    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, sorry, too much going on cannot get on much for a few days but you know how it is...I just cannot help peeking in lol

 

I am drawing up one more letter to Welcome in reply to their latest joke response to my complaint. It great, they say "regarding my complaint about their breach of the data protection act, as this was 'so long ago' (3 years lol) they cannot find any evidence of this"

 

Oh really? Then how n the hell did my partner at the time find out I had a loan with them, be able to settle my loan, know the financial details and my account number appear on his agreement?

 

All because his address was the same as mine, they asked him who I (Miss Dipply) was to him and he said 'girlfriend'. On the strength of that they told him I had a loan (yes, my own private business thankyou), how much I borrowed, that I had no arrears and how much to settle and forced him to settle it.

 

It is this I really want to sting them for in court as its not for the FOS and the ICO is about as forceful as a grumpy gummy bear but don't know where to start.

 

I will update my (now very old) thread in a few days and would appreciate any advice!

 

Will be able to get back on track and start helping out again, sorry :(

evening everyone :) - we sent a letter to compliance at the end of march putting our account in dispute re: interest on acceptance fee. We then got a call from complaints dept saying that they were investigating and in the meantime we should continue payments even though we had put account in dispute.

We then received our subject access request and in this was the final response to our complaint, which had been sent to our old address on 2nd April (this was sent there even though this loan was taken out at our new address). It basically said our agreement was enforceable blah blah blah same old welcome c***. Anyway we phoned them to advise we will now complain to ombudsman and account still in dispute, which we will confirm in writing. However complaints dept don't really understand what this means so we asked why it wasn't being dealt with by compliance. They gave us compliance number as they didn't know. After 2 days of persistent ringing we finally got someone to answer and they were very rude and said we don't deal with this and passed us back to complaints. We are getting worried now because we are being told our persistent non payment will have an adverse effect on our credit rating and as this is a secured loan we want to make sure they can not take legal action against us while in dispute.

We logged the complaint with FOS today but they said that although a company should stop all action when account in dispute they could not force them to do so. Does this mean we should continue payments or are we within our rights to keep account in dispute?

Millymo -legally you are within your right to stop payments Welcome know this they are chasing it BIG time!

Report them to OFT.

 

My account is in dispute - they have not argued it with me - infact they as always do not even bother to contact me - they never have done about anything.

Perhaps as I am in small claims court with them they know i'll go to the judge about them who does have power to stop them.

 

Maybe send them a LBA saying stop harrasssing or i'm filing in small claims.

I still don't really understand why our complain is not being dealt with by compliance when everyone elses seems to be - Maybe they have all lost their jobs:D

Thanks again Andie - I will definitely do that asap - Welcome are obviously trying to play games and I think they are relying on the fact this is a secured loan to scare us into paying up.

The thing is before we put the account into dispute we were only 1 month in arrears, which we explained to them, but the subject access request makes out like we are persistent non payers because we refused to speak to them on the phone. It is all very twisted and I am sure they have cherrypicked what they have sent to us.

They certainly do that millymo, i had a call at the end of Jan, thay asked to speak to my Hubbie, at 6pm, he was still at work, told them this, and then said but you can speak to me, their reply was due to DPA :grin: (Since when do they comply to this, if Dipplys post is anything to go by) they could only speak to Hubbie, I said no you can speak to me, account in joint names..their reply no it isnt!! this is when alarm bells started to ring!! I said no it is in joint names, always has been. 10 mins later rang back, had checked with local office etc, can i bring acct upto date...1 month missing, (this was their error not calling for direct debit).

On receipt of scrap paper they called, SAR call log for that conversation only lists what they want you to see...they delete half of it before they send it out by yhe look of it!!!

I logged a complaint with FOS yesterday too, ref no statements from inception to date....he was really unhelpful with all my other complaints and questions...waste of time really.

 

Have decided i will just keep adding all complaints one by one now, just to P**s them all off, like they have p***ed me off!! Miss-sold usless PPI next i think.

 

Have issued a LBA, ref non compliance to DSAR. WFC have untill Thursday to get their act together, so think i will email/post copies of all letters sent to Andrew Wakefield / Chris Palmer, and see what happens.... if anything?

Hi,

 

I am having some problems with Welcome and have just dug out this CCA and it looks as though i am paying interest on the acceptance fee. Would you guys who know what you are looking for have a look for me please;-)

 

This agreement was to spread my earlier loan over longer so i could pay less and i have obviously ended up paying alot more for it:rolleyes:.

 

When i got a copy of my Credit File today WF have stated that this loan is satisfied and entered another loan onto my credit file for the remaining balance in 2004 but as far as i am aware i didn't sign another agreement to pay £10 a month but i did speak to them on the phone:-?

 

I have had a few calls offering to take off a percentage of the debt if i can pay a bit more but never had written confirmation and it also looks as though they haven't done it from the balance shown on my credit report:rolleyes:

I did not take out a new loan with WF in 2004 but did however agree to start paying £10 a month but can not remember signing an agreement:confused:.

The thing i find even more strange is that if this new agreement was the balance of the first loan at a lower rate then why was it not satisfied until 2008:confused:. The original loan was for £500 in 2000/2001 and i still owe £617 8/9 years later:rolleyes:. Apparently i am no longer being charged any interest or extra charges. I am going to send SAR today.

Hi again everyone,

 

Just called CCCS and even if I do go for a DMP, a creditor can still refuse to freeze all interest and other charges.

 

As Welcome refuse to answer any of my letters in relation to this but my other creditors have agreed in writing then I will probably go for a DRO and then as far as I am concerned it's Bye Bye Welcome.

 

I did not trust Welcome's employees saying to me over the phone that they would freeze the interest and other charges if I went on a DMP ( Debt Management Plan ).

its just the brokers making out things are not as bad as they seem

just wait when the 2008 results are released when the auditors have done there thing,
