    • As i don't have any mitigating circumstances other than trying to save pennies, will they fine me to the maximum? What is the maximum fine they will impose? I honestly don't know how many times i use it.  I will get a criminal record which means i can't find another job? Will they prosecute my partner?   
    • Yes. They won't inform your employer but you may need to. You need to check what it says iin your employment contract. I don't think it usually causes huge problems for most people. HB

I've read a few threads briefly regarding a dmp with stepchange and was 95% complete with setting one up when I noticed the advice of letting things default instead and/or managing a dmp yourself. My current situation is the following £470 owed to Jacamo. Has not defaulted. Currently on a £10 payment plan with them for 12 months. Not sure what to do here £2700 owed to Vanquis - Credit Card. Has not defaulted and I have not missed payments. I am unemployed and even making a £200 payment from my benefit means £80 odd gets eaten thanks to interest. Guessing I let this default and then set up a payment plan after? £2500 owed to Lowell who bought from Very and passed on to Overdales after I ignored them. Last payment to Lowell was 30th November 2022. Plan here was to fight them in small claims court if it ever gets that far, assuming the worst. Any advice is very much appreciated, thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

Apparently in a recent report/survey by OFT about regulation of finance industry, irresponsible lending and second charges in particular and what they consider irresonsible and what guidelines should be in place etc etc, cattles PLC very kindly responded by saying there was sufficient regulation on lending practices and no further guidance was necessary, AHEM!

Glad they ain't writing the acts and seem to be in a minority and luckily OFT don't agree with them and think there is improvement to be made. Might be a bit late for cattles...LR still cannae find my charge certificate and I got a little email from Mr Brunt at DG (looks like he's bearing the...Ok, obvious but been a long day wi unresponsive students :roll:)

Evening all...well no news on the Cattles results yet...nice phone call from my local branch today asking for money, told them straight, "sort my SAR and give me some statements on my account" (nearly 2 years and ive never seen one !)"and i might think about giving you some money". "oh yes and dont even dream of sending any of your goons round to my house ok, my wifes nearly 6 months pregnant and ill call the Police if you do ok"

Bye Bye !!....Funny they didnt ring back after that ear bashing !!!

just checked another credit file site, welcome down as progressive and the agreement under welcome on the first site which according to that was settled is still running according to this other site,so totally confused even more if the credit references don't tally how does anybody know where they stand.

You must be lucky I have had them round twice, 1st time they got through the secure door entry system (block of flats) 2nd time I saw them hanging around my car, didn't let them in!!:)

Anyway I have got a solicitor looking at a disclosure order for me and DG don't seem to like it that I've suddenly turned on them (after all the help they gave I should be ashamed ;) ) - but I have told them - you're the only one so far that's admitting you've got the information that I need and unfortunately you have Cattles PLC to think for me turning on you - if he'd been decent I would have let you off the hook - UNLUCKY!!!

 

Hopefully should have it ready to file tomorrow - Nottingham County Court here we come again Mr P - though they probably won't let you come out and play - they'll send a REAL legal team!

Am taking on Welcome for some friends. Brief study of the paperwork today shows that they borrowed 7k for a car, then there was previous o/s balance of 3k which was offset by 3k trade in allowance. Total amount of credit 8k???????????

=8000

 

This is in the pre-contractual paperwork supplied by the garage. The loan agreement shows they borrowed 7k and 1k was to settle a previous loan. :confused::confused::confused:

 

SAR on its way. Car blew up at the weekend anyway, so we decided that was fate playing its hand.

 

My friend tells me that they have been charged for phone calls that they didn't answer and home visits when they weren't there. The o/s balance on this one is 19k :confused::confused::confused:

Evening all, just managed to get back on, my whole quarter of the country had a power cut! What a carry on, it is ridiculous how helpless we become without electricity for just half a day!

Well the 40 days is up today and no SAR received....now theres a surprise, sisnt actually expect to receive anything on time anyway...

 

Did get a reply from Simon at DG..in reply to my PPI info request that was emailed to NU, and sent around a million departments....Simon is looking into it and will get back to me....we shall see what happens there then !!

Must have been a coincidence that i mentioned it on here over the weekend, and suddenly there is a reply waiting in my inbox....

To those of you checking he charges etc recorded at the Land Registry, if you find ANYTHING irregular, whether you are unsure about it or not (ie both signatures required on paperwork for joint), complain bitterly to the registry and get them to respond to every point in writing.

 

When I worked in insolvency, it was the Register of Scotland (ROS) we dealt with to place inhibitions etc and they were notoriously strict...as they are supposed to be, but if you phoned with a question you quite often got some young person and not much by way of a definite answer on things.

 

If there is anything wrong, focus on the registry and hound them with a complaint - they will cover their backside no end and turn the heat on Welcome, as I know in the ROS they were very strict with procedures and staff and didn't tolerate cock ups.

 

At least I hope thats how it still is!
