    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Im probably wrong and hopefully someone will correct me if i am but im pretty sure any agreement that wasnt signed is unenforceable??

 

We have a modified hp agreement but that was signed but our darling local manager has written us a nice new reconstructed agreement to make the figures add up :rolleyes: which isnt worth the paper its written on as no one has signed it and it doesnt add up anyway silly mare has the total payable as less than the amount of credit for goods and just randomly added them together :rolleyes::lol::grin:

I am a consumer just like you, please get a second opinion or investigate yourself on anything I advise as I am in no way legally trained. Everything I know has come from the Mighty CAG and fellow CAGGERS. :cool:

since i posted this comment I have actually found a signed copy......but....it looks like a forged signature to me. Does anyone know how I could go about proving my signature has been forged ??

when u say forged? do you mean as in they signed it or copied the signature over?

 

if they have signed it, then its been suggested to get a specialist to analyse it which I think costs between £100-£200.

 

if they have copied it, then you can try finding the original signature in your paperwork and match it up. I dont think I have ever seen two signatures the same size that would match up line for line. This would point to someone cutting and pasting it.

I will have a little sift through the docs they sent me

 

I am 99% certain its been copied as I dont have an original copy of it. since 2003 I always keep agreements until the account is finished so I was surprised to get it in the SAR. I find it highly suspicious though as there are 2 signatures, one in the customer box & one in the PPI signature box which raises the question....why would I sign the box if the loan has no PPI ?

no not the same slightly different, another of the agreements they sent me looks like it was faxed the signature on that one looks like a ruler was used (go figure ???:confused:)

 

Will let you know when I have looked through paperwork I think one came from my drivers licence!!

are the signatures the exact same? if so it would indicate it has been copied in my opinion.

 

If you find one on an agreement that looks very much the same... then get some tracing paper and trace one... lay it over the other then match them.

 

No two signatures are exactley the same.

 

I done this for some signaturres on a ppi agreement and the company backed down as soon as i said i would have it tested for confirmation.

BOO!!!

 

just looked at the agreement, cant find 1 exactly the same.

 

I have also looked at my 2nd agreement with them & something just doesnt add up.

 

I have looked at all the copies of my signatures welcome have & none of them come close. I know I didnt sign the document they have sent, the figures on it look like they have been traced over the top (if you r writing a single zero you would get it in the box) it doesnt line up correctly. Where my name goes its hand written too high in the area. Also when you sign a document you sign it by the words "your signature" it appears by the words new terms in the box. I would never sign it like that.

 

 

On agreement 2 I am lucky enough to have the actual original copy. The address is typed differently on their copy & the welcome staff members signature is completely different plus on my copy I signed once, theirs has 3 seperate signatures for me. Plus the added fact that their copy is a template which has the numberplate as ABC1 DEF!!!

 

So which authority do I go to to accuse them of "alleged" fraud ? :lol:

Well when i turned up to see the boys in blue...they had no one who did that!! apparently... not even CID?? but then they had a bulldog on the counter who knew nothing....only how to growl!! SEE A SOLICITOR!!! Is it any wonder we complain about everything..taxpayers money to the banks, the politicians and the pit bull at the local police station...its the world gone mad!!!

well had an interesting morning, spoke to the FOS who told me welcome are at least two months behind with payouts on insurance rebates and still have no figures then told to ring welcome and ask them for the figures, so thats what i did, now welcome are saying that the 12 weeks they quote for payouts are from when they look at your letter from the FOS not from when they recieve it also they are only now looking at the figures for claims they recieved in August so thats four months behind to my reconing, also if I want my repayment without any further delays I have to sign a new agreement, at this point I had lost me sense of humour and told the droid that when the refund is calculated it would clear the agreement he of course disagrees, so told him I would not put my signature to any welcome document under any circumstances as this would give them an enforceable agreement which they currently dont have he asked why and I then gave him the list of all the things wrong with my agreement to which he replied I dont know anything about the legal side of it all you need to make a complaint having told him the account was in dispute for nearly two years with a four inch thick file of letters, and the FOS being involved for the last year, I then realised this is welcome and they just sit there acting as if they kn ow nothing just to wind me up, so told him to go back to the nursery with the other idiots and the FOS would be in touch.

So rang the FOS again told them the whole sorry story the lady was very helpfull and sympathetic and informed me the the whole of the complaint had now been moved up to a full review due to welcome messing around and they would be contacting welcome again to get thing resolved as quick as possible as they know welcome are using whatever delaying tactics they can even with the FOS so Im back to waiting again.

mine was 12th august and i am still waiting when i rang they didnt give me any idea how long it would be anyone know any different
