    • I (and other respondents) always advise “not getting caught in a lie” it hardens their response. Why would they now believe protestations of remorse and “I won’t do it again” if they've already seen you'd lie and say it was a one-off when it wasn't..  You can try approaching the prosecutor on the day, but "I wouldn't hold my breath" …..  
    • I told them that it was an accident and that I used the oyster card as my debit card was lost. However, they did an investigation and realised it was not a one off. I have told them how remorseful I feel and how a criminal conviction would result in expulsion from my degree but they still want to take me to court. I have received the court summons letter

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I hope someone will be able to give me the answer to this:

 

Sent SAR to Haliprats (fraud issue) in February, after constant letters and reminding them of their obligation to comply, only after 5 1/2 months did they decide to respond.

 

However they have only sent what they want me to see, no surprise there really, considering they know they are in the S**T.

 

The question I need to ask, am I now obliged or do I have to send them a non compliance letter given them yet another chance to fully comply with my request.

 

I just feel that they have had more than long enough, and I just want to go to court to make them fully comply.

 

If the answer is "yes" I can go straight to court, would I state on my N1 form "non compliance to SAR" or would it be "partial non compliance to SAR as they have supplied some information"

 

Any help would be greatly appreciated.

I'd contact the information commissioner , especially considering you waited 5 and a half months. Explain to them what kind of information you received , and then inquire as maybe the need for the data protection supervisor to undertake an assessment and retrieval of the information on your behalf if you think they are withholding data. Looks like you would need an independant person/dept in this case anyway . You can get them to go in if no S.A.R within 40 days, but you'd have to ask them if they would do it in this particular case.. which is somewhat different. But if the data protection supervisor is asked to perform just an assessment on your data.. he has to do it by law . So... maybe you want them assessed ? I think I'd get their opinion/assessment first , make for a better informed response on the N1 form .

 

There is no extension of the 40-day time period for obtaining consents. Failure to respond to a subject access request within the 40-day period gives rise to the ability of the individual to obtain a court order to require the data controller to comply with the request. In addition, failure to respond within 40 days will be a breach of the Sixth Data Protection Principle. Any person affected by the breach may bring an action for damages (provided they can prove loss) and any associated distress.

 

I think you seem very distressed over this disgraceful wait of 5 and a half months Nanna ?...

 

 

If everyone on this forum.. each put in a S.A.R - (Subject Access Request) to their respective dca on the same day , it would be devestating. A system meltdown ...

I have already been in contact with the ICO, my case has been passed to the department, that deals with the more serious issues, I am just waiting for them to contact me.

 

Yes I am huffed of to say the least regarding the SAR, I will issue a LBA this weekend to the Haliprats.
