    • Hello, Following the submission of my defense, last night I received an email from DCBL indicating that the claimant intends to proceed with the claim (I've attached a screenshot of the email for reference) along with the N180 directions questionnaire. I'm unsure how they obtained my email, but I suspect it was through the courts' form when I completed the Acknowledgment of Service. This email almost slipped my attention. I have also today received a letter from court to state they have received my defense.  It appears they are requesting an online telephone hearing with the court.     • Default Amount £9237.88, all this started in 2006 Admitted debt £9075.65 Weightmans added £1515.01 immediately they became involved, no explanation The Statement shows when Marlin bought debt in May 2011 £10439.25 Their statements, not received until the SAR, are based on this. Cabot deducted £1515.01on their statements in January 2019, again did not find this out until SAR. Weightmans added in  2007 after the CH1 etc was confirmed by the court £741.50, made up of Process server fees, Court Fee (they tried for bankruptcy), Solicitors fee and Land Registry fee. Unspecfied Legal costs were added by Marlin in March 2015, again I did not know this until statements received with SAR I had been paying monthly, without exception until December 2018. I am minded to take the property charge, CH1 amount ,deduct all my payments and the subsequent fees, and request/demand a refund on the final payment made? I consistently disputed Weightmans balances, but they never responded. I also told Mortimer Clarke/Cabot that I disputed their amounts.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

thanks for that advice, we will go for that. My daughters family has this loan secured against their property, it dates back to 03 with remnants of an 02 loan added and also includes remaining interest from a car HP loan (year 2000) for which no rebate was given when absorbed into second loan after paying 20 payments out of 36. Both these 2nd and 3rd loans are not executed properly with no cost of credit brought out, interest on fees, PPI and loan rolled into one and not as multi loan, number of payments quoted as an estimated period and not a definite number, also adittion of all the bits on loan is incorrect by a few hundred pounds (current loan). These 2 agreements are pure Walt Disney, I have written to compliance with all the errors quoting relevant CCA1974 sections, but they dont answer. Since reading this forum from March I have now managed to get them to agree unenforceability and not properly executed based only on the addtiion error at present. We dont have to pay unless we want to and they wont add to the debt, so they say. I want the security canceled and idealy have the loan completely scrapped. But so far so good, thanks to continued reading of the forum.

Hi, Thanks for the reply.Have been reading this thread all weekend.It is amazing.(Still only on page 93:D)

 

Have had a look at the paperwork but all daughters boyfriend has is a Statement of Price...which he had to sign???

We have today requested a copy of the agreement which he says he can't remember signing.(They have taken him for everything...ppi Accident ins and Lifecare for 5 years ...even though the agreement is for 3years)So we will see.

 

As for the payments he has requested Welcome NOT to take anymore payments from my daughters card and he is going to pay cash at the local office every week.They seem to have agreed to this so again...We will see.

She did ask the bank for a new card and they are sending her one but they have said this may still not stop the payments although surely it should if that card is cancelled.

 

Thank you all for taking so much trouble to keep people informed...I shall now return to page 93 and hopefully will catch up soon.

Just a quick question guys....

We went to local Welcome office today to pay the weekly payment in cash.The request for CCA was hand delivered to this office last Monday 07/09/09.and signed for.

We were told today that the person dealing with our account was still on holiday so hadnt even seen the letter although a copy was seen and signed for....so it hasnt been dealt with yet.I think they only have until Friday to deal with this matter or have we done it wrong by sending it to the local office.

Should we do another letter to Nottingham.

Thanks for the quick reply.We will do that tomorrow. Will let you know what happens and start a thread as soon as we get anymore paperwork.I think there is alot of worrying things regarding the bits of paper we have so far.

Certainly was conned.It's my daughters boyfriend and boy did they see him coming.....His Pre-contract paper says APR 72.24. and the Interest on PPi and other insurances is more than the things themselves.

I can't wait to see the actual agreement....if there is one.

 

Good idea about the book.....It could save alot of people from alot of misery.

it means welcome are in big trouble

they are trying to get a standstill agreement, this means trying to get the bond holders etc to lay off the preasure

 

now cattles invoice finance has gone, cattles have nothing left that makes any money

 

the bond holders want there money back and my feeling is they will say no way jose to a stand still agreement

 

its going for the throat time now me thinks

 

told you once cif went it would be quick

I am kind of hoping Welcome will be no more by then but who knows they seem to have more lives than a cat.

 

On another note Welcome have sent me a default notice this week even though they agreed to not chase us for payment pending the outcome of our FOS complaint. They have really hacked me off now. Even though it is your standard mickey mouse default notice it has scared me a bit as ours is a secured loan.

you can put an account into dispute after this

 

if it was the 7/09/09

 

the date would be by close of biz today

you can now legally with hold payments if you wish
