      Thanks all for all your input. I have decided to follow this all the way. So far, I have not replied to Alliance Parking's original NTK letter. The time-period for the reduced amount has now finished, and the time to appeal (21 days from the date of letter) will finish on 25th Apr. No further comms received from Alliance Parking. Could you please guide me, for my readiness, on what happens next? Am I going to start receiving letters from Alliance Parking > Debt Collector letters > Letter of Claim? Who sends me the Letter of Claim - Alliance Parking / Debt Collectors / Solicitors / court? How many weeks / months from now is this likely to be? Once Alliance Parking passes the debt off to the Debt Collectors, is there a risk of anyone turning up at the door? Do I need to reply to any other letters from either the parking company, debt collectors, or solicitors? Many thanks in advance.

      Hello,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

      We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Acf Is An Independant Micky Mouse Car Dealers.

They Get The Finance Through Welcome, The Funding Corp, Or This Is For The Old Hands, Forthright Finance.

Other Dealers Were Ucan, Yes Car Credit, Approved Car Finance, Etc

 

There Are Very Few Actual Finance Companies

On the Back of my Green Copy which is headed Terms of Credit Agreement Regulated by the Consumer Credit Act 1974, it has the following 6 Sub Headings:

 

1) THE LOAN INTEREST AND REPAYMENT

2) ACCEPTANCE FEE

3) OPTIONAL PAYMENT PROTECTION INSURANCE

4) DEFAULT, EXPENSES AND APPROPRIATION

5) GENERAL

6) USE OF PERSONAL INFORMATION

 

There are further sub headings in these 6 headings.

 

All seems pretty standard stuff to me although I am no expert on these matters.

Just leave them be, the traders deserve to make the bit of money considering alot of them bought in at +10p they are making little bits of money back.

Someone leaked something somewhere. Volumes were so low previously,

this is either the work of some serious shorters ramping the price to wait for a BIG fall. Or someone has passed some critical infomation out in the market and now its created a buzz.

 

There is NO way in hell this is normal media speculation. Ive been watching this POS for way to long!

I hope your right tigga. im a bit confused about what will happen to them. i thought they were in so much debt and trouble that the creditors will take them and strip them bare of all current assets, including the loan book to clear there debt. i would not have thought there would be anything in the coffers to finance a re-structure.

I personally think they have been thrown a life line somewhere and markets have got wind of this and are going to rape this share to bits.

 

Either that or this is the biggest dead cat bounce in history!

 

If they dont go t*ts up then it will be a tougher Welcome that comes out the other end. Alot has been made of the lack of collections and re-writes so we have to ensure we have our sh*t together because they are going to be hungry after this.

 

And investors wont accept poor performance from them and they will have to show results, hence the collections are going to get very aggresive going forward. WATCH OUT!

yeah but in a much smaller format than now, rumour states may 5-10 branches but dont know how that would work when they have no money to fund any new business, thats just my opinion tho, like andie said lets concentrate on our own fights, and see what cattles anounce or toilet & douche anounce big losses ,fingers crossed

Its all speculation. Dont take what you read on the boards to heart.

 

You have a company with a loan book of £2.5 billion running from 5-10 branches. No way. They even spoke about door step collections taking over collecting. Thats not going to happen either.

 

They will downsize to properties they own. Not many.

 

I just know witht he re-shuffel the targets are going to be highly aggressive.

The only thing that does change...perhaps...is the person dealing with the problem.

We only represent such a small percentage of Welcome customers I dont even think we would make up a fraction :roll:

 

They collect something supid like £80 million a month on repayments. its those people who are not informed of thier rights, and possibly sitting on agreeements that are worth more as wall paper than a contract.

 

We can fight a good fight but Welcome are a good rival!

 

And on this parting note. Never under estimate the power of the short sellers!!! Like I have mentioned before. They are the pond **** of the stock market, they can make crap look like gold with diamonds incrusted on it! They break companies like Welcome every day.
