balance now stands at around £20000.

 

I dont know what T&C's they are working to as my agreement is for a secured loan. They have defaulted me last month without even telling me. They have just carried on as if nothing had changed and are saying it is now unsecured. I have stopped paying them now. I decided that as my balance was going up anyway i was just throwing money away each month that i could really do with having myself.

 

I dont really understand how they can keep charging interest and defaulting me as if it was still a secured loan, nowhere in the T&C's does it say the loan will revert to an unsecured if the property is sold. Anyway, im just waiting for them to go bust then i will try and come to an agreement with whoever takes it over. Welcome are so hard to deal with i have given up trying.

Thank you again, for all your hard work, experience and graciously always finding time to help everyone...how do you do it!? you haven't cloned yourself have you, because it's a thought!

 

Your right and it was on my mind to drop the fight for the time being till the default goes, then go from there. Also they won't know where I'm moving to so I think I take the hit and cut my losses for sanity if nothing else. Thanks for clarifying the default issue, I thought they couldn't default twice and I will never sign anything with this company again...ever. :D

 

I think it's the injustice and anger at what they get away with that hangs around, but that will go eventually.

 

Andie, thanks for the contact at DG, once the house sale is tied up I will send copies of my policy with all their names on it and ask where the money went & what was refunded. I never expect to get a word of truth from them so never believed it anyway, it's just good to confirm that they don't have a clue...But like they say it will all come out in the wash.

 

I might still hang about for my daily fix of this thread tho even if my fight is on hold :D
