I had the funniest conversation with Nottingham CRC last week when they mistakenly tried to call me to chase an account that complaince have asked them not to collect on - it went something like this

 

WF: Is that Andrea?

Me: Yep

WF: Hi its X from Welcome Finance

Me: Yes?

WF: Can I ask your password?

Me: Yes

WF: Err excuse me?

Me: I said yes

WF: Err ok what is your password

Me: I don't know

WF: It begins with P

Me: So do a lot of things I don't know it

WF: Ends in R

Me: Again so do a lot of things I still don't know it

WF: Ok well for future reference it's XXXXXXXXXXXXXXXX

 

He gave me my own password!!

 

What a dill!!

 

Begins with "P" ends with "R" - to do with Welcome.... got it! Plonker!

Welcome called me at work today , I suspect it something to do with the account being ''in dispute'' for 3 months.

 

I tried to paitiently explain last time that I wasnt going to pay another penny unless they correct the host of errors that appear across 2 agreements.

 

I am not quite sure what to do now , take them to court or wait till they take me to court.

Charge for credit on Insurance

Term stretched to 41 months

Interest charged on amount already paid ie Interest added to total before old payments were removed from total

Welcome used to try and phone me when I was at work, or should I say they used to ring the office, and when it was explained I was out and about in my truck, tried to obtain the number for cab phone. When that didnt work they'd ring back a little while later and leave a message as if they were a friend. This was all done despite them having my mobile number. That was over a year ago now though, I'm curious as to whats happening, as apart from a phone call in July to try and get money out of me, I haven't heard anything from Welcome lately. Did find some recent default notices in my sar, but unfortunately (or fortunately) they've been sent to the wrong address. Also notes in transcripts about them wanting to uplift car but again trying at wrong address. Am I right in thinking they cant take the car without court order due it being parked on private property, namely our drive? I haven't paid more than a third, to be honest have been unable to make a payment for well over a year but never received, nor found anything in sar, about being taken to court.

Hi I just need a little advice, here is the story very shortened version. I took out a car loan in 2001 with welcome finance, In 2003 i voluntarily handed the car back on a voluntary termination as payments were awful and i knew i could get a better deal somewhere else. I took out ppi, and in 2004 they wrote to us stating that the insurance part of the agrreement had to be paid even though we had handed the car back. In 2004 we paid a debt collection agency a settlement figure and received a letter stating full and final settlement.

 

we have just found out that this is still showing on my credit file as a default but i think i have now sorted this.

 

In the meantime i also wrote to them re: missold PPI, I Know that this was over six years ago, but I thought it was worth a shot.

 

I have received a response from them today:- here goes.

 

1) your client entered into a loan agreement on 07/11/2001 with the agreement being settled 09/07/2007 (wrong) - does this mean 2007 I am still able to claim ppi misselling

 

2) we would have sent you a policy schedule and wording in which i would have 30 days in which to cancel the ppi which should have given me the opportunity to read through the policy information which covered any cancellation rights. ( I never received a policy that I can remember)

 

3) I have alleged misselling may have occured- this would involve the sale of a policy that was not relevant to the personor on whicxh they were unable to claim, our records show that you have paid for and enjoyed the benefits of the purchased insurance for the term of its respective existence ( Wrong becuase i voluntarily terminated the agreement and was still paying for the insurance in 2004)

 

4) i would like to point out that my loan agreement pre-dates the regulation of our business by the fsa and therefore the principles i seek to rely are not applicaple ( Am I out of time or are they just trying to put me off)

 

5) I do not beleive you would be able to refer my complaint to the courts to begin legal proceedings in view of the length of time that has elapsed since my ppi was cancelled ( but it was still active in 2004 and to there records settled in 2007 so why cant i claim)

 

6) should i decide to refer my complaint to the FSA we would request my claim be dismissed on the grounds that it has no reasonable prospect of success ( can they say this)

 

 

any help would be great as I am wondering wether i should persue this any further.

I have received a response from them today:- here goes.

The default will saty on your credit file for 6 years after it was entered btw regardless of if it is settled or not.

 

2) we would have sent you a policy schedule and wording in which i would have 30 days in which to cancel the ppi which should have given me the opportunity to read through the policy information which covered any cancellation rights. ( I never received a policy that I can remember) - surprise surprise! No-one has ever recieved one until they complain then they claim you would have had it and knock another one up for you - the best way to describe what it looks like is an 8 year old using Word!

 

3) I have alleged misselling may have occured- this would involve the sale of a policy that was not relevant to the personor on whicxh they were unable to claim, our records show that you have paid for and enjoyed the benefits of the purchased insurance for the term of its respective existence ( Wrong becuase i voluntarily terminated the agreement and was still paying for the insurance in 2004) - They need to prove the rebated you for the period after termination for starters - however "enjoying the benefit" is only if you made a claim - if no claim was made and it was mis-sold because you couldn't have used it etc there is no "benefit" to enjoy.

 

4) i would like to point out that my loan agreement pre-dates the regulation of our business by the fsa and therefore the principles i seek to rely are not applicaple ( Am I out of time or are they just trying to put me off) - There is an alternative body you can go to for those that pre-date FSA regs I'm unsure of what it is but will try and dig it out unless someone else can jump in with it.

You have 6 years Ruth so if it was paid off in 2004 you have until the same date in 2010 to claim.

 

I would send them a reply to that effect and ask if this is their final response so you can start to issue preceedings against them.

thanks for your reply. I have contacted the FSA and they are off the opinion that i would have to get in touch with the brocker/underwriter of welcome finance who issued the ppi as they havent got a claim for welcome before 2003.

 

do you still think this is worth the effort, dont really know where to go now.

 

this letter is really getting my back up though.

Wow, 428 pages. Tried to read through some of it, but most over my head. Basically took an unsecured loan out with my partner many years ago with Welcome Finance (before April 07). Haven't made a payment to them for at least a year, but no default letters or anything. Not sure if got original agreement (will have to dig through cupboard of paper.. lol).

 

Wondered if I should request copy of my agreement (subject access request or cca (not sure what difference is?), or just keep quiet with them not contacting me for so long?

 

Wondered if someone could advise me on the basic first steps. I apologise if it's already been posted, did try and look through this post, but found it hard with so many pages....

Welcome have said its nothing to do with them, its the Car Dealers

 

Wrote to The dealers, they said they cannot refund or cancel the PPI, I have to go back to welscum, and that I would have had a period of 30 days to change my mind!!

 

I NEVER even recevied any documents, until I was unemployed.

 

The same apparently applies to the Mechanical Breakdown, apparently (NOT) I had a choice at the time of buying the car.

 

And its my word against the long gone Salesman @ Car Craft.

 

They also sent a letter for me to sign if I do not agree with the final letter they sent.

 

WELL of course I don't agree with them!!

However, I've also read stuff about people getting refunds, etc... and I really can't remember what I took out when I took out the loan it was so long ago, which was why I wondered whether I should look into it....

 

Was also worried if kept quiet, then loan was sold to another company, whether it'd be harder for me to prove loan was unenforceable (if it is?)...

 

Sorry if sounding really thick...and don't know what I'm talking about. (which is more than likely true for the most part.. lol)

Postggj - was that post meant for me regarding insuranc products? What info will I need to give them when I phone up, as don't have welcome agreement number to hand. Would I just give them my name/address?

 

Or, if it's not, after my last post about refunds, writing off debt, still reckon to keep quiet if not heard from them for about a year?....

 

Don't mean to be annoying by asking basic questions... so apologise in advance...

I have now decided to take the matter further, welcome finance defaulted me on my credit file for something that should never have been there. this have been on my credit file since 2004, i contacted welcome finance and they have agreed to take this off and i have since checked with experian and the default has been removed and is now showing as settled. this has caused me unneccesary stress over the past six years, as having had this on my credit file has deterred me from obtaining credit. I have decided to have a go at taking them to court under data protection, just need to get my head around it all first, if anyone has ever done this or had any success i would like any tips available.

yes pls post,

 

PM it to me & I will scan it over to you tomorrow. basically you would only get anything out of their PPI if you died or had a very bad accident. The unemployment bit is laughable.

 

btw the mech breakdown rebate was for a new carboretta (spelling ?)

 

That was after having the car for 5 months so I reckon they thought they had better pay up or I might not pay for the car.
