    • Thanks for posting the CPR contents. i do wish you hadn't blanked out the dates and times since at times they can be relevant . Can you please repost including times and dates. They say that they sent a copy of  the original  PCN that they sent to the Hirer  along with your hire agreement documents. Did you receive them and if so can you please upload the original PCN without erasing dates and times. If they did include  all the paperwork they said, then that PCN is pretty near compliant except for their error with the discount time. In the Act it isn't actually specified but to offer a discount for 14 days from the OFFENCE is a joke. the offence occurred probably a couple of months prior to you receiving your Notice to Hirer.  Also the words in parentheses n the Act have been missed off. Section 14 [5][c] (c)warn the hirer that if, after the period of 21 days beginning with the day after that on which the notice to hirer is given, the amount of unpaid parking charges referred to in the notice to keeper under paragraph 8(2)(f) or 9(2)(f) (as the case may be) has not been paid in full, the creditor will (if any applicable requirements are met) have the right to recover from the hirer so much of that amount as remains unpaid; Though it states "if any applicable ...." as opposed to "if all applicable......" in Section 8 or 9. Maybe the Site could explain what the difference between the two terms mean if there is a difference. Also on your claim form they keeper referring to you as the driver or the keeper.  You are the Hirer and only the Hirer is responsible for the charge EVEN IF THEY WEREN'T THE DRIVER. So they cannot pursue the driver and nowhere in the Hirer section of the Act is the hirer ever named as the keeper so NPC are pursuing the wrong person.

    • Good afternoon, I am writing because I am very frustrated. I received a parking fine from MET Parking Services Ltd , ( Southgate park Stansted CM24 1PY) . We stopped for a quick meal in Mcdonalds and were there fir around 30 mins. We always do this after flights and never received a parking fine before.  Reason: The vehicle left in Southgate car park without payment made for parking and the occupants southgate premises. they took some pictures of us leaving the car. i did not try and appeal it yet as I came across many forums that this is a scam and I should leave it. But I keep getting threatening letters.  Incident happened : 23/10/2023 I did contact Mcdonalds and they said this:  Joylyn (McDonald’s Customer Services) 5 Apr 2024, 12:05 BST Dear Laura, Thank you for contacting McDonald’s Customer Services. I’m sorry to hear that you have received a Parking Charge Notice following your visit to our Stansted restaurant.   We've introduced parking restrictions at some of our restaurants to make sure there are always parking spaces available for customers.   We appreciate that some visits such as birthday parties or large group visits might take longer and the parking restrictions aren't intended to stop this. If you think your stay will exceed the stated maximum parking time then please speak to a manager in advance.   Your number plate is scanned by our Automatic Number Plate Recognition (ANPR) system when you enter our car park, and then again when you leave. If you have overstayed the maximum time allowed, you will not be notified straight away- a Parking Charge Notice will be sent to you via the post.   If you feel that a Parking Charge Notice has been issued in error, please contact our approved contractors who issued the charge in order to appeal the charge. Unfortunately McDonald's are unable to revoke parking tickets- the outcome of the appeal is final and cannot be overturned by McDonald’s.   Many thanks for taking the time to contact McDonald’s Customer Services.   Can someone please help me out and suggest what I should do next?  Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes, they are that stupid. They charged me many times for this exact reason and this is what led me to start investigating my account. I would ask them for a statement to check, chances are they have been charging you £10 each time they have called. I phoned several time to query these charges and was told that they would continue adding charges unless I set up a DD, which I refused to do.

Yes it has dates and then the payment running total debited off

 

Then it has date - Capitilisation (interest) and the running total credited.

 

At the bottom is then that nice little disclaimer about interest being added on the amount outstanding AND the acceptance fee - sure thats for those people that didn't get it on their contracts - why what you thinking??

I had a letter this morning from Welcome Finance, Data Services, Mail Centre, Middle Bank, Doncaster, DN55 1WG enclosing a Direct Debit mandate.

 

They are having a laugh aren't they?

 

If they were to read my letters ( which obviously they don't ) then they would know my current financial position.

Hi Andie - they are having a laugh surely they must know if you feel the need to complain to CEO then you are getting nowhere with department you are complaining about.

 

I have not had reply yet but I expect to get the same response. The only thing was I did say I did not want this being passed back to dept 33 in my original complaint so I won't be happy if they do. I will keep you posted.

Just a quick query - we got a final response to our complaint from Welcome CRC last week but I noticed that on the envelope they had put a sticker saying if undelivered return to :

Welcome Financial Services

Bishops House

Abbeyfields Road

Lenton

Nottingham

NG7 2SZ

 

I have not seen this address before but is this where CRC are based and not in Mere Way as I previously thought.

I had the same today too. The cheque is acceptable statement on it made me smile. My local branch are not accepting cheques, wanting cash or debit card only!!!!! they actually returned the cheque i sent in!!

 

I should take the cheque back with a copy of the mail shot, that would p**s then off.

Thanks for that. i am thinking that as point one of my OH's case aginst them is to force them to remove any interest charged for the whole time they have not supplied an annual statement (that is ever lol) and we can then work with that amended figure for the rest (refund PPI, DPA breach charges etc)

 

Will be doing this with RBS also methinks. Thing is, with a normal high st loan it works out only a few hundred in interest to be refunded but with WELCOME interest rates???!!!

 

Thats a much bigger fish ;)

 

I think it would be too easy for **** companies to just make false entries saying statements were sent so a full SAR first, and if they are not there (or you have not already received) then you could take this route.

 

Have asked for opinions on this in the Legalities section too.

I personally think that they are relying on the fact that FOS takes forever and are hoping we all just disappear. I don't believe for one minute that Andrew Moss has even read our complaints. I understand he can't personally respond to every complaint he gets about NU - and lets face it he must get a lot - but his office could ensure that these complaints are dealt with properley without passing the buck.

So I am sending letter looking charges back, Letter of dispute given sar hasn't been fulfilled, and another letter asking wht i have documentation relating to ppi when they said in a final response i never got ppi.

 

Now for the advice. My cca looks ok except for a box at the bottom where a preexisting account number should be filled in. This has been left blank is that enough to void the agreement?

They are trying to get in as much money as they can.

 

I would not trust this bunch of confidence tricksters one second as they could drain a person's Bank Account in one second flat.

 

If everybody across the UK with a Welcome Finance loan were to cancel all their Direct Debits for one month or more, then this loanshark type company would go belly-up immediately......... :idea:

Hey All

 

Ho hum still waiting on a settlement figure from Welscum, supposed to be moving out next Tuesday....there's only £5,000 equity left on the property, pretty sure they will have their greedy hands all over it, but I'm still gonna claim my PPI and all my charges once I get my head together & dismiss the resentment that is bubbling up at the moment. In the meantime I've reported them as loansharks on the DirectGov website :cool: it won't go anywhere as they are apparently legal, but felt compelled to make the point that they fit at least three of the descriptive categories for defining a 'loanshark' as detailed below!

 

 

  • they rarely give any paperwork to the people they've loaned money to - making it very difficult to keep track of how much is owed
  • if payments are missed, they often use threats and violence to get more money
  • they charge extremely high rates of interest and also add other 'charges' to loans whenever they want
  • they take away people's bank cards as 'security'

In fairness (Ahem) i've never heard of them taking a bank card as security, but they bloody well take everything else.

 

On the plus side, had a wee meeting with my really quite useless lawyer (bless) and a quick squiz at my PPI doc, def NU underwriters & def DG admin & def sold by welcome...all in the lovely welcome coloured printed brochure, like it was designed and printed by...er .....welcome. I'll be getting these docs back soon then inspired my lawyers complacency I'm gunning for them again. Fires have been stoked.

 

Lets hope someone at Directgov has a conscience.

I am sorry to hear of your plight.

 

But also look on the bright side that you can start again and will be free of Wellscum.

 

I am going for a DRO soon and I will be free of these ba****ds too.

 

At all times I have written to WF to keep them abreast of my financial position and apart from two letters from CRC Complaints, I have NEVER received one single reply from many letters that I have sent to their branch.

 

At least I am not being plagued by phone calls from them as they know that they can't get " Blood Out of a Stone ".

EBOY - an insufficent SAR is not grounds to put an account into dispute and stop paying - sorry
