    • moved to the debt self help forum. plenty of like threads here to read along with the ones you've done so far..good work. last thing you ever want to do is look at any kind of IVO/BK or anything alike concerning consumer debt, never do that, turns unsecured debts into secured ones in many instances. your best bet for now is p'haps looks at  Options for dealing with your debts: Breathing Space (Debt Respite Scheme) - GOV.UK (www.gov.uk) sadly you have to go thru one of the free debt charities to invoke that but DON'T be tempted to also open up a DMP with them, just get the Breathing Space done. get that in place that gives you at leasy 60 days buffer you've also goto to realise you'll probably get a default once breathing space is in place, bit if not it might pay you to withhold payments even after BS then p'haps re start payments once a DN for each debt is issued and registered. at least that way, whatever happens in 6yrs the debt will drop off dx  
    • Hello, I am a private seller and recently sold a pair of trainers on eBay.  Everything seemed fine until just after the eBay 30 day mbg had expired.  The buyer contacted me with photos showing me that both shoes had ripped.  He wanted his money back, and after refusing to refund him, he then left me retaliatory and defamatory feedback on my profile to the effect that I had sold him fake trainers (this was removed by eBay).  He then initiated a chargeback via Paypal.  Invariably, the outcome was in his favour, and I have now been charged for the cost of the trainers.  I would have also been stung for the chargeback fee, but eBay refunded this.  Incidentally, I do have the email receipt of the trainers from when I bought them from a well-established and bona fide online retailer.  The susbequent conversation with eBay followed its predictable course, i.e. the chargeback is out of their hands etc. I have been in contact with citizens advice, and my bank.  Citizens advice told me that as a private seller I'm responsible for the "Title and description" of the goods, but not the performance, or the fitness for purpose.  To me it is clear; if you receive something that's not as described, you don't then use the goods, and more than 30 days later claim 'not as described'.  In my mind, this makes the claim fraudulent.  He's used the 'they're fake' card to give credence to a 'not as described' claim here, obviously, without any evidence.  My understanding is that the chargeback is unlawful, because the trainers were shipped as described.  However, I read something on an eBay forum regarding sellers having no statutory rights, i.e. no right to appeal against a chargeback decision, or to complain to the financial ombudsman.  Does this mean that if my bank disputes the charge on my behalf, it will be to no avail, even if it's recognisably a fraudulent chargeback?  I have reported it via the Action fraud website. Any advice, anyone?  Would be most grateful!
    • Thank you, I have drafted my letters and started to complete the reply form, printed from this site and not using the one they provided.    2 questions, on the forum link it says to tick box D & I, the reason for box D will be given on my thread, what would my answer be to "I dispute the debt"?  Do I send anything for the Vodafone debt they have included?  I've only done 118 loan s. 77 & capital one credit cards so. 78    Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

could someone please take a look at my thread welcome finance ppi ripoff i need to get my POC together to take them to court for secret commissions it is a bit of a read but the last three pages are where i am at at the momment and had thier final sarcastic response FOS have been of no real help and seem to be backing them.

This morning I had a letter from my local branch from a person called Txx Exxx asking me to contact them.

 

I already have a letter from their Complaints Dept agreeing that the branch cannot contact me by phone.

 

I have changed my phone number anyway.

 

So they must have been trying to call my old number so broke their Head Office instruction.

 

So I called them and witheld my new number naturally.

 

A man eventually answered and I asked for the woman Txx and he said that nobody of that name works here but is at another branch.

 

Probably another Welcome lie.

 

Anyway I said that my local branch is not allowed to call me and referred to the HO letter that confirmed this and he eventually found it.

 

Then he said where is your three monthly Income & Expenditure form.

 

I said that I sent it via Recorded Delivery in June and he said we don't have it.

 

He then started to become very arrogant and said you owe us money to which I said " I am now going to call HO and complain once again.

 

I then put the phone down.

 

Tried to get through to their Complaints Dept but was put in a queue and gave up after 12 minutes ....:-x

 

I then called the Post Ofiice and it was never signed for and must have been lost in the post.

 

They also said that if it had been delivered and nobody was there to sign for the letter, then there would have been a report logged to this effect.

 

So not only are my personal details lost somewhere but I have to send this information to them once again.

 

This time I will send them via Courier who has to get a signature.

 

Anything to do with this company just makes me mad.

 

I loathe them with a passion.

PS. Which reminds me, I had better check with the Post Office that they have received my SAR.

Ive had an offer from Welscum regarding my ppi. Im confused tho :(

 

IT says Total compensation offered : 1479.52

Compensation being applied to the balance of your current loan £285.85

Compensation being applied as an adjustment to your current loan £1193.67

 

also on the break down of how theyve worked it out, theres two different loan numbers. I have one loan and i signed one agreement????

i also have to loan agreement numbers lol only differnce is i didnot sign the second one and the first one says on my credit report that it got paid off lol,which is why i am cca ing them with the second one cos i know they dont have an agreement for that one :) if they dont have an agreement with your signature on it then F them :) ps NEVER SEND A LETTER TO THEM WITH YOUR SIGNATURE :)

Does the total sum offered exceed any arrears? If so they must pay the balance direct to you & not set it against the loans

well i havnt paid in months but i have no idea what the arrears are. oddly there not badgering me for payment. i still dont understand the figures.if i accepti get 285? i dont understand the loan numbers either. one says closed the other says active but i only signed one!!!! also they have been insisting for weeks i dont have ppi!!!!!!!!!!

Get the ref number from ur credit file for the agreement u did not sign then cca them :) they will reply with a letter sayin to give them ten quid first,,dont send it,but instead cca them again,iv sent 5 cca requests and keep gettin same response,im building up paper work for ME taken THEM to court :) if u need any help just ask :)

haha is right.I sent them a cca ages ago and only got one agreement back. mmm ill have to dig it out cos i still have the original.

Hi, In March I got a letter from a company callled MKRR stating that they have taken over my account from Welcome. I have written a CCA to them allowing correct reply time and nothing. I also telephoned them last Wednesday and they told me it was in the post. De ja vu.......(with Welcome)......what do i do now?......I have been paying £100 per month to MKRR since May. I am paying no more monies to them as i believe that they legally do not have a leg to stand on if they cannnot produced legal documents? Please can someone give me some advise where togo from here. Very much appreciated.

Hi im also having problems with welcome,they are adding £150 interest to my account every month,dont know what to do! can anybody help?
You need to start by geeting all the info about your account. If you don't have regular statements, you will have to send a SAR with £10. Make sure you aske for the underwriteing sheet specifically if there is any insurance on your loan

Well, that seems to be a first. They appear to prefer first contact to be by telephone. Idiots.

 

I suspect, but I do not know for sure, that Welcome are selling on accounts where they know they would have trouble enforcing the debt.

 

Only time will tell. As yet, I haven't heard of anyone managing to get anything like a CCA from them, enforcable or not. Early days. But as they learn what this debt purchse lark is all about, at least we'll get to see at first hand whether or not Welcome have stitched them up good and proper.

 

Since they don't appear, from what you say, to have come up with a satisfactory response to your perfectly reasonable request for a copy of your agreement, you are not obliged to continue paying them a penny. I would NOT advise you to stop paying them. But I certainly cannot fault you for it.

Well i have not sent the sar yet & have a mesage left by welcome to say phone us we have some good news for you!!! After them telling me 2 weeks ago we can sort this the nice or the nasty way! this company is awful....i just want to pay back what i owe them,not get ripped off with their charges...does anyone know what this good news could be??

Never done this before so I hope this works! My partner an I got a loan from Welcome Finance in September 2007 for £2500. We have missed payments along the way bet agreed to pay £200 pm compared to the £165 in the agreement. This has gone on for ages and the payments have been getting made each month. My credit report says my balance is currently at £2600 but then we received a phonecall from them saying we could pay off the loan at reduced amont of £3600! We have paid way more than this in the last 3yrs and our balance doesn't seem to be going down AT ALL! Our agreement was over 3yrs and this comes to an end in September this year. I feel like telling them they can stick it and that i'm not paying them another penny but i'm not sure how this will pan out. Do I have any rights to do this and what will happen if I do? I have also had the usual problems with them such as up to 13 calls a day, doorstep visits and bitchy staff. My partner an I both work, have a mortgage and 3 kids under 6yrs and we are really struggling to keep up these outrageous payments when they don't seem to be making any difference to the balance. Did you or anyone else have any luck in getting rid of these leeches? Please help!!!

do some reading in the welcome forum too

 

they are the biggest leechers ever and i would suspect they owe you!

if you're getting 13 calls a day, thats 13*£25 they are charging you.

 

you can claim EVERYONE of those call charges back & the letters charges and a whole lot more +++++interest on top.

90% of the time welcome owe you!! ... that is if the agreement is not pants as well!!
